Call to Order Englewood Code Enforcement Advisory Committee Meeting Minutes February 16, 2005 Chair Gehr c alled the regular meeting of the Englewood Code Enforcement Advisory Committee to order at 6:30 p.rn. Roll Call Members Present: Chair Dooley Gehr, Brian Bleile , Michael Calahan Daryl Estes , Jim Goodrich , Paul Hendricks, Chris Hoaglund and alternate member Angela Hardin. A quorum was present. Ex-Officio Members Present: Sergeant Gary Condreay and Assistant City Manager, Michael Flaherty Guests: Larry Wheeler. 3 130 S . Washington St. II. Approval of i\ilinutes • Member Hoaglund mo ved for approval of the meeting minutes from January 19 , 2005. • Member Goodrich seconded. The motion carried. III. Welcome and Swearing-in of New i\ilembers Chair Gehr requested that the welcome of new members be taken out of order from the order listed on the agenda. Member Goodrich made a motion to do so , which was seconded by Member Hoaglund. The Chair welcomed new member Brian Bleile and new alternate member A ngela Hardin and conducted the formal swearing in of each. Member Goodrich. as senior CEAC member, explained the role of the CEAC to the new members . III. Open Public Forum IV. Larry Wheeler expressed his concern for possible changes to the inoperable vehicle ordinance . He s tated that he was opposed to any changes that would weaken the ordinance . Unfinished Business-Inoperable Vehicles Member Hoaglund made a motion for a five minute recess to review two draft ordinances prepared by the Cit y A ttorney at the request of the Committee. Member Goodrich seconded the motion . The motion was approved. l of 3 The first dra ft ordinance proposed that one off-road vehicle ma y be stored in the front yard on a property on a s easonal basis. The second draft ordinance would allow for an • "exception process " for storage of off-road or inoperable vehicles, in which a person in violation to the inoperable and off-road vehicle ordinance could appeal to a hearing officer for relief based on criteria for exception, including no access to rear yard or a corner lot. Following the recess, Chair Gehr asked the Committee for comments on each approach. Member Hoaglund asked whether both proposed ordinances should relate to inoperable vehicles as well as off-road vehicles. Committee members were divided on this issue. Assistant City Manager Flaherty reported that it had been his understanding from the prior meeting that the ·'seasonal exception " was intended only for off-road vehicles; however, he may have misunderstood the Committee 's intent. Member Hoaglund spoke in favor of the seasonal exception for off-road vehicles and s uggested that a City issued. color-coded sticker could be displayed on off-road vehicles , one color for the spring- summer season and another color for the fall-winter season. Member Goodrich stated that he favored an appeal process. Member Estes said that the appeal process s hould address both inoperable and off-road vehicles. Member Goodrich made a motion to recommend the exception (or appeal ) process to City Counc il :md Member Bleile seconded the motion. However, the motion failed. Discussion c ontinued. Member Hendricks stated that the current ordinance should be amended to include the proposed exception c riteria. Member Hoaglund agreed stating that an appeals process could result in different ruling being made in similar cases. which would create • inconsistenc ies. Member Hendricks made a mot ion to de la y a decision until Code Enforcement staff input could be provided o n appropriate exceptions to be incorporated into the existing ordinance. Member Bleile seconded the motion . The motion w as approved. The Committee continued to discuss the idea of incorporating exceptions into the existing ordinance. Member Goodrich suggested that. in addition to the lack of rear yard access and corner lot exceptions proposed. that a property at which the primary dwelling structure that is located within the 15 foot setback, i.e .. an "alley house", should be a reason for an exception. Member Bleile made a morion to close discussion. The motion was seconded by .\!!ember Estes. The morion was approved. V. Monthly Activity Report Sergeant Condreay distributed and discussed the 2004 year-end and the January :zoos activity reports. Significant activity in 200.+ included 1332 inoperable vehicle notices, 4000 animal related calls or notices. -+900 weed notices and -+54 graffiti notices . Significant January activities included .+60 snow removal and 136 inoperable vehicle notices. VI. Topics for Future Meeting A. Continue discussion of Inoperable Vehicles 2 of 3 • VIII • • • Adjournment Member Goodrich made a motion to adjourn , which was seconded by Member Hoaglund. The motion carried.
