BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF ENGLE·
WOOD, COLORADO:
Section 1. Section 6.1 through
and including Sect i on 6.6-15, Section
6.7-7 through and. including Section
6.7·9 , Section 6.7·29 and Section
6.7-30 of the Municipal Code of the
City of Englewood , together with any
Ordinances inconsistent with the
prov is ions of Section 2 hereof , are
hereby re pea led.
Section 2 . Chapter 6 of the Mun -
i c ipa I Code of the City of Englewood
i s hereby amended by the add1t 1on
thereto of new Sec tions 6.1-1 through
and includin_g 6.3-9. which shall read
as follows :
§ 6.1 Munic ipa I Employment Ad-
ministrat i on
~ 6.1-1 Career Service Boa rd.
There is hereby created a Board of
Caree r Serv i ce Com missioners , here-
after referred to as the "Board,"
which sa id Board shall consist of
three qualified electors sympathetic
with the i ntent and purposes set forth
in Art i cle XV of the City Charte r.

a ppo 1n te d by the Counc i I for a term
of two years . beginning June 1 . 1959 :
o ne member for a term of four years,
beginning June 1. 1959: and one mem-
ber for a term of s ix years . beginning
June 1 , 1959. Thereafter . each Com-
missioner shall be appointed for a
term of s 1x years . Members of the
Board shall hold no other appointive
or elective municipal off i ce during
their tenure on such Board. The y
shall receive such compensation and
or reimbursement for expenses as may
be determ in ed from time to time by
the Counc il.
§ 6.1-2 Responsibility of Career
Service Board. The Board shall be
generally responsible for the admin-
istration of the career service system
of the City of Englewood , as the same
is established by the provisions of
this Chapter 6, and sha II perform such
duties as may now, or hereafter , be
imposed upon them by the Charter or
any ordinance. The Board shall have
the authority to adopt necessary
rules and regulations , not incons is-
tent with the provisions of this Chap-
ter 6 , as may be necessary or ap-
propriate to administer said system or
to carry out its responsibilities and
duties ·im posed thereby.
~6 .1-3 Personnel Director.
(a) The City Manager shall, after
consultation with the Board , appoint ,
suspend , remove and transfer , an
employee of the City as Personnel
D irector who shall , for purposes of
Section 138 of the Charter and
§6 .2-1 of this Code. be considered to
be a department head.
(b) The Personnel D irector shall
give such aid and assistance to the
Board , in the performance of its re·
sponsibilities and duties , as may be
necessary, including, without limita-
tion :
(1) Generally supervising all
other employees designated
by the C i ty Manager to ren-
der clerical and general
office assistance to the
Board ; '
(2) Preparing and recommend -
ing to the Board all neces-
sary rules and regulations to
carry out the provisions of
this Chapter E ;
(3) Interpreting and enforcing ,
subject to review by ~he
Board , all such rules and
regulations;
(4) Assisting the appointing
authority all departments o•
the City , and the Board in
establishing qualifications
for pos itions with the City ,
preparing and holding exam-
i nations and passing upon
the qualifications of appli-
cants , establishing eligibili-
ty lists and certifying
eligible applicants to the
appointing authority to fill
vacancies :
(5 ) Preparing for the approval of
the Board a position clas-
sification plan with spec i·
f ic at ions, dlld rev is ions
thereof when necessary; per-
forming position audits and
recommending to the Board
the allocat i on or realloca-
tion of all positions to
classes within the classi-
fication plan.
(6) Establishing and maintain-
i ng a file of all career ser·
vice emp loyees and such
records, forms and proce-
dures as necessary to
facilitate personnel trans-
actions.
(7 ) Collecting personnel data,
relating to wages, from
throughout the Denver met-
ropolitan area comparing the
same with the presently
effective pay plan for C i ty
employees and, based there-
upon, recommending to the
Board an annual pay plan
for submission to City
Council.
(8) Performing such other duties
as may be necessary to im-
plement the career service
system.
(c) In addit i on, the Personnel
Director shall, under the supervision
of the City Manager :
(1) Recommend and administer
an employee in-service
training program ;
(2) Recommend and administer
an employee safety pro-
gram:
(3) Consult with employees on
matters relating to employee
problems or complaints
which cannot be resolved
with in any department and
report thereupon to the
City Manager;
(4) Accumulate personnel data
relating to employee bene-
fits of municipal employees
in the Denver metropolitan
area and report thereupon
both to the Board and to the
City Manager :
(5) Carry out such other ass ign -
ments, not inconsistent with
the foregoing, which he may
be delegated, from time to
time, by the City Manager.
§6.1-4 Record ing Secretary . In
accordance with Section 53 of the
Charter , the C ity Manager shall des-
ignate a recording secretary for the
Board, who shall keep a record of all
the proceedings before the Board .
§6.1-5 Othe r Clerica l Ass istance .
The City Manager may, from time to
time, upon recommendation of the
Board , designate such other and fur-
ther employees of the C i ty to aid the
Board in the performance of necessary
clerical and genera I office work .
§ 6.2 Career Serv ice System
§ 6.2·1 Applicability and Purpose.
The provisions of § 6.2·1 through
6.2-11 shall be known as the "Caree r
Serv ice System of the City of Engle-
wood " and shall apply to all em-
ployees of the C ity (hereinafter cal-
led "classified employees "l excep t
all elective officers , all appointees of
Council , all department heads , one

