HomeMy WebLinkAbout1991-06-12 EC MEMO [2]MEMORANDUM TO: Rick DeWitt, City Attorney FROM: Pat Crow, City Clerk DATE: June 12, 1991 SUBJECT: PROPOSALS OF CHANGES TO THE CITY CHARTER I have reviewed the drafted council bills proposing various changes to the Charter and have the following comments regarding them: 1. Draft dated 4/18/91 amending Sections 6, 121, 134 -this looks fine; however, I would suggest eliminating the Question number at this time and let those numbers be assigned as the ordinances are approved. I have circled the numbers to be deleted on the attached copy. 2. Draft identifed as "CB2Chart 2/5/17/91" amending Sections 23, 34, 42, 45, 46, 47, 69, 104, 137:6, and 138:5 -this looks fine, except I believe we could include the recommended change to Section 15 in this one which would eliminate one ordinance and one ballot question. (See note below regarding Section 15.) NOTE: The draft dated 5/16/91 which deals with Section 15 as a separate question does not reflect the Election Commission's recommendation. The Election Commission only recommends that this section be changed to reflect "registered electors" instead of qualified electors. The Commission did not recommend any change to the number of signatures required for petitioning nor the dates in which signatures could be obtained by candidates. As stated above, it appears that this section could be incorporated into the ordinance identified as "CB2Chart 2/5/17/91" dealing with Sections 23, 34, 42, 45, 46, 47, 69, 104, 137:6, and 138:5. 3. Draft dated 5/22/91 dealing with Sections 7, 11, 13, 56, 59, and 61 does not reflect the changes recommended by the Council Sub-committee (Clayton, Bullock, Crow) which were forwarded to you on April 25th. The Election Commission did not make any recommendations for any changes to Sections 7, 11, 13, 56, 59, and 61. To reiterate the Sub-committee's recommendations to those sections: Section 7 -DEFINITIONS no changes recommended -to remain as is in the Charter. Section 11 -ELECTION COMMISSION no changes recommended -to remain as is in the Charter. , -2 - Section 13 -REGISTRATION no changes recommended -to remain as is in the Charter. Section 56 -COMMISSION ESTABLISHED (PLANNING & ZONING) no changes recommended -to remain as is in the Charter . Section 59 -BOARD CREATED (ADJUSTMENT AND APPEALS) The Council Sub-committee recommended removing "tax paying" from this section leaving it to read "Members shall be qualified electors , residents of the City ... " Section 61 -BOARD CREATED (WATER AND SEWER) The Council Sub-committee recommended removing "tax paying" from this section leaving i t to read" ... and six (6) members appointed by the Council from qualified electors, serving ... " The question would have to be revised and perhaps the following could be used: QUESTION NO. Shall the Home Rule Charter of the City of Englewood be amended by changing the term qualified tax paying elector to qualified elector in Article VIII, Sections 59 and 61?
