APPROVAL OF MINUTES ...
The minutes were approved.
OLD BUSINESS •..
Todd Allen attended a Neighborhood Watch meeting and presented what the Code
Enforcement Advisory Committee is about and their efforts. An invitation was extended
to those at the watch to attend one of CEAC's meetings. Todd would like other
committee members to attend Neighborhood Watch meetings, making the Committee

more visible. Don Roth recapped what happened on mandatory trash and fielded
questions.
Study sessions are every Monday night, only about one hour long when Council has their
meeting. Public can attend but must be invited to speak. Olson stated there are many
issues to be discussed at the study session and would not recommend attending on a
regular basis unless there is a specific issue. If there is a major issue the committee
wants to discuss, the City Manager's office should be contacted and a time will be
arranged.
NUISANCE ABATEMENT ORDIANCE DRAFT UPDATE -DUGAN COMER ...
Todd Allen introduced Dugan Comer who presented the Ordinance (Draft Two).

. Received some comments on Draft One but all were not included as of yet •
. Was given several interesting comments by Roth regarding the trash portion of
Ordinance. The trash ordinance was amended by Council Bill 99, which dealt with the
pick up of trash. The old code section was left in the draft to address trash issues.
. Stated there were questions regarding hobby and derelict vehicles with respects to
permits, which was not addressed. It was left as is and should be discussed by the
group to determine if a permitting system is in place. There is a permit system in place
at this time but does not know if it is used .
. Stated that car alarm systems should be addressed under the noise portion of the
Nuisance Abatement Ordinance .
. Advised that Todd had a few concerns with the definition section which can be
expanded, especially with garbage i.e. the definition of garbage.
Dugan explained that Draft Number One was very rough. Draft Number Two is "a little
tighter." Draft Number Three will focus on the Judicial Abatement procedures. Dugan
is trying to get a copy of Judicial Abatement procedures from the City of Westminster.
The group should discuss how the abatement procedure works and who will be
responsible for the enforcement? Will it be one entity of the city, Code Enforcement;
Code Enforcement for majority of the enforcement; some police; some building and fire
division? Dugan feels the committee should discuss the issue.
Dugan stated that Sergeant Sam Watson had comments on "First and Second Drafts."
The Second Draft seemingly answered his comments.
Dugan stated he is going to focus his attention on "Judicial Abatement and Civil
Abatement." Westminster is the only city that has an active judicial abatement
ordinance; Dugan wants to look at it to determine if it is applicable for Englewood.

Olson asked Dugan if that would be a separate ordinance or included and Dugan said it
would be included. Anybody could refer to the Nuisance section and have an answer,
eliminating many sections of Englewood's code.
Parsons asked Dugan if a hearing officer would be used to which Dugan said it is still up
in the air; will be addressed in a "Third Draft." A neutral party would be considered the
fairest.
Questions to Dugan ...
Stankorp asked why the new trash ordinance is not incorporated.
Dugan answered the new trash ordinance dealt with the requirement of citizens of
Englewood having a trash pick-up (contracted). When Council changed that
ordinance, they used the existingTrash, Junk and Salvage ordinance . Dugan
placed the unchanged ordinance in the Nuisance Abatement Ordinance .
Todd Allen asked about derelict vehicles ... can boats , canoes etc. be included?
Dugan thinks some of that is addressed in the parking permits and is already in
our code. Dugan will look at it.
Dugan reiterated the whole point of "Draft #2" was to promote discussion amongst the
grpup; however, it is not close to being an ordinance. Dugan will continue to work on
the Judicial Abatement procedures, as well as tightening up the Civil Abatement
procedures.
Dugan wants to focus on not changing the body of the ordinance, at this point, the rest of
the group can focus on the rest of the ordinance, verbiage and anything else they would
like to see changed, amended, added or taken out.
Moore suggests that each individual, in the next week or so , mark their individual copy,
tag it. At the next meeting , allow an hour for individuals to provide what input they
need. Prior to the meeting, determine how many issues each individual has .
Olson would like the ordinance to be in place the beginning of the summer (June l51).

Todd Allen asked the committee if they would mail the pages that have comments in lieu
of calling or faxing~ The deadline for comments to Todd is two weeks (April 8, 1998).
DISCUSSION OF BYLAWS AND BUDGET ...
Todd Allen if there were a lot of comments ...
Todd asked Jerry Stankorb to incorporate the comments on his copy.
Section Three should read "City Manager."
Olson stated schedules of all meetings are posted in the Englewood Citizen and the
Herald.
Stankorb read "Any commissioned member missing more than two consecutive
meetings, without prior notice or a total of three meetings in a calendar year, should be
replaced on the committee. Should replacement be by majority vote?
Stankorb stated reference other committees, if people are not interested enough to attend
most of the meetings, we need to get somebody that is really interested.
Article Two, Section One on structure ... per Olson has to be set up per ordinance what
the actual structure is going to be, thirteen members.
Article Two, Section Two, Officers, the Executive Coordinator was explained would be
the highest-ranking ex-officio member (Bob Moore or Joyce Parsons).
Article Three, Section Two, the Chair and committee will call Special Meetings. Special
Meetings must have three days notice given to each committee member.
Article Four, Section Two, spelling error.
Section One, Three year terms? Should be two year term.
A question about the quorum ... if there is eleven on the committee, a quorum should be
SIX.
Chairperson is an on-going member. .. do we need six other than the chair for a quorum?
Moore stated a quorum gives you the opportunity to vote. You still have to have the
majority of the eleven. So if only six people are there, six people would have to vote in
the affirmative. (This was later corrected)

Parsons read that by-laws might be attended by a two-thirds vote of the committee
members, present at any regular meeting.
Todd Allen asked if the committee should make a motion if we have six people
attending, we have a quorum (four people). If there is a vote in favor of it, it could pass?
Stankorp does not feel the numbers should be made large .. .if somebody resigns, it takes
Council a couple of months to replace them, the committee should not be tied into that.
Article four; Section Five under Duties, Item five ...
Todd Allen would like to vote next week, if everyone present has a copy of the by-laws.
BUDGET ...
Moore passed out a summary "Expenditure Report." It shows no expenditures at this
time. Expenditures will come through Chris Olson or Moore for payment or be paid in
advance by going through the normal purchasing channels.
Todd Allen asked who would be responsible for decisions about expenditures. and Moore
stated it would be Todd Allen.
The budget amount can also be amended if necessary.
Stankorp would like more information about Code Enforcement's operations before they
make decisions.
Joyce pointed out that Code Enforcement has a digital camera and pictures on file of
homes in Englewood.
Stankorp would like more feedback from City Council. They passed on an ordinance
with some "real bad stuff." Stankorp hears that City Council gets a lot of complaints
which the Code Enforcement Committee, as well as Code Enforcement Division is not
aware of.
Members of City Council that are a part of the Code Committee should inform the
committee of complaints .
