SUBJECT: ELECTION MATTERS
Enclosed are several items:
1. Copy of Council Bill No. 37, adopting the Uniform
Election Code of 1992 (Charter provisions to supersede
certain Election Code provisions). The Council Bill
was approved by council on first reading July 6, 1993.
The second and, hopefully, final reading is scheduled
for July 19. Final approval will allow the city to
participate in the County's mail-in ballot election on
November 2, 1993.
2. Copy of Council Bill No. 40 calling for the Election
Commission's recommended Charter amendments to be
included on the November 2 ballot. It is anticipated
this council bill will be considered by Council on
first reading July 19, 1993.
3. City Council minutes of June 21, 1993.
Chris Upton of Arapahoe County has finally confirmed the
County will be able to accommodate our Charter provisions
and include Englewood in its coordinated election. So it
appears things are on a roll.
I understand Bill Belt is resigning as Commissioner of
Career Service Board effective August 31, 1993. Therefore,
we will have to proceed with an employee election to fill
this vacancy. I will send you an election schedule after I
receive his formal resignation.

AN ORDINANCE ADOPTING ELECTION PROCEDURE FOR NOVEMBER 1993
ELECTION WITHIN THE CITY OF ENGLEWOOD.
WHEREAS, the City Charter for the City of Englewood authorizes the Englewood City
Council to adopt by ordinance election procedures in the City of Englewood that are not
inconsistent with the Charter and the State Constitution; and
WHEREAS, the Englewood Election Commission has reviewed in great detail the
Englewood Charter, the election laws of the State of Colorado and Taxpayers Bill of Rights
adopted by the voters of the State of Colorado in November 1992; and
WHEREAS, the Home Rule Charter of the City of Englewood authorizes City Council
to adopt election laws by reference; and
WHEREAS, the City Council, on recommendation of the Englewood Election
Commission , desires to adopt those provisions of the Uniform Election Code of 1992 that are
not inconsistent with the Englewood Home Rule Charter; and
WHEREAS, by ado ption of the Uniform Election Code of 1992, the City will be able to
participate in the coordinated election with Arapahoe County as desired by the voters and set
forth in the Taxpayers Bill of Rights ; and
WHEREAS, that participating in the .coordinated election will result in the use of a mail
ballot and reduce confusion by not having competing polling places.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ENGLEWOOD, COLORADO, AS FOLLOWS:
City Council of the City of Englewood hereby adopts as election procedure, for the 1993
municipal election within the City of Englewood, the provisions of the Uniform Election Code
of 1992, also known as C.R.S . 1-1-101 et seq, as amended, that are not inconsistent with the
Englewood Home Rule Charter.
Introduced, read in full, and passed on first reading on the 6th day of July, 1993.
Published as a Bill for an Ordinance on the 8th day of July, 1993.

The Election Commission seeks Council approval of a bill for an ordinance adopting the
Uniform Election Code of 1992.
PREVIOUS COUNCIL ACTION
City Council met with the Englewood Election Commission on June 14, 1993, and discussed
the recommendation of the Commission to adopt the Uniform Election Code of 1992. The
adoption of this Code would be· needed in order for the City of Englewood to be able to
participate in a coordinated election to be conducted by the Arapahoe County Clerk and
Recorder on November~ 1993.
BACKGROUND
Because of recent State legislation, and as a result of the "TABOR" Amendment approved by
the voters in 1992, coordinated elections are to be conducted throughout the State by
County Clerks. Arapahoe County has advised the City of Englewood it will be utilizing a
Mail-in Ballot for the November~ 1993 election. The County has the capability of
coordinating this election and of including the City of Englewood.
The Election Commission unanimously agrees that it is in the best interest of the electors of
Englewood to conduct future elections joiritly with the other political entities within the
County. In order to participat e in the 1993 coordinated election, it is essential for the City
of Englewood to adopt the provisions of the Uniform Election Code of 1992 that are not e inconsistent with the Englewood Home Rule Charter.

STAFF ANALYSIS
The Election Commission has met with the City Attorney, the Director of Financial Services,
and the City Clerk. Staff concurs with the Commission's recommendation, with the
understanding that the Englewood Home Rule Charter provisions supersede any conflicting
provisions of the Uniform Election Code.
FINANCIAL Il\1P ACT
Financial data will be available at the time an intergovernmental agreement is proposed
between the City and Arapahoe County. The amount budgeted for the 1993 regular
municipal election is $8 ,500; the anticipated costs for the mail-in election are expected to be
at least $16,000.

