HomeMy WebLinkAbout1991-03-07 EC MINUTESMEMORANDUM TO: ELECTION COMMISSION MEMBERS FROM: PAT CROW, CITY CLERK DATE: MARCH 7, 1991 SUBJECT: UPDATE OF ELECTION MATTERS Enclosed are several items, which require your review. First, the minutes of our meeting on January 22nd. Lou will give you a call in a few days to see if there are any corrections. If not, copies of those minutes will be forwarded to Council in their next agenda packet. As you already know, Council approved our recommendation to postpone any redistricting in the City of Englewood until after the State/ County reapportionment is completed. I am pleased this sailed through so well. So the current district lines will remain in effect for the November 5th election. A district/precinct map is enclosed for your information. At the February 19th Council meeting, Council approved on final reading Ordinance No. 12 (copy enclosed) which limits certain contributions a candidate for Council can accept. I will be including a copy of this ordinance as part of the candidate packet with a brief statement explaining how this ordinance affects the Campaign Reform Act reporting requirements. Minutes from the February 19, 1991 City Council meeting are enclosed. We will be sending these to you on a regular basis, just to keep you apprised of what's going on at the Council level. Also at Council's meeting on February 19, Council Member Koltay moved to table the proposed ordinance establishing employee residency requirements. Mr. Koltay strongly feels this will surface again, probably in the form of petitions calling for the question to be included on the election ballot in November. You may wish to review Charter §46 -SUBMISSIONS on page Cll. According to this section it would require 10% of the electors residing in Englewood who voted in the preceding gubernatorial vote for a special municipal election or 5% of the electors residing in Englewood who voted in the preceding gubernatorial vote for the question to be included on the ballot of the next regular municipal election. The County estimates there were 8,834 votes cast from Englewood precincts at the November 6, 1990 general election; therefore, 883 signatures would be required in the one instance and 442 in the other. So don't be surprised if petitions are circulated. I understand there is a strong contingency in favor of requiring City employees to also be residents. Mr. Koltay's proposed ordinance, as drafted, would have affected permanent and temporary employees hired after January 1, 1992. Until petitions are circulated, it's impossible to know how the wording or approval of the question would affect employees. Page 2 March 5, 1991 It appears there will be several Charter amendments on the ballot of the next regular municipal election. If you have any changes you wish to propose, now is the time to begin working on them . I am reviewing the Charter as it relates to "qualified electors" versus "registered electors" and will present you with a recommendation to see where the Commission stands on this matter. If you have any other ideas, please let me know. Our session with Council is scheduled for April 15 at 6:00 p.m., in the Community Room. This will be a brief meeting, probably no more than an hour long. The Election Procedures Manual will have been forwarded to Council prior to the meeting. The next Regular Municipal Election is November 5, 1991, and it is necessary for the commission to meet often during an election year. Our meetings are called as needed based on the election calendar which is established prior to the Regular Municipal Election. WHEREAS, interests located outside the City of Englewood should not be allowed to influence the vote of Englewood citizens for the Office of City Council; and WHEREAS, the existence of a "revolving door" type relationship has been derronstrated between candidates who, after having accepted PAC carrpaign contributions and upon having won election, have voted to use City funds to fund the interest of organizations closely associated with such PACs; and WHEREAS, the City Council feels that Englewood's elections are properly influenced solely by Engl~ residents and directly by its businesses; NCM, THEREFORE, BE IT ORDAINED BY THE CITY CDUNCIL OF THE CITY OF ENGI.EWX)D, COLORADO, AS FOI..LCmS: Section 1. The Englewood Municipal Code 1985 §1-5-2 is arrended to add the follCMing provisions under SUbsection 12: 1-5-2-12 CAMPAIGN CONTRIBUI'IONS A. No candidate or elected official shall accept a rronetary contribution of any kind fran a person or political carmittee not residing in Englewood. B. No candidate or elected official shall accept PAC (Political Action Ccmnittee) m:::mey from businesses or any other type of organization, association or chamber of camerce which does not maintain an off ice or place of business within the City of Englewood notwithstanding the existence of its custarer base, nernbership or affiliation with Engl~ citizen(s} and/or business(es}. c. Acceptance of any type of resource, financial or otherwise, fran any citizen group whose rrembership includes citizens who do not reside or who do not have a physical presence within the City of Englewood shall constitute a violation of this ordinance. D. Acceptance of any type of resource, fran any business, association or chamber of cc:.mlerce which does not maintain an office or place of business within the City of Englewood shall constitute a violation of this ordinance. E. -' Violation of this ordinance shall constitute a penalty assessment equal to the arrount of the unlawful contribution up to jurisdictional limits of the rrn.micipal courts lawful ability to impose.
