The regular meeting of the Englewood Code Enforcement Advisory Committee was called to order at 6:34 p.m. by Chair Stankorb in the Community Room. Roll Call Present: Ex-Officio: Fischbach, Hansen, Stankorb, Roth, and McCahill Flaherty, Lynn, Yurchick, Wicks Absent: Hambleton Approval of Minutes. Member McCahill moved and member Roth seconded that the minutes of the April 19, 2000, Code Enforcement Advisory Committee be approved . Ayes: Nays: Absent: Fischbach, Hansen, Stankorb, Roth, and Mccahill None Hambleton The motion carried. 3. Public open forum. Waived. 4. Old business. a. Nomination of Vice-Chair. Member Stankorb opened the floor for nominations to fill the position of Vice-Chair. Member Hansen nominated Don Roth and member Fischbach seconded the motion. All were in favor and voted member Roth as Vice-Chair. b. Leash Law. Member Stankorb opened the floor for further discussion of the leash law. Member Hansen advised the group that both cities on either side of Englewood have a leash law, and asked why Englewood doesn't have a leash law. Member Stankorb stated that the discussions have all been made regarding the need for a leash law, and now is the PAGE 1 • 5 . • • time to either make or fail to make a motion to recommend to the City Attorney's Office to address the issue. Member McCahill inquired of Lynn what the committee's recommendations should address. Lynn replied their recommendation can address anything they wished, and the City Attorney wquld draft the change based on the committee's desires. Member Roth stated that some penalties in place at the present time are standardized by the municipal court, and some allow a judge to decide. He also stated that the committee could make recommendations to the City Attorney on what the CEAC committee would like to see put in place. Lynn explained that the Englewood code presently states that any dog not under reasonable control of its owner and off his property is in violation. He also stated any dog off a leash in a park constitutes a violation. ~urchick asked Lynn how many calls are received for dogs at large and dogs without leashes. Lynn replied the number of calls received for "dog at large" is larger than the calls for "dogs off leash". Dogs off leash continues to be a problem at Belleview Park, and there is a need for two (2) leash signs to be installed. Member McCahill made a motion for the Englewood City Attorney to draw up a leash law. Member Fischbach seconded the motion. The motion carried. New Business. a. Discussion of RV parking i n driveways. Member Roth indicated he had met with Lynn and had also done some research on the issue of parking of trailers, RV's and derelict cars in front driveways. After significant discussion, it was decided not to pursue any change to the Englewood Municipal Code at this time. b. Discussion of bonafide driveways. Member Roth indicated the main issue was defining what constituted an acceptable front driveway in Englewood. Lynn replied that the code specifies front driveways be concrete, asphalt, pavers or gravel. There is no design criteria for gravel, and as a result, rarely used gravel driveways sometimes don't appear to be legitimate. Lynn also mentioned a design criteria implemented in the City of Aurora in 1 993 which specified gravel depth, bordering and "grandfathering" was unsuccessful. He went on to state his staff has been dealing aggressively with cars parking on front lawns and the deterioration that naturally occurs with gravel driveways, and felt that action at this time by the committee might be premature. Committee agreed and decided against any changes to the Englewood Municipal Code at this time. c. Member Hanson requested information on how to get items dumped in alleys by unknown persons removed. Lynn replied items within the 16' alley right-of-way can be removed by calling the Public Works Streets PAGE 2 • • • 6. Division. Items outside the ROW on private property are the responsibility of the private property owner, who can either call his or her trash company for a special item pick-up, or can haul the item to the landfill. d. April Code Enforcement Monthly Report. Lynn presented the statistics from the April monthly report. Hansen asked if there were any suggestions to reduce the number of repeat parking violations. Lynn responded that his staff was researching an option to tow and impound any vehicle with three unpaid parking tickets. The Committee liked this proposal, and a motion was made by Fischbach and seconded by Hansen to support the subject of towing all vehicles with three or more unpaid, outstanding parking tickets. The motion carried. Lynn cautioned the committee that this matter may require some expense because it would need to interface with the court's system of tracking tickets. e. Code Enforcement Advisory Committee meetings. Flaherty mentioned the June meeting would be held in the new Civic Center at 1 000 Englewood Parkway. He also mentioned that all committee members would be receiving invitations for an open house on June 1 2th, 2000 at 4:00 p.m . Topics for June meeting. a. DMG Maximus report. b. Christina Estes-Faraci report on graffiti. c. Rewriting bylaws d. May Code Enforcement Statistics. 7. Adjournment. Member Hansen moved, and member Roth seconded, to adjourn the meeting.
