City of Englewood Code Enforcement Advisory Committee Minutes from the Meeting of July 16, 2008 ~ Call to Order The regular meeting of the Englewood Code Enforcement Advisory Committee was called to order at 6:37 p.m. by Chair Hoagland. Board members appointed July 7th were introduced. Roll Call Present: Chair Hoagland, Members Mosman, Bayless , Becker, Cox, Hart and Wilson. Absent/Excused: None A quorum was present. Ex-Officio Members Present: Council Liaison Mccaslin, Staff Liaison Flaherty, and Sergeant Contos . Absent/Excused: Council Liaison Penn. ~ Approval of Minutes A motion to approve the minutes of the June 18, 2008 meeting was made by Member Becker and seconded by Member Mosman. The minutes were approved. ~ Public Open Forum None. IV. -New Business A. Introduction of New Code Enforcement Advisory Committee Members Introductions were made earlier in the meeting. B. CG Election of New Officers c. A motion to elect Chris Hoagland as Chair and Marty Mosman as Vice Chair for the coming year was made by Member Becker and seconded by Member Wilson. The vote was unanimous. 0 Board and Commission Appreciation Night Chair Hoagland reminded board members of the City's Board and Commission Appreciation Night on Monday, August 11th . This event will be held at Pirates Cove at 6:30 pm. All board members are invited. , • • • V. El Unfinished Business A. .a Use of Violations Bureau to Expedite Code Enforcement CEAC members have been interested in expediting the processing of tickets and want to develop a list of violations that can be sent to the violations bureau rather than going through the judicial process . Discussion ensued on decriminalization, administrative and judicial abatements, and violations bureau procedures . .a Council Request made by Council Liaison Mccaslin for information from the City Attorney's office: • Of the issues that code officers enforce, how man y of these could go to v iolations bureau? • How would this affect abatement? • At what point can we reprosecute for a continuing offence or issue another summons? When does a violation become a second offense? -Chair Hoagland suggested the Committee also ask the City Attorney's office whether adding a violations bureau option would impair any other part of the process. And could a violations bureau option be added to the process simply as a matter of City policy or would an ordinance change be required? .a Member Becker requested a copy of the Englewood Municipal Code covering the codes being discussed by this Committee for her reference . Staff Liaison Flaherty advised that the current Municipal Code is dated 2002 and some of the ordinances have changed. However, Titles 11 and 1 5 would cover the majority of the issues being discussed by the Code Enforcement Advisory Committee . .a The Committee asked that Code Officers review the Municipal Code and compile a list of current ordinances for the Committee. Sergeant Contos will forward this request to Commander Watson . B. .a Chair Hoagland's Flowchart Regarding Abatement and Decriminalization. This was discussed under Item V.A. above. C. .a Storage of trailers on driveway when there is no back or side yard D. Council Liaison Wilson advised that City Council discussed this issue in a recent Study Session and will be discussing this further at an upcoming meeting. Chair Hoagland asked that the Committee be advised of when this meeting will occur so CEAC members can attend . El Guidelines on Board Communications and Meetings -Staff Liaison Flaherty advised that the City Attorney prepared a memorandum with guidelines concerning communications between and informal gatherings of board members. A copy of the City Attorney's memorandum will be provided to Committee members in the September packet. Essentially, for any formal or 2 • • • E. informal meeting where three or more members are gathered, a notice with an agenda must be posted. This also holds true for telephone conversations as well as e-mail communications . ..s Code Enforcement response to Council Request #08-166 and similar CEAC request regarding abatement procedures The Committee briefly discussed a memorandum from Police Chief Tom Vandermee describing the city's policy relating to abatements. VI. -Code Enforcement Monthly Report VII. VIII. Sergeant Contos furnished the Committee a comparison of Code enforcement statistics from June 2007 with those of June 2008. Discussion ensued on the disposal of dead animals, trapping and releasing animals, graffiti, and weeds. It was noted that Patrol officers as well as Code Enforcement Officers are turning in reports of violations. This more aggressive enforcement has resulted in an increase in the number of violations written. -Topics for Future Meetings • Use of Violations Bureau to Expedite Code Enforcement • Trailer Storage on Driveways • Guidelines on Board Communications and Meetings -Committee Member Comments Sergeant Contos reminded Committee members there will be no meeting in August. Member Wilson has seen improvement in the City of Englewood in that she doesn 't see graffiti and the City looks better. She appreciates what code officers are doing. Englewood citizen Jerry Nay complained at a Council meeting a month ago that the Circle K Shell Station at Federal and Belleview was using a distressed bird signal to keep pigeons away. This signal was disturbing to the neighbors. Sergeant Contos' has since talked with the manager of Circle K, and the distressed bird signals are no longer being used. Jay Nay asked Chris Hoagland to thank Sergeant Contos for his work on that. IX. -Adjournment There being no further business, the meeting was adjourned at 7:57 p.m. Submitted by ~)/~ 3
