The regular meeting of the Englewood Code Enforcement Advisory Committee was called to order at 6:37 p .m. by member Roth in the City Council Conference Room. Roll Call. Present: Ex-Officio: Absent: Roth , McCahill , Hansen, Blair, DesMarteau, Olsen Lynn, Moore , Flaherty , Yurchick Roberts , Nabholz 2. Approval of Minutes. Member McCahill moved and member Olsen seconded that the minutes of the August 15 , 2001 Code Enforcement Advisory Committee meeting be approved. Ayes:· Nays: The motion carried . 3. Public Open forum. Roth , McCahill , Hansen, Blair, DesMarteau, Olsen None There were twelve guests in attendance at the meeting, some to discuss their concerns of RV parking, and some to discuss animal issues and general code violations. Those in attendance were: John and Linda Barton, Henry Williams, Donna Tuttle, Patricia K. and Robert E. Kavan, Mary Hoeft, Walter E. Perry , Pat Bailey, Christy L. Haling , Ruth and Ned Steel. The majority of the residents who attended the meeting were RV owners and were inquiring what the current code reads pertaining to RV storage. It was explained that the current discussion of RV's was the result of a city council request to the Code Enforcement Advisory Committee . In response to questions on expeditious enforcement of code violations , Lynn discussed a proposal by the Code Enforcement Advisory Committee (dated September 7 , 2001) to decriminalize violations. Lynn stated that an article will be coming out next week in the Englewood Herald newspaper on Code Enforcement follow up procedures. Chief Moore explained the complexity and the history of Code Enforcement and how it is enforced. 4. Old business. a. City Council Study Session. Roth explained there will be another City Council Study Session on the gth of October discussing the animal issues . Ruth Steel had questions regarding the procedure taken at the City Council Study Sessions. Lynn explained that Council Bill #36 (animal licensing) and Council Bill #37 (the number of animals) will PAGE 1 • • • be topics of discussion at the next City Council Study session. Roth compared the statistics of dog bite attacks in Englewood verses Denver , and the number of dogs at large. McCahill asked what issues would be discussed at the City Council Study Session, and discussion followed on what should be presented. Council also made a request of the CEAC to look at the leash law to possibly allow trained dogs be off leash. Roth stated that the committee has made their recommendations regarding the leash law, and doesn't foresee them changing anything at the present time. Roth stated he would reiterate their position at the study session. Flaherty gave an interpretation of the Parks and Recreation Director's stand on allowing a dog park ordinance for the city . He is not in favorable opinion, due to the lack of available park space in Englewood. b. Animal Licensing. Due to the lack of time remaining, a motion was made by member McCahill and seconded by member Blair to table the licensing discussion until next month. All were in favor. c. Extension of meeting. Roth proposed to continue the meeting, as the two-hour time limit had expired. All were in favor. 5. New business. a. August 200t' Code Enforcement Monthly Activity Report. Due to limited time, Roth proposed that the August 2001 Code Enforcement Monthly Activity Report be discussed in detail at the next meeting. All were in favor. b. RV's in front yards. Roth presented the Code Enforcement's survey on "Storage Regulations on placement and storage of RV's in residential zones. Lynn added that the storage of RV's in driveways is perceived by some to be a safety hazard. Lynn read the current Englewood Municipal code on RV storage. Additional discussion included types of surfaces allowed for RV's and clearance from intersections. When asked, Lynn said he wasn't aware of any pedestrian accidents resulting from the front driveway placement ofRV's. Member Olsen asked Lynn how many violations for RV placement are issued in Englewood. Lynn replied he had no idea, as some of these violations would come from police officers. As far as code enforcement was concerned, Lynn thought the number would be small. Member Olsen implied that the RV's seem to be a visual situation verses a safety issue. Member DesMarteau made a motion to not act on the issue at this time, as this is an aesthetic issue and not a safety issue. The motion was seconded by member Blair. All were in favor. 6. Topics for October 17, 2001 meeting. a. Animal Licenses b. September Code Enforcement Monthly Activity Reports c. Discussion of the October 8111 City Council Study Session And October 15th City Council meeting PAGE2 • • • 7. Adjournment . Member McCahill moved and member Olsen seconded to adjourn the meeting.
