The regular meeting of the Englewood Code Enforcement Advisory Committee was called to order at 6:33 p.m . by Chairperson DesMarteau in the City Council Conference Room. Roll Call. Present: Ex-Officio: Absent: A quorum was present . Also Present: 2. Approval of Minutes . Blair, McCahill , Crowell, DesMarteau, Belt Lynn, Yurchick Olsen , Grazulis , Flaherty, Moore City Attorney Brotzman Intern Brett Davies Guest Don Roth Guest Jim Goodrich Member McCahill mo ved , and Member Blair seconded the motion to approve the minutes of the regular meetings of July 17, 2002 , and August 21 , 2002. All were in favor. The motion carried. 3. Public Open Forum. Guest Jim Goodrich attended the meeting to oppose the hobby vehicle. He stated that it is wrong and he feels betrayed by what the ~ommittee was mandated to do by City Council at the August meeting in eliminating hobby cars. Goodrich feels that Council has overstepped its boundaries when they placed the committee as their scapegoats in enacting an ordinance. He strongly recommended to the committee that they look at it fully , and understand what is written in the ordinance as it stands at the present time . Goodrich inquired of City Attorne y Brotzman on procedures when a quorum is not present, in particular questioning the legality of the August meeting . Brotzman replied that the meeting was proper and proper! y conducted . P AGE 1 • • • 4. Old Business. a. Review CEAC By-Laws. Member McCahill passed out copies of the revisions made to the By-Laws. He posed a question concerning when the terms of the Chairperson and Vice-Chairperson should start. City Attorney Brotzman explained to the members that terms expire at different times, and vacancies are filled from each term. Additional discussion followed. Member McCahill made a motion and Member Belt seconded the motion making changes on the By-Laws to be approved at next month 's meeting. All were in favor. The motion carried . 5. New business. a. City Attorney Dan Brotzman: Discussion of the Decriminalization initiative, inoperable vehicles, and outdoor storage. Chairperson DesMarteau commented on prior discussions on hobby vehicles , that it was decided by members to leave the ordinance as is, deleting the $100 permit fee. Brotzman welcomed any new changes from the committee on changing the ordinance from abandoned vehicles and derelict vehicles to inoperable vehicles. McCahill inquired of Brotzman how the definition of motorcycles would fall under the ordinance . This led into discussion of derelict vehicles in front and side yard setbacks , and requirements to be screened. McCahill also inquired of Brotzman if travel trailers fall under the same vehicle ordinance. Brotzman explained that City Council is looking at separating out recreational vehicles entirely from the hobby/derelict/inoperable vehicle ordinance . He went on to say that there would be a separate proposed ordinance on Recreational Vehicles. He added that he is also trying to clarify the "hard surface" definition. Car cover requirements for rear and side yards were also discussed. Brotzman stated that the purpose of the code was to make a specific distinction between car covers as being acceptable, verses the fitted tarps. Councilman Y urchick asked for a clarification on the definition of "screened from view" in storing vehicles. Brotzman interpreted council's stand on the issue as wanting to require a solid fence , and recommends that the committee look at it. Chairperson DesMarteau disclosed his concerns with City Council in asking the committee to look at the hobby vehicle ordinance , since the committee had already decided months ago not to pursue it. Attorney Brotzman reassured the committee that if their decision is to not pursue it , they can follow up with their reasoning to council why it's not important for them to continue with it. Lynn added his thoughts on other possible changes to include: inoperable/uninsured vehicles , adding a clear definition of gravel type , more definitions of recreational vehicles, inoperable RV's stored in carports , and to define hobby/derelict vehicles more clearly. City Attorney Brotzman will review these changes and will present another ordinance with inoperable vehicles split out from RV 's and RV "toys "at the next meeting. PAGE2 • • • City Attorney Brotzman then addressed the Decriminalization initiative. He said, in looking at issues to decriminalize , there would be some enforcement problems involved, i.e., Code Enforcement issuing a ticket, following nuisance procedures, with civil penalties to follow. Member McCahill commented, for example, with the long process involved with weed and snow issues, that the committee was interested in decriminalization to help streamline the process, thus eliminating the hearing and duplicating paperwork. After much discussion, Brotzman agreed to draft changes to the Englewood Municipal Code to enable the committee's wishes. Brotzman then discussed the council's desires concerning outdoor storage. After much discussion, it was concluded the changes he proposed made outdoor storage acceptable in many locations where it was currently prohibited , such as in side and rear ya rds . The committee disagreed with these proposals, and Brotzman agreed to redraft his proposal to reflect the committee 's desires. c. Yo uth involvement on Englewood's Boards and Commissions. Chairperson DesMarteau received a suggestion from Council Member Julie Grazulis asking CEAC Members to consider adding a school age person to sit on the committee. After lengthy discussion, Member McCahill made a motion and Member Belt seconded the motion and recommendation to City Council that the members decided it would not be beneficial to add a youth on the board. All were in favor. The motion carried. At 8:29 p.m. Chairperson DesMarteau suggested extending the meeting 10 minutes. Member McCahill made a motion and Member Belt seconded the motion that the meeting be extended for 15 minutes to hear Lynn's Monthly Activity Report. All were in favor. The motion carried. b. August 2002 Code Enforcement Monthly Activity Report. Lynn started discussion of the monthly report; stating most of the numbers were up appreciably, with 368 positive public relations contacts. Barking dog complaints increased by seventy five percent since the previous month . The number of animals at large increased from 72 in July to 119 in August. Lynn advised that the leash law violations were fairly constant, dropping from 23 the previous month to 18 this month. Discussion of the leash law pilot program followed, Lynn adding that some residents have complained over which of the parks were chosen. The number of summons at municipal court rose to 40, directly related to the number of animals being picked up. Parking citations rose to 841, weed notices went up, and Code Officers have been picking up dead birds for West Nile Virus screening . Lynn also mentioned the six animal assists to other jurisdictions . PAGE3 • • • 6. Topics for October 16, 2002 meeting. a. Revisit Re-draft of the inoperable vehicle ordinance b. September 2002 Monthly Activity Report 7. Adjournment. Member Belt made a motion to adjourn and Member Blair seconded the motion. The meeting was adjourned at 8:45 p .m. All were in favor. The regular meeting of the Englewood Code Enforcement Advisory Committee was called to order by Vice-Chairperson Blair in the City Council Conference Room . The official start time of the meeting was not recorded, as this meeting was short one member preventing a quorum. Roll Call. Present: Ex-Officio: Absent: 2. Approval of Minutes . Blair, McCahill, Crowell Lynn, Moore, Grazulis Olsen, Belt, DesMarteau, Flaherty, Yurchick The Minutes of the July 17, 2002 meeting were not voted and approved , due to lack of members present to create a quorum. 3. Public Open forum. Former Code Enforcement Advisory Committee Chairperson Don Roth, and Jim Goodrich were present. Mr. Goodrich mentioned attending a council meeting Monday evening, with discussion over the Uniform Building Code. Mr. Roth expressed his concerns over the recent proposal in the Englewood Herald regarding eliminating derelict vehicles. He was concerned that Council would address this issue while failing to adopt an animal licensing program. It was mentioned that the committee had mixed feelings on the animal licensing proposal. 4. Old Business. a. Review CEAC By-Laws. Member McCahill looked at the changes Lynn made to the By-Laws and gave his o.k . He added that to amend the By-Laws, it would have to be amended at two thirds of a vote of the members present. He suggested waiting until next meeting when there would be a quorum to vote . b. Penalty enforcement on Rabies Vaccinations. Lynn summarized the memorandum he sent to committee members regarding retrieval of rabies PAGE 1
