CODE ENFORCEMENT ADVISORY COMMITTEE
MEETING MINUTES
SEPTEMBER 17, 2003
Call to Order.
The regular meeting of the Englewood Code Enforcement Advisory Committee
was called to order at 6:40 p.m. by Chairperson Crowell in the City Council
Confereµ_ce Room.

A quorum was present.
2. Approval of Minutes .
Member Goodrich moved to approve the minutes of the regular meeting of
August 20, 2003. All were in favor.
3. Public Open Forum.
There were four guests. Tara Curtis and Carole Curtis were observers.
Englewood citizen Scott Smolarczyk addressed his concerns on the consistent
problem with littering, broken bottles, and public urination after the concerts at
the Gothic. He wondered if it was because of the lack of security. Mr.
Smolarczyk brought up the possibility of "No Littering" signage around the
area. Lieutenant Collins will speak with Mr. Vostry on the signs. Officer
Christensen from the Impact Team will speak with Mr. Schalk from the Gothic.
Englewood citizen Bruce Geiler wanted information on the ordinances re lati ng
to trailers ie ., being used as storage, being used as a residence, or being used as a
business. Code Enforcement i s aware of this problem and has addressed it with
the viola tor.
4. Old Business .
a. Inoperable Vehicle Ordinance. Nanc y Reid , Assistant City Attorney, and
Tricia Langon, Senior Planner in Community Development, presented questions
to Code Enforcement Advisory Commi ttee on Council's behalf reference the

ordinance passed on inoperable vehicles. There is a need for some clarification
in the ordinance.
1. Should trailers continue to be prohibited as inoperable vehicles in
the front yard? Recommended to incorporate trailers issue into
"O utdoor Storage."
2. Do you think there should be allowed more than one "Off Road
Vehicle" in the back yard? No.
3. Should the UDC screening cite be inserted into the Inoperable
Vehicle Ordinance? A motion was made for "solid fence
definition" and "screening UDC cite insertion" be put on agenda for
next meeting to allow for extra study time. It was seconded. All in
favor. None opposed.
4. Should the Inoperable Vehicle Ordinance, as a matter of policy, be
enforced on a complaint basis ? Council feels this should not be on
a complaint basis and plan on being proactive. CEAC agrees with
Council on being proactive.
5. Definition of "yard" was furnished ie, front set-back, front yard and
rear yard . A set-back is defined as 25 feet back from the property
line.
6. Reference storage on a hard surface, UDC liked CEAC 's definition
of "hard surface" better than theirs.
7. Do you want to have a six-month moratorium on enforcement of
inoperable vehicles or do you want to do something such as giving
Code Enforcement some leeway? Recommended limited
enforcement action until issues with the Inoperable Vehicle
Ordinance are resolved.
b. Outdoor Storage.
1. Draft 6-24-03: An ordinance amending Title 15 Chapter 7
Englewood Municipal Code with the addition of new sub-section
four relating to outdoor storage will be revisited at the next
meeting. This is to determine whether unhooked trailers will be
included in outdoor storage; the limitation of inoperable vehicles or
vehicles stored, and the coordination of some of the definitions.
Junk will remain the same.
5. New Business.
a. Glare. Assistant City Attorney Comer presented ordinances from Littleton and
Boulder for the committee to review for the next meeting. To be discussed will
be the current language of Title 16 to include emission of heat, glare, radiation,
dust, and fumes. 16 -4-14-J-3, 16 -4-12-I, and 16 -4-13-M-3 are all the same and
that is the City's o rdinance with regard to glare . This issue of glare can be
looked at to see if it can be incorporated into the Title 15 N uisance Ordinance .

It was suggested that when the yearly ordinance cleanup happens, it can be
added in .
b. Decriminalization.
Assistant City Attorney Comer has the first draft of the Decriminalization
Ordinance. He will send copies out to be reviewed before the hearing next
month .
6. Monthly Activity Reports.
Sergeant Sanchez distributed and explained the layout of the July stats .

a. UDC -Screening issues.
b. Decriminalization.
c. Putting "Glare" into Title 15 Nuisance.
8. Adjournment.
Motion was made and seconded to adjourn the meeting. All were in favor. The
motion carried. The meeting was adjourned at 8:38 p.m .
