CALL TO ORDER City of Englewood Code Enforcement Advisory Committee Minutes from the Meeting of December 17, 2008 The regular meeting of th e Englewood Code Enforcement Advisory Committee was called to order at 6 :40 pm by Chair Hoagland. Roll Call Present: Chair Hoagland, and Members Mosman, Bayless, Hart and Wilson. Absent/Excused: Members Becker and Cox. A quorum was present. Ex-Officio Members Present: Staff Liaisons Flaherty and Sergeant Contos. Absent/Excused: Council Liaisons Mccaslin and Penn. APPROVAL OF MINUTES A motion to appr ove the minutes of the November 19, 2008 meeting was made by Member Mosman and seconded by Member Wilson. The minutes were approved as submitted . PUBLIC OPEN FORUM None IV. NEW BUSINESS a. Colorado Humane Society Status Mike Flaherty provided an update on the Colorado Humane Society regarding the Colorado State Attorney General 's civil suit and court appointment of a custodian. Discussion ensued. b. Neighborhood Services Commander Appointment c . Chair Hoagland announced the recent selection of Gary Condreay as Neighborhood Services Commander. Feeding of Wildlife Sergeant Contos requested an Englewood Municipal Code amendment prohibiting the feeding of wildlife within the city limits; this amendment would exclude song birds . Discussion ensued. As the Committee requested additional information, Linda Hart volunteered to research what other cities have done and what County • and State laws exist. She will also look into recommendations from other state wildlife divisions. d. City Website Request Member Hart reported that the Vicious Animal Task Force has discussed possible educational resources such as postings on the City website to inform the public about the new animal ordinance. Discussion ensued. e. City of Littleton -Snow Removal 'Alert' The City of Littleton currently uses a doorknob hanger as a snow removal 'alert'. The Committee discussed incorporating a similar doorknob hanger in Englewood's notification process . Sergeant Contos advised that the current notification process is in place and will remain consistent. V. UNFINISHED BUSINESS a. Discussion regarding use of the Violations Bureau Tamara Wolfe had previously provided a list of violations approved by the Judge for referral to the Violations Bureau. The Committee continued their discussion on what other violations could potentially be sent to the Violations Bureau. Member Wilson made a motion to refer a list of items to the Court to see if the Judge would approve them as violations and not as court dates onl y. Member Mosman seconded this motion. The Committee vote was unanimous. Chair Hoagland inquired about the possibility of clearing tickets through Assistant City Attorney Comer in an attempt to reduce the amount of court traffic and to assist citizens in resolving issues . Mike Flaherty will discuss this with the City Attorney and report back. b. Report from the Vicious Animal Task Force (VATF) on Dog Owner Training Recommendations The VATF has discussed and will be drafting a recommendation on the education, training, and test criteria for required behavior standards of rehabilitated vicious animals. Marty Mosman has volunteered to assist the VA TF . Sergeant Contos will provide copies of informational material currently being disseminated. The VA TF will meet early in January and make a preliminary report at the next CEAC meeting. c. Guilty Pleas during the Court Process Although the new animal ordinance was approved by City Council and the 30-day waiting period has expired, it has not been codified and therefore does not currently • appear in the Englewood Municipal Code. Recently a guilty plea was inadvertently • entered by a citizen who apparently did not understand the new law; and the Committee understands that once a plea is entered, it cannot be withdrawn without 2 .· • • • the Judge's order to do so. Discussion ensued. Member Hart will contact Assistant City Attorney Comer regarding what can be done in this situation. She will report back at the next meeting. d. Graffiti patterns in the City of Englewood Sergeant Contos reported on reasons for fluctuations in graffiti throughout the year. e. Comment from CEAC on the EMC Code pertaining to Code Enforcement This was discussed under item V.a. above. VI. CODE ENFORCEMENT MONTHLY REPORTS FOR NOVEMBER Sergeant Contos reviewed the November 2007 and November 2008 reports with Committee members. VII. TOPICS FOR FUTURE MEETINGS • Update on Colorado Humane Society • Report on Wildlife Policies, Ordinances, and Statutes in other Jur isdictions • Dissemination of Animal Ordinance Information through the City Website • Update on Dangerous Dog Education and Behavioral Training • Court response to Violations Bureau questions • Assistant City Attorney response on Reversal of Guilty Plea VIII. ADJOURNMENT There being no further business, the meeting adjourned at 8:49 pm . 3