any head of a department, Board or
Commiss ion, one confidential secre-
tary in the off ice of each departmen t,

State Statutes, is expressly reserved.
Section 136 . Assignment-Assignment or leasing of a franchise shall be
considered a forfeiture unless application therefor be made
to the City and consent given by Council by ordinance with
such change of conditions or terms as they may deem neces-
sary. Council reserves the right to deny any assignment of
franchise .
ARTICLE XV
ENGLEWOOD CAREER SERVICE SYSTEM
Section 137. Enabling Act-Council may create, by ordinance, a Board of
Career Service Commissioners. This Board shall consist of
three qualified electors, sympathetic with the intent and
purposes herein set forth. The members of said Board shall
be initially appointed by Council for terms of two, four, and
six years. Thereafter each Commissioner shall be appointed
for a term of six years. Members of the Board of Career
Service Commissioners shall hold no other appointive or
elective municipal office during their tenure on the Board
of Career Service Commissioners.
Section 138. Principles -Board of Career Service Commissioners
shall submit to Council a Career Service System embodying
the following principles-
A. Classification of all full time regular employees of
the City.
B. Employment based on open, free and competitive
examinations as to fitness for employment. Actual
employment to be made from a certified eligibility
list prepared by the Board of Career Service Commis-
sioners and based on the examinations.
C. Promotion within the Englewood Career Service to be
made from a certified list of eligible employees
prepared by the Board of Career Service Commis-
sioners and based on merit, experience and record of
service.
D. Establishment of pay scales , retirement plans and
other benefits.
E. Review for approval or disapproval , by the Board of
Career Service Commissioners, all contested termina-
tions and disciplinary actions. The decisions of the
Board shall be final.
F. Placement in their proper classification, without fur-
ther examination, all full time regular employees of
the City having at least one year's satisfactory em-
ployment at the time the Career Service System is
adopted.
G . Exclusion of all elective officers, appointees of the
Council and heads of departments.
H. Exclusion of one confidential secretary in the office
of the City Manager, and in the office of each depart-
ment, board or commission at the discretion of the
City Manager, head of the department, board or com-
mission, respectively.

Section 139 . Implementation-Upon passage of an ordinance creating the
Englewood Career Service System, the Board of Career Serv-
ice Commissioners shall implement the system with appro-
priate rules and regulations as authorized by the enabling
ordinance.
ARTICLE XVI
TRANSITIONAL PROVISIONS
Section 140. Status of Transitional Provisions-The purpose of this Ar-
ticle is to provide for an orderly transition from the present
City government to a Home Rule Government under the
provisions of this Charter. This Article shall constitute a part
of this Charter during the transition period.
Section 141. Transition Period-The period from the effective date of this
Charter to January 1, 1960, shall be known as the transition
period. During this period, all officers and employees shall
proceed with due diligence to put into effect the provisions
of this Charter. During the transition period, the Council
shall designate by resolution provisions of the Charter to
become operative. The resolutions shall fix the dates on
which, and the a gency or agencies to which, each provision
becomes operative. Until superseded by this Charter or any
. provision thereof the State Statutes shall be in effect.
Section 142. Present Council and Mayor to Continue in Office-Council and
Mayor, or their appointed successors, in office at the time of
the adoption of this Charter shall continue at their present
salaries to serve and carry out the functions , powers and
duties of their offices until the first Monday after January
1, 1960 .