AN ORDINANCE SUBMITTING TO A VOTE OF THE REGISTERED ELECTORS OF THE
CITY OF ENGLEWOOD AT THE NEXT SCHEDULED REGULAR MUNICIPAL
ELECTION A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF
ENGLEWOOD, COLORADO, BY AMENDING THE PROVISIONS RELATING TO THE
ADOPTION OF ELECTION LAWS TO COMPLY WITH AMENDMENT I, SPECIFICALLY
THE COORDINATED ELECTION MANDATE, SO THAT IT IS LESS COSTLY AND
TECHNICALLY MORE CONVENIENT TO HAVE THE CITYS ELECTIONS IN
CONJUNCTION WITH THE COUNTY'S ELECTION.
WHEREAS, by Amendment I, the people of the State of Colorado and the City of
Englewood adopted election procedures that desire coordinated elections and a minimal
number of elections; and
WHEREAS, the Election Commission of the City of Englewood has reviewed the
Charter and State Laws relating to election and election procedures; and
WHEREAS, the review by the Election Commission resulted in a recommendation to
the City Council of the City of Englewood; and
WHEREAS, the City Council desires to present to the voters of Englewood the
recommendations of the Election Commission;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ENGLEWOOD, COLORADO, AS FOLLOWS:
Section 1. There is hereby submitted to the registered electors of the City of Englewood
at the next scheduled regular municipal election the following proposed amendments to
ARTICLE II -ELECTIONS of the Charter of the City of Englewood:
Section 10 -modify by eliminating "Municipal" to read:
GENERAL
All municipal elections shall be governed by the provisions of the Colorado
Munieipal election laws, and as hereafter amended or modified, except as
otherwise provided in this Charter. The Council may adopt by ordinance such rules
and regulations in respect to elections including by reference any laws of the State
of Colorado not inconsistent with the provisions of this Charter or the State
Constitution, as may be recommended by the Election Commission.

Section 11 -modify by eliminating "Municipal" in second paragraph; eliminate
third paragraph regarding "tie vote" to read:
ELECTION COMMISSION
There is hereby created an Election Commission consisting of the City
Clerk and four qualified electors of the City. Said electors, during their tenure in
office, shall not be City officials or employees or candi dates for elective City office.
Council shall make two additional appointments, one term of appointment to
terminate January 1, 1983 and one term of appointment to terminate January 1,
1985; thereafter appointments shall be for four-year terms. The Commission shall
elect a Chairperson from its membership .
The Election Commission shall establish precincts and appoint the election
judges and clerks for each precinct as provided in ~ Colorado Munieipal election
laws and have charge of all other activities and duties required of it by law or this
Charter.
In ease of a tie vote the Eleetion Commission shall detel'mine by lot the
pel'son Ol' pel'sons ~vho shall be eleeted.
Where municipal election procedure is in doubt, the Election Commission
shall prescribe the procedure to be followed.
Section 13 -eliminate in its entirety
REGISTRATION
Eligibility to • ote and registration shall be as required or preseribed by the
Colorado Munieipal Eleetion Laws. Qualified eleetol's may registel' at the offiee of
the County Clel'k and Reeol'der or at the offiee of the City Clel'k at sueh times and on
sueh dates as may be provided by statute. The l'€gistl'ation books Ol' lists of the
County Glel'k and Reeol'del' shall be the l'€gistl'ation books Ol' lists of the City.
Qualified eleetors, Ytho al'€ unable to l'egister as provided above, may l'egistel' as
provided by statute fur absentee registration if eligible to do so.
Section 15 -modify second paragraph to read:
NOMINATIONS FOR ELECTIVE MUNICIPAL OFFICE
Each candidate for an elective municipal office shall be nominated by
petition signed by at least fifty registered electors residing within the municipality,
or the district, from which the officer is to be elected.

Section 17 -eliminate in its entirety
ABSENTEE VOTING
In aeeerdanee with Colorado Munieipal Eleeti en Laws, an absent veter
must file w·ith the City Clerk an applieatien whieh may be in the furm of a Jetter fur
an absent veter's ballet net earlier than ninety days before and net later than the
elese of business en Friday immediately preeeding any mun i eipal election. The
manner of easting sueh absentee ballet shall be in aeeerdanee with Co l orado
Munieipal E1eetien Laws . Sueh ballet must be in the hands of the City Clerk net
later than five P.M. en the day of the e1eetien.
Section 18 -el iminate in its entirety

polling p]aee on election day.
Sect ion 2. The voting machines and paper ballots for said election shall carry the
following designation which shall be the submission clause :

Shall the Charter of the City of Englewood, Article II, Section 10, be amended to allow
the City Council to adopt by reference Colorado Election Laws relating to registration
of voters, listing of candidates, and absentee voting requirements when necessary to
more fully implement Amendment 1 provisions?
Section 3, If Question No. __ is approved by the registered electors, upon
certification thereof to the office of the Secretary of State of the State of Colorado, pursuant to
Section 9, Article XX, of the Colorado Constitution and Section 31-2-210 Colorado Revised
Statutes, Article II, Sect ion 10 et seq. of the Home Rule Charter of the City of Englewood.
The foregoing Amendment shall become part of the Home Rule Charter of the City of
Engl ewood.
