CITY OF ENGLEWOOD CODE ENFORCEMENT ADVISORY COMMITTEE Minutes from the Meeting of January 20, 2010 CALL TO ORDER ~ The regular meeting of the Englewood Code Enforcement Advisory Committee was called to order at 6:37 p .m . by Chair Marty Mosman . A welcome was extended to City Council Liaison Gill it and Sergeant Englert who are new to the committee. Roll Call Present: Chair Mosman and Members Bayless, Becker, Hinger, Hoagland, Wilson and Alternate Member Berger. Absent/Excused: Member Hart. A quorum was present Ex-Officio Members Present: City Council Liaison Gillit, and Staff Liaisons Flaherty and Sergeant Englert. Ex-Officio Members Absent: City Council Liaison Mccaslin. Guest Present: City Resident Andy Berger . APPROVAL OF MINUTES -~ A motion was made by Jill Wilson and seconded by Susan Bayless to approve the minutes of the November 18, 2009 meeting. There being no changes, the minutes were approved as submitted. Ill. PUBLIC OPEN FORUM ~ No one was present for the Public Op en Forum . IV. NEW BUSINESS a. 12]) Police Powers of Animal Control Officers. Sergeant Englert advised that, according to the Englewood Municipal Code, Code Officers have authority to issue a summons for a code enforcement issue, but no arrest powers for criminal and traffic violations other than parking citations. Englewood Code Officers have sworn an oath of allegiance to the City, but they are not sworn as certified peace officers. A brief discussion ensued . v. UNFINISHED BUSINESS a. ·~ Information on Foreclosures in Englewood . From January through November 2009, 116 Englewood properties commenced the foreclosure process. Discussion ensued . b . ·l?lJ Signs at Ultra Legs Lingerie . Sergeant Englert reported that this property was inspected on November 19, 2009 . The bench on the sidewalk in front of the store is owned by the Parks and Recreation Department and cannot be used by any private business . Tricia Langon has advised that advertising and products within the front inset of the building are allowed without permit as the inset is private property. Dugan Comer has advised photographs of the subject display do not show probable cause of obscene materials and no prosecution would result. Mike Flaherty advised the city has placed a moratorium on enforcement of temporary signage. During this moratorium, the Planning Commission is reviewing the sign code and will potentially put forth suggested language, hold a public hearing and make changes. The Alliance for Commerce in Englewood Committee is also reviewing this code and will make recommendations to the Planning Commission . The issue then goes to City Council for review, changes, and a second public hearing . These meetings are all open to the public. Discussion ensued. VI. CODE ENFORCEMENT REPORT The following topics were discussed. a. rlt?ll Monthly November/December 2009 and Yearly 2008/2009 statistical reports. The committee discussed the following topics: • Decline in City code violations. • Enforcement of snow removal within the City. • The City's volunteer program. • Coyote sightings and current activity. • At risk dogs, dog attacks, and dog bite issues. b. The scheduled open house for the new animal shelter is February 26, 2010. VII. MISCELLANEOUS DISCUSSION a. l?lJ Jill Wilson discussed the proposed closure of the Broadway Post Office. b . ~ Marj Becker inquired about the City's new police cars. • • • • VIII. TOPICS FOR FUTURE MEETINGS • • • Code Officer feedback on the decline in violations over the past few years. • Handicap accessibility in private, commercial parking lots -Zoning violations versus Code violations.
