The regular meeting of the Englewood Code Enforcement Advisory Committee was called to order at 6:37 p.m. by Chairperson DesMarteau in the City Council Conference Room. Roll Call. Present: Ex-Officio: Absent: 2. Approval of Minutes. DesMarteau, Blair, McCahill, Belt, Olsen Lynn, Moore, Flaherty, Yurchick, Grazulis Roberts, Crowell Member Blair moved and member Belt seconded that the minutes of the February 20, 2002 Code Enforcement Advisory Committee meeting be approved. Ayes: Nays: The motion carried. 3. Public Open forum. DesMarteau, Blair, McCahill, Belt, Olsen None Guest Jim Goodrich, who resides at 2890 South Logan, and has a business at 2990 Yi South Galapago, Englewood came to voice his interest in the workings of the Code Enforcement Advisory Committee. 4. New business. a. Role of Staff with Advisory Committee. Dan Brotzman, City Attorney for Englewood discussed the four primary functions of the Code Enforcement Advisory Committee. They include: (1) reviewing the code (i.e. Title 15) and making recommendations to city council , (2) reviewing what staff does and how the administration works, (3) prioritizing what Code Enforcement writes, (4) interacting with the citizens and looking at complaints . Brotzman stated this committee was formed by council as a policy committee to have citizen input on Code Enforcement issues. He added that the staff role on the legal side and City Manager's side is to help the committee. Brotzman went on to say that CEAC 's policy recommendations PAGE 1 • • • go directly to council, pointing out that there are no changes made by his office, only recommendations given on how to present an ordinance. Brotzman elaborated to the committee how important it is when the committee recommends new policies to council that they remember to include the "why's" (reasons for changes to the ordinance). Gary Sears, City Manager of Englewood announced that he was asked by Council Member Yurchick to attend the CEAC meeting with Attorney Brotzman to answer questions of what the staff role is in making committee recommendations. Sears explained that council looks at making sure there's firm direction coming from the CEAC and how to interface with council. Blair asked what the role of council members is on the committee. Sears replied that council is the final decision maker, with Brotzman adding that council members on the Code Enforcement Advisory Committee act as liaisons between CEAC members and council. Member Belt responded, referencing the last study session, in which a 28-page presentation was to have been presented by Lynn, ultimately at the last minute, a four page document was presented by Member DesMarteau. Member Belt, in seeking clairification of issues going to council, asked why the presentation was changed from 28 pages to four pages. He expressed his concerns of unfairness. Additional discussion followed by City Manager Sears regarding procedures how a city council presentation should be presented. Chairperson DesMarteau was commended by committee members on the excellent presentation he gave. Member DesMarteau conveyed the importance of staff, council and committee members in working together. City Manager Sears commended the staff and committee members for all of their hard work. 5. Old Business. a. Animal registration presentation. Chairperson DesMarteau stated the committee presented the animal registration proposal at the City Council Study Session on Monday , March 4, 2002. DesMarteau explained there was good feedback from the presentation, with questions arising as a result of it. DesMarteau thanked members who were in attendance at the last presentation who supported the animal licensing. Code Enforcement Supervisor Lynn explained that some items came up at the regular council meeting after Study Session. He stated questions were raised, and it was asked of the committee to do additional work on the presentation, to include re-doing the costs of registration. Lynn read the list of costs he calculated for the four options . Member DesMarteau made a motion to recommend to city council that there be a general licensing registration. Member Belt made a first motion and member Blair seconded it. The motion carried. Member Des Marteau made a motion on animal licensing to be an annual fee. Member McCahill made a first motion and member Belt seconded it. The motion carried. Much discussion followed, examining various options for animal licensing resulting in Member McCahill making a motion and member Belt seconding it to recommend to council a differential fee structure . There was a split tie vote , with Chairperson DesMarteau breaking the tie and voting for a flat fee structure. The committee will be recommending a flat fee licensing structure administered by PetData to council. Member McCahill asked for clarification on whether to include both dog and cat licensing . DesMarteau presented a motion for PAGE2 • recommendation to include both dogs and cats in the licensing process, and Member Olsen seconded it. The motion carried. b. February 2002 Code Enforcement Monthly Activity Report. Lynn presented the February Monthly Activity Report. He discussed the leash law ordinance now in effect is keeping his officers busy at the parks. Lynn went on to say his officers have also been busy doing educational PR work on the leash law. c. Review of CEAC By-Laws. There was discussion over the Sunshine Law in the CEAC By-Laws. Member DesMarteau suggested it would be valuable for the committee to meet together every 6-8 months without staff and council members present to discuss issues at hand. DesMarteau stated he will give Dan Brotzman, City Attorney a call to confirm the legality of this . d. Review of Englewood's snow shoveling ordinance. Due to lack of time available , Chair DesMarteau proposed to postpone the snow shoveling issue until next meeting. e. Licensing of Hobby/Derelict vehicles. Council Member Yurchick discussed council's position on this. He stated there are three options on this: (1) change the law and enforce it, (2) enforce the current law, (3) or totally doing away with the law. This topic will be added to the April meeting. • 6. Topics for April 17, 2002 meeting. • a. Discussion of animal registration presentation on March 18th b. Review Englewood's snow shoveling ordinance c. Review of CEAC By-Laws d. Hobby vehicle licensing discussion 7. Adjournment. Member DesMarteau moved and members Belt and McCahill seconded to adjourn the meeting .
