HomeMy WebLinkAbout1993-11-09 EC MEMOMEMORANDUM TO: Election Commission FROM: Pat crow, City Clerk DATE: November 9, 1993 SUBJECT: NOVEMBER 2,1993 COORDINATED ELECTION AND CAREER SERVICE BOARD ELECTION Enclosed is a copy of the election results for Englewood's portion of the 1993 Coordinated Election. I personally feel this was a very successful election and that Arapahoe County did an tremendous job in our behalf. I served as a member of the Canvass Board along with Jack Ballard of Littleton School District, and both of us were impressed with the process. As I told most of you over the telephone, Mr. Farris has been elected to the Career Service Board. However, recall petitions have since been received and the petitions were signed by a sufficient number of full- time, permanent, classified employees. Notice to Mr. Farris is attached for your review. Mr. Farris has the option of resigning or standing for election along with any other nominated candidates. This process is covered in Title 3, Chapter 2 of the Englewood Municipal Code, a copy of which you received when you became a member of the Commission. December 10th has been set as a tentative date for the recall election. Other items enclosed for your review are: 1. Summary of Decisions -October 20, 1993 2. Question No. 4 on Englewood's portion of the ballot concerned various amendments to Englewood's Home Rule Charter. These amendments were approved by the electorate by a vote of 5,219 to 1,125. Amendments to ARTICLE II -ELECTIONS are as follow s : Section 10 -modify by eliminating "Municipal" to read: GENERAL All municipal elections shall be governed by the provisions of the Colorado Municipal election laws, and as hereafter amended or modified, except as otherwise provided in this Charter. The Council may adopt by ordinance such rules and regulations in respect to elections including by reference any laws of the State of Colorado not inconsistent with the provisions of this Charter or the State Constitution, as may be recommended by the Election Commission. Council shall make two additional appointments, one term of appointment to terminate January 1, 1983 and one term of appointment to terminate January 1, 1985; thereafter appointments shall be f o r four-year terms. The Commission shall elect a Chairperson from its membership. The Election Commission shall estab .ish precincts and appoint the election judges and clerks fo r each precinct as provided in {:he Colorado Municipal election laws and have charge of all other activities and duties required of it by law or this Charter. In ease of a tie vote the Election Commission shall determine by lot the person or persons who shall be elected. Qualified electors may register at t h e office of the County Clerk and Recorder or at the off ice of the City Clerk at such times and on such dates as may be provided by statute. The registration books or lists of the County Clerk and Recorder shall be the registration books or lists of the City. Qualified electors, who are unable to register as provided above, may register as provided by statute for absentee registration if eligible to do so. Section 15 -modify second paragraph to read: NOMINATIONS FOR ELECTIVE MUNICIPAL OFFICE Each candidate for an elective municipal office shall be nominated by petition signed by at least fifty registered electors residing within the municipality, or the district, from which the officer is to be elected. Petition forms supplied by the City Clerk may be circulated and signed not more than fifty days prior to the day of the election and shall be filed with t he City Clerk not less than thirty days prior thereto. Petitions. Petitions shall be circulated and filed in accordance with Colorado Municipal election laws. Section 16 -eliminate in its entirety VOTING 2 The method of voting on all proposals and election of candidates shall be as the Election Commission directs. The names of the candidates nominated for pub l ic office shall be set up without party or other designation and shall be arranged under the designation of the office according to surname alphabetically from a to z and in reverse from z to a in alternate precincts. Section 17 -eliminate in its entirety l'1BSENTEE VOTING In accordance with Colorado Municipal Election Laws, an absent voter must file with the City Clerk an application which may be in the form of a letter for an absent voter's ballot not earlier than ninety days before and not later than the close of business on Friday immediately preceding any municipal election. The manner of casting such absentee ballot shall be in accordance with Colorado Municipal Election Laws. Such ballot must be in the hands of the City Clerk not later than five P.M. on the day of the election. Section 18 -eliminate in its entirety ELECTIONEERING NEAR POLLS No person shall do any electioneering within one hundred feet of any polling place on election day. The election was conducted by the Office of the City Clerk during the period October 22 -November 4, 1993, and was certified today, November 5, 1993. It is my responsibility as a member of the Englewood Election Commission to advise you that petitions for your recall have been filed with the Election Commission today . By Code, the Englewood Election Commission is charged with conducting a recall election within 3 5 days of receipt of the recall petitions . Therefore, please be advised that an election will be conducted on D ecember 10, 1993, to determine if you shall be retained as a member of the Career Service Board . I am enclosing a copy of Title 3, Chapter 2 which addresses this process . You will notice that you have the option of resigning or being listed on the ballot for retention along with any other candidates who may be nominated . Please notify me in writing by November 12, 1993, as to your wishes in this regard . These are the basic provisions dealing with this subject.
