Call to Order Vice Chair Susan Bayless called the regular meeting of the Englewood Code Enforcement Advisory Committee to order at 6:30 p.m. Roll Call Members Present: Susan Bayless, Margaret Becker~ via teleconference, Heather Roberts, James Jordan, Linda Hart, Mary Berger and Doug Cohn (Alternate). Members Absent: Council Liaisons: Rick Gillit Ex-Officio Members Present: Sergeant Mark McKay and Deputy Manager Michael Flaherty Guest: None • A quorum of the Committee was present. • II. Approval of Minutes Deputy Manager Flaherty. made spelling corrections to Mary/Nancy, Commander Tim Englert's name. Member M. Berger made a motion to approve the minutes including corrections of the July 20, 2011. The motion was seconded by Member M. Becker. The minutes were unanimously approved. III. Open Public Forum None IV. New Business A. New Members Oath of Office Letter submitted to Council Member Olson by Chris Hoagland proposing permit fees for parking recreational vehicles and boat trailers in driveways and streets. Member Becker disagrees with permit fees or changing any part of the code, it would create more recreational vehicles parked on the street which is not currently allowed; Member Hart feels the time required by staff would be prohibitive and not covered by fees; Member Berger disagrees that revenues received would offset visual loss. Council Member R. Gillit adds that Council does not want to create fines and rules that would create revenue. • • • Vice Chair Susan Bayless made a motion to review in one year and forward the minutes to Mr. Hoagland and invite him to that meeting. The motion was seconded by Member Hart and was approved 5-1. V. Unfinished Business A. Election of Officers Nominations: Member L. Hart makes aware that Marty Mossman did not apply for another term on the commission and nominations would be needed for Chair and Vice Chair. Chair: Member Bayless nominates L. Hart for Chair based on her background experience running committees. The motion was seconded by Member Roberts and was passed unanimously. Vice Chair: Member M. Berger nominates S. Bayless as Vice Chair. The motion was seconded by Member L. Hart and was passed unanimously. Linda Hart assumed Chair. B. Review of classification of potbellied pigs Chair L. Hart distributed materials on potbellied pigs from the California PotBellied Pigs Association. Member M. Berger introduces other Colorado cities with ordinances permitting pigs and requirements ; Colorado Springs, Longmont, Commerce City and Manitou Springs . Committee concerns are ; limit number of pigs to 2, weight limit, however at maturity, 4 to 5 years of age , they can get up to 200 lbs. aggression issues due to needing a mate since they are pack animals , neuter/spay requirements, trimming of tusks , sanitary issues would be addressed under health laws. Chair L. Hart wants also consideration of putting something in the potbellied pigs ordinance regarding aggressive behav ior similar to the "Dangerous Dog" ordinance. Member J. Jordan suggests a 1 year probationary period to see how it works out; Member L. Hart , it's either in or it 's out. Sunset Law mentioned but not discussed. Member M. Becker motioned to refer the potbellied pig issue to the City Attorney 's Office for drafting an ordinance. Chair L. Hart proposed an amendment to request a draft to City Attorney and refer to City Council for discussion and would also like to have someone with more knowledge come to a meeting and speak on potbellied pigs . Member J. Jordan seconded the motion to both. Amendment approved 6-0 Motion approved 6-0 • VI. Code Enforcement Activity Report Sergeant Mark McKay stated the number of violations are down right now because new Code Enforcement Officer, Susan Schnell, is still in training leaving only 2 of the 3 officers on duty. VII. Topics for Next Meeting Council Member R.Gillit; has given 3 Council requests regarding the rules on vegetation enc!oaching on sidewalks. What is the rule , what is the legal rule? Chair L. Hart refers to the code and Code can resolve the situation. Sgt. Mark McKay said Code can take a stance on the encroachment of the 90 degree rule and will follow up. Chair L. Hart suggests that this issue is one of interpretation and not for the committee to decide. Chair L. Hart will discuss Potbellied pigs in the next meeting. Member M. Becker on signage; Deputy Manager M. Flaherty will check with Zoning on the status the signage and when the public hearing is scheduled. VIII. Adjournment • Member M. Berger made motion to adjourn , Chair L. Hart seconded the motion, The motion carried. The meeting was adjourned at 7:15 p.m. Michael Flaherty, Deputy City Manager •
