Meeting Minutes
September 15, 2004
Call to Order
Vice Chair Hoaglund called the regular meeting of the Englewood Code Enforcement
Advisory Committee to order at 6:48 p.m.
Roll Call
Members Present: Vice Chair, Chris Hoagland, Michael Calahan, Darryl Estes, Dooley
Gehr, Jim Goodrich and alternate member Paul Hendricks
Absent: Jonathan Crowell, Chair, Cynthia Payne
A quorum was present.
Ex-Officio Members Present: Laurett Barrentine, Council Liaison, City Manager Liaison
Michael Flaherty, Safety Services Liaison, Lieutenant Jeff Sanchez and Sergeant
Gary Condreay
Guest: None
Approval of Minutes
Member Goodrich moved approval of the meeting minutes of J:'~S., 2004, Member
Gehr seconded. The motion carried.
III. Open Public Forum

IV. Old Business
A. Discussion of Committee By-Laws
The committee discussed the b y-laws and reviewed the suggested changes. Vice Chair
Hoaglund stated that the ordinance authorizing the Code E nforcement Advisory
Committee and the subsequent Municipal Code language makes no mention of alternate
members. Assistant City Manager Flaherty responded that he would check with the City
Attorney to determine whether alternate members could legally serve on the committee.
Member Goodrich made a motion to postpone approval of the b y-law s to the October
meeting. Member Gehr seconded the motion. The motion carried .

B. Discussion of the Code Enforcement Notice of Violation
Vice Chair Hoaglund noted that Section 15.3 .3 of the Municipal Code specifies the
language for "Notice Form". Hoaglund asked whether the language change would
require change to the Code. Lieutenant Sanchez replied that the notice form to which
the Code refers is an official abatement notice issued prior to a court summons and not a
Notice of Violation, which is advisory only.
Further discuss of the Notice of Violation included Lieutenant Sanchez' comment that
the remaining NOV forms would be used before the new forms were p rinted and that
because of the pending change, in early 2005, to an automated permit tracking system,
which would includes Code Enforcement documents, the format and appearance of the
NOV may have to change due to system limitations or the requirements of mobile
computing devises (PDA or laptop). He does yet know what information might be
included in an automated NOV, but will report back when he has that information.
After additional discussion, Member Estes made a motion for approval of the NOV
form as submitted. Member Goodrich seconded. The motion carried.
New Business
A. Introduction of Sergeant Gary Condreay
Lieutenant Sanchez introduced Sergeant Gary Condreay as the new Code Enforcement
supervisor. Sergeant Condreay has assumed direct responsibility for the Code
Enforcement Division. Sergeant Condreay will report to Lieutenant Sanchez .
B. Sidewalk Definition Issue
Vice Chair Hoaglund stated that he believed that there are inconsistencies in the
Municip al Code, Section 11, regarding the definition of "sidewalk" particularly as it
relates to the property owner's responsibility to remove snow and ice from sidewalks.
Hoaglund stated that "walkways which are constructed as an integral part of the curb
and gutter" are specifically excluded in the definition of sidewalks. This type of integral
curb-gutter-sidewalk construction is common in Englewood, including in front of the
Hoaglund home. Vice Chair Hoaglund maintains that because of this exclusion in the
definition of "sidewalk" property owners with the integral type of walkway cannot be
required to clean snow and ice from these walkways . Council Member Barrentine stated
that she had discussed this issue with the City Attorney and that the Attorney opined
that the he believe that the sidewalk definition is adequate, but would further explain his
opinion to the Committee, if requested. Vice Chair Hoaglund stated that he would like
further explanation.
Monthly Activity Report
T h e Monthly Activity Report was reviewed. Member Calahan asked about the 138
summons issued, in the "Sign" category. Lieutenant Sanchez responded that the figure was
posted in the wrong column, it should have been posted in the "Sign Removed" column and
that many of the removal were political signs posted in the public right-of-way, which is
common in an election year .

Member Goodrich made a motion to adjourn, which was seconded by Member Calahan.
The motion carried. The meeting was adjourned at 8:04 p.m.
