Call to Order Englewood Code Enforcement Advisory Committee Meeting Minutes May 17, 2006 Chair Dooley Gehr called th e regular meeting of the Englewood Code Enforcement Advisory Committee to orde r at 6:34 p.m. Roll Call Members Present: Chair Dooley Gehr, Co-Chair Chris Hoagland, Darryl Estes and Marty Mosman. Members Absent: Brian Bleile (excused), Paul Hendricks (excused) and Marc Ogonosky (alternate). A quorum of the Committee was present. Ex-Officio Members Present: Council Liaison Laurett Barrentine, Council Liaison Jim Woodward, and Sergeant Gary Condreay . Ex-Officio Member Absent: Mike Flaherty (exc used ). Guest: Robert Maes, 3332 South Sherman, Englewood. II. Approval of Minutes Ill. Chair Gehr asked if there are corrections to the minutes of the April 19, 2006 meeting. Member Hoagland pointed out that the fourth paragraph on Page 3 of 4, just above Item C, does not clearly state the reason the Committee voted against the modifications to Title 15 proposed by the City Attorney's office. Following a discussion, it was recommended the minutes be amended as follows. "As the curren t ordinance is already in harmony with the CDOT model traffic code, the Code Enforcement Advisory Committee recommends that the City not implement the City Attorney's recommendation to alter the language of Municipal Code 15-9-2." A motion to approve the minutes of the April 19, 2006 Code Enforcement Advisory Committee meeting, as amended, was made by Member Mosman and seconded by Member Estes. Th e minutes were unanimously approved . Open Public Forum Mr. Robert Maes, 3332 South Sherman, sits on another board -Posi tivel y Englewood with Council Liaison Barrentine and Member Estes and is here to observe. He may have interest in serving on the Code Enforcement Advisory Committee. 1 IV. Unfinished Business A. Dangerous Dog Discussion Chair Gehr stated that at the April meeting the Committee agreed to not recommend any changes to the current ordinance. This was precipitated by the recent decision of City Council to raise the maximum fine imposed on owners of dogs or animals in violation of this ordinance. An inquiry was sent to Dugan Comer and his response was distributed to the Committee. Sergeant Condreay asked if there were any questions. Council Liaison Woodward voiced his opinion on a number of items such as tethering, training, fences, repair of gates, signage, muzzling, and minimum fines. Council Liaison Barrentine stated that dog owners have been cooperative and have attempted to come into compliance voluntarily by taking whatever measures necessary so a dog is under control. It seems the ordinance is working. B. Property Owner's Responsibility for Public Right of Way Discussion 11-5-5 Member Hoagland opened this discussion with background information. He advised that the State of Colorado has authorized cities to require property owners to maintain vegetation growing on their property so that it doesn't project into or • interfere with a public right of way. The City of Englewood has expanded this to • allow the City to compel property owners to maintain adjacent property that doesn't belong to them. His contention is that the City should not have authority beyond what the State authorizes. Maybe this gets into Constitutional Law, but the Colorado Statute clearly states that an individual is responsible for maintaining vegetation on his property. It says nothing about compelling a person to work on the property next door. He took interest in this issue as a property owner was facing a huge fine and a situation that was grossly unfair as they were being required to maintain a section of public right of way. Council Liaison Barrentine stated that neither the property owner in question nor any other property owner is bringing the issue up at this time. She has contacted the City Attorney and the Public Works Department to find out if there is a limit on distance; i.e., five feet, 20 feet, a block, a mile. She feels we need to make sure that anyone buying property in the City of Englewood understands their obligation if they buy property adjacent a right of way parcel. Council Liaison Woodward suggested this issue might impact the Parks Department as they maintain the Little Dry Creek, the Beltways, Northwest, Southeast and City Ditch easements. Council Liaison Barrentine said people along these areas may have put in landscaping that is actually on City property. Chair Gehr said this sounds like it falls outside the realm of a single committee and suggests City Council provide some direction. 2 • • • • c. Council Liaison Barrentine will contact the City Attorney before the June meeting on how to proceed . Perhaps the City Attorney can provide information. Or perhaps it should be brought up as a Council Request. Funfest Booth Discussion Member Mosman has made arrangements for booth space at FunFest on August 26th. An awning and table are needed for the booth. She wants to hand out flyers on Code Enforcement and also wants to coordinate a game for the kids with favors or prizes. The booth can be manned by Committee members working in two hour shifts. Sergeant Condreay volunteered that Margie Payne works with exotic birds, taking them to schools and events, and might be available to show them at the booth. He will follow-up with her. Discussion ensued. The Committee will continue making plans at the next meeting. V. New Business A. Shopping Cart Recovery Discussion Sergeant Condreay is pulling this Agenda item. He and Nancy Peterson, Community Relations Officer, have been working on this for six months. Seven of the 13 businesses have contracted to have their shopping carts picked up and returned by Pro Buggy, an independent contractor. Sergeant Condreay and Commander Jeff Sanchez will be meeting with the City Attorney on a procedural item, but most businesses are in compliance and the program seems to be working. VI. Monthly Activity Report Sergeant Condreay distributed and discussed the April activity report. Graffiti continues to be a significant problem . A task force has been formed with Greenwood Village, Lakewood, and Arapahoe County. Littleton also wants to be a part of it. In the next few months, we may have six or seven jurisdictions that will all share information. Member Estes said that Code Enforcement Officer Larry Medina is in contact with the Boy Scouts, and they 've been covering graffiti with paint. Council Liaison Woodward advised that Judge Atencio is in charge of a juvenile community service group that goes out one Saturday a month with Larry Medina to also clean up graffiti. Parks and Recreation cleans up graffiti in the parks. Public Works street crews clean traffic poles, stop signs, etc. And Code Enforcement officers carry ·spray paint in a variety of colors for the graffiti they encounter. Public Works Director Rick Kahm had the lot on the northeast corner of Corona and Hampden regraded to cover the wall so there's no place for graffiti; native grass will be planted on the lot. Council Liaison Woodward advised that the City owned, white ACT house at Zuni and Wesley was recently covered with graffiti and then painted over with 3 black paint. This actually looks worse than the graffiti, and the house needs to be demolished quickly. There are many other areas of on-going graffiti incidents -this is the time of year with the end of school that activity increases. The Parks and Recreation Department has approved Colorado's Finest Alternative High School's graffiti art project on the east and west sides of the skate half pipe at Cushing Park. Joyce Parsons retired in March, and Carolyn Faseruk who works the east side of Broadway north of 285 has taken over the majority of Joyce's duties. VII. Topics for Future Meeting • Language modification to the Off Road Vehicle Code 15-9-2 and 15-9-3. • Right of way limitations in Ordinance 11-5-5. • Foreclosed and Abandoned Properties. • FunFest event. VIII. Adjournment Member Estes made a motion to adjourn; this was seconded by Member Hoagland.
