FISCHBACK did not receive copy of :iotes. The minutes were approved. OLD BUSINESS ... At the January 21 st meeting , a picture of the residence located at 3398 South Logan was viewed by the committee. The com1nittee wants to know what can be done to resolve this "pathetic" residence. PARSONS said the address was posted and it will be determined if the residence is owner occupied , which is the County Clerk Tax Assessor 's role . Code Enforcement/Meeting Minutes February 18, 1998 Page Two SWEARING IN OF NEW MEMBERS ... KA THERINE FISCHBACK & TIM TUCKER were sworn in. ROSTER UPDATES AND CORRECTIONS ... The roster was circulated for any updates. TODD ALLEN would like the Districts of each member included on the roster. MELANIE CRAWFORD might not be at meetings for three months due to an illness. TODD ALLEN would like all members to participate in the agenda for the next meeting, prior to the end of meeting. NUISANCE ORDINANCE GUEST PRESENTATION -DUGAN COMER ... DUGAN introduced himself with a brief summation that he has been the Assistant City Attorney for the City of Englewood for 4 ~years. DUGAN COMER ... • • is familiar with some of the abatement issues in Englewood • • was asked by DAN BROTZMAN to draft the Nuisance Abatement Ordinance • went through the current Municipal Code and removed all sections that deal with the abatement issues (Building Safety area, Fire Code area, Housing Regulations, Public Utilities and the current Nuisance Ordinance, Health Sanitation Environmental Protection). Other abatement ordinances used by other cities have been used as 'v\'ell as the Colorado Revised Statute. A copy of the ordinance was given to all present. DUGAN COMER ... • explained this copy is a working document; e is working on the second draft. • hopes to put current sections into one section and the procedures needed to abate. • • • • Code Enforcement/Meeting Minutes February 18, 1998 Page Three DUGAN stated ... • there are abatement procedures on the books currently • this is to bring everything into one place and eliminate confusion • is also trying to expand Municipal Court's power to abate • the whole point is try to have a tight narrow focus Procedures are Administrative and Court Abatements. (Court Abatements are people who do not comply with abatement notices and could be summoned to court.) There are legal issues to abating nuisances with private property rights and constitutional issues which would be addressed further in the second draft. The whole point of the rough draft was to have something for the committee to review and get to a starting point; he will have a second draft done by the middle to end of March. ST ANKORB asked how long it would be before it could be presented to Council , and DUGAN replied he had no idea; it would have to be reviewed with the City Attorney's office as well as the Code Enforcement Committee. NABHOLZ asked if the draft could be completed by the next meeting (March 18th) and DUGAN agreed it would be. MOORE suggested a gathering place be established for input (draft re v isions ) once the deadline approaches . Concerns should be given to MOORE at least two weeks prior (March 4th) so DUGAN may review them . Code Enforcement/Meeting Minutes February 18, 1998 Page Four ALLEN asked what constitutes a "Nuisance?" DUGAN stated they are generally a Public Nuisance. Things that would impact an entire neighborhood or several homes. A building would be solely the responsibility of the Building Department or a Fire Nuisance would be abated by the Fire Department or Fire Marshall. Policy issues are to be addressed in an ordinance. All departments should use the same procedures. An individual who is convicted of violating a code can be fined up to $500 or receive 180 days injail or both. The initial thrust is hopefully they will do it on their own. In the case of rental property, both could be fined (owner and renter). ALLEN brought up the man power staffing issue. DUGAN stated he could not answer that topic. It is up to the individual departments. MOORE stated it would help simplify matters. Where the City :Nfanager is now held responsible, it would remove the burden from him and place it in the court where it belongs. DUGAN stated we can utilize State actions; an action could be filed in State court if necessary. DUGAN is reviewing Denver, Fort Collins and Aurora ordinances. ALLEN asked about seizing a house. COLLINS stated a seizure takes months and would be a police action, reviewed and handled in District Court. Both owners must be aware of illeg al actions. MOORE instructed how committee should make changes in the draft and present them to him. DUGAN stated the second draft is on the computer and does not see a problem getting it to everyone by the 18th of March. !\t100RE g_skcd that suggestions be noted and the rationale incorporated. GROUP ESTABLISHMENT OF MISSION, GOALS AND OBJECTIVES ... JERRY STANK.ORB provided members with a mission statement he wrote. The committee members brainstormed the statement and approved the revised statement. A copy was given to all committee members present. ALLEN asked if the roster could include phone contacts for CHRIS OLSON, BOB MOORE, JOHN COLLINS and ROSEMARY BUCKLEY. MOORE said that is not a problem. PRESENT AND DISCUSS DRAFT OF BYLAWS ... Will be discussed March 18th meeting . DISCUSS BUDGET ... Will be discussed March 18th meeting. (Budget is $2,000) NEW BUSINESS ... Agenda will include by-laws , 2nd draft of ordinance.
