I. Ca ll to Order
Co -Chair Chris Hoaglund called the regular meeting of the Englewood Code
Enforcement Advisory Committee to order at 6:35 p .m.

Members Present: Co-Chair Chris Hoagland , Brian Bleile, Michael Calahan , Jim
Goodrich, Paul Hendricks.
Members Absent: Chair, Dooley Gehr and Daryl Estes (both excused)
A quorum of the Committee was present.
Ex-Officio Members Present: Sergeant Gary Condreay and Assistant City Manager,
Michael Flaherty

II . A pprova l of M inut es
A motion to approve the minutes of the May 18 , 2005 meeting was made by Member
Calahan and seconded by Member Goodrich. The motion carried.
III. Op en Public Fo ru m
Bob McCaslin stated that he is a candidate for City Council and was present to educate
himself about the workings of the city and of Code Enforcement. Co-Chair Hoagland
thanked Mr. McCaslin for attending.
IV. U nfinished Busin ess
R ev iew of Staff R ecom mendati on on Off-Roa d Vehicl e Ordin anc e (EMC 15.9 .2)
Co-Chair Hoagland stated that he had reviewed the recommendation made by the Code
Enforcement Division . Staff has basically recommended no change to the ordinance , that
they like it as is, according to Hoagland . Member Bleile said that he was not surprised by
the recommendation since the rate of compliance is high. However, he remains
concerned that the cost of meeting the requirements for screening and hard-surface
imposes a hardship on some residents. Assistant City Manager Flaherty reminded
committee members that the ordinance allows for storage of one ORV in a car port, the
side or rear yard, if on a hard surface ; only any additional ORVs require screening.
Member Hendricks made a motion to table discussion of the matter to the next meeting,
but no second was offered. Discussion on possible means of allowing for some relief to
residents who have a hardship ensued. The option of administrative review or appeal
process for residents with specific hardships , such as comer lots or lack of access to the
rear yard was discussed. Assistant City Manager Flaherty distributed a draft council bill

that the City Attorney had prepared in February, at the request of the conunittee that
would allow such a r eview process. Co-Chair Hoagland suggested a brief recess to
review the draft. A motion for a brief recess was made by Member Bleile and seconded
by Member Hendricks . The motion was approved.
Following the recess, discussion continued on how best to address hardship cases. The
options discussed included moving forward with a recommendation for an administrative
review process , or changing the ordinance to allow for additional storage of ORV s if
certain hardships were present. At the completion of that discus sion, Member Bleile
made a motion to change title of the amendment to the code from "Exception Process" to
"Appeal Process ". The motion was seconded b y Member Goodrich and was approved
unanimous! y.
Member of the committee then discussed their concern with the draft proposal that would
require the code process to be completed prior to any court relief. Some members of the
committee felt that this would delay a resident's appeal until he or she had been formally
cited for a violation. Member Bleile made a motion to strike the proposed language of
Section 15-9-3 , subsection B , as follows , "The procedures of this Chapter shall be
followed to conclusion prior to seeking relief from a court of competent jurisdiction."
The motion was seconded by Member Goodrich and unanimously approved.
Member Bleile then made a motion that the word "Within" in proposed Section 15-9-3-C
be changed to 'Up to ". The motion was seconded by Member Goodrich . Member
Calahan suggested that the motion be amended to request a specific time limit, rather
than up to 30 days. The amendment was seconded by Member Hendricks and the
motion, as amended was approved .
V. New Business
Formal Public Forum for Code Enforcement Issues
Co-Chair Hoagland stated that he was concerned that the Committee was not receiving
adequate public input on the issues that they review and suggested holding a public
forum. He stated specifically that only two residents had taken time to come to the
CEAC meeting regarding the inoperable and off-road vehicle ordinance. Assistant
Manager Flaherty remarked that City Council holds quarterly public forums and that at
their most recent forum on May 23 ; about 6 residents spoke, all but one of them about
their concern for residential storage of their Recreational Vehicles , which are not
impacted by the inoperable or off-road vehicle ordinance. After additional discussion,
the Committee concluded that it would be better to solicit public input through the City of
Englewood Citizen newsletter, the En glewood Herald and the City website. Member
Bleile volunteered to draft a brief article for the Citizen and the web site.
VI. Monthly Activity Report
Sergeant Condreay distributed and discussed the May 2005 activity report. Significant
activities included 318 weed notices and 84 inoperable vehicle contacts , but only two

case involving an off-road vehicle. A total of 120 animal control cases, 73 trash and litter
were also reported for May. (A copy of a summary of May cases is included with these
minutes.)

VIII. Other Business
Member Goodrich informed the committee that this would be his last meeting as his term is
up and he is not re-applying. He stated that he would soon be moving out of the City.
Member Calahan announced that his term was also up and that he was leaning against re-
applying due to his schedule. Co-Chair Hoagland and committee members thanked Mr.
Goodrich and Mr. Calahan for their service. Hoagland remarked that he would miss Mr.
Goodrich's advocating of neighborhood covenants .
VIII Adjournment
Member Goodrich made a motion to adjourn, which was seconded by Member Calahan.
The motion carried. The meeting was adjourned at 8:15 p.m.
