CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION March 23, 1966 Regular Meeting Page 903 The Regular Meeting of the City Planning and Zoning Commission was called to order by Chairman Woods at 8:05 P.M. Members present: Carlson, Love, Rice, Touchton, Woods Romans, Ex-officio Members absent: Parkinson II. APPROVAL OF MINUTES. Mr. Woods stated the Minutes of February 23, 1966, were to be considered for approval. Rice moved: Carlson seconded: The Minutes of Februa~y 23, 1966, be approved as written. The motion carried unanimously. III. AUDIENCE. Chairman Woods welcomed Linda Douglas and Larry Barton, students from Englewood High School, to the meeting. These students will be assigned to the Planning and Traffic Department on Student Government Day. IV. SOUTH ENGLEWOOD K-Mart Store Touchton moved: REZONING R-3-B to B-2 and R-4 CASE #21-65C February 16, 1966 Rice seconded: The Public Hearing on requested rezoning of the K-Mart property from R-3-B to B-2 and R-4 be opened. Mr. Parkinson entered and took his place with the Commission. Mr. Woods called for the vote on the motion: AYES: Carlson, Love, Rice, Touchton, Woods NAYS: None ABSTAINING: Parkinson The motion carried. Mr. Woods asked Mrs. Romans to review the case. Mrs. Romans stated the subject area had been zoned R-3-B following annexation to the City of Englewood. A District Court ruling placed the property back under County jurisdiction, and rezoning by the County to permit the K-Mart Stor€ was accomplished. A Supreme Court decision reversed the District Court ruling, and returned the property to Englewood. However, building permits had been obtained from the County and construction of the building begun. The building is in the present R-3-B zone, and is non-conforming under the 1963 Comprehensive Zoning Ordinance. To make the use conforming, the B-2 zoning would have to be extended westward over Lots 1, 2, and 3, Ewing Subdivision, and Lot 16, Interurban Addition, To provide protection to the residential property west of this subject site, a 50 foot strip of R-4 zoning has been suggested for Lot 1, Ewing Subdivision, and Lot 16, Interurban Addition. The property was so posted, and publication given in the official City newspaper. Mr. Woods asked for those in favor of the rezoning to speak. Mr. Bill Tom stated he was an associate of Hiester, Tanner, and Clanahan, counsel for the Northwest Land Development Company in charge of the development of the property. They are in agreement with the proposed rezoning, as outlined by Mrs. Romans. Mr. Woods asked for those in opposition to speak. There were no opponents to the proposed rezoning. Mr. Parkinson inquired about the Lininger Rezoning which was before the µittleton Planning Commission recently. Mrs. Romans stated the request had been denied. Love moved: Rice seconded: The Publ.ic Hearing be closed. The motion carried unanimously. The rezoning case was discussed. Rice moved: Love seconded: The Planning Commission recommend to City Council the approval of the change of zoning of the west 50 feet of Lot 1, Ewing Subdivision and the west 50 feet of Lot 16, Interurban Addition, from R-3-B to R-4; the east 50 feet of Lot 1, all of Lots 2 and 3, Ewing Subdivision, and the east 316 feet of Lot 16, Interurban Addition from R-3-B to B-2 for the following reasons: Page 904 1. The property is being developed commercially subsequent to a building permit being issued in Arapahoe County prior to the area being assigned to the City by the State Supreme Court. 2. The R-4 zone will serve as a buffer between the business zoning and the residential area to the west. Th e motion carried unanimously. - - - - --- - - - --- --- - - - - - V. R. A. MILLER SECTION 22,5-19 2400 South Raritan Trash Transfer CASE #6-66 Mrs. Romans presented a referral from B. A. Wallace, Chief Building Inspector, on a "transfer and salvage dump operation" at 2400 South Raritan. This use is not mentioned as a permitted use in any of the zone districts, and is being referred to the Planning Commiss i on under Section 22,5-19 of the 1963 Comprehensive Zoning Ordinance, which reads: "Upon recommenda- tion of the Planning Commission, a Building Permit may be issued for any lawful use rot pro- vided f or in this Ordinance, when, in the opinion of the Commission such use is compatible wit~ a~d not objectionable to nearby property by reason of odor, dust, fumes, gas, noise, rad1at1on, heat, glare or vibration or is not hazardous to the health and property of the surrounding areas through danger of fire or explosion." Members discussed the proposed operation with Mr. Miller, who stated it would be a "pay dump"; the trash will be sorted as it comes in, and salvageable materials will be hauled to the purchasers each day. Non-salvageable matter will be taken to a regular dump. Mr. Miller stated the trash bins will be washed every day ; the property will be fenced to prevent litter blowing onto adjacent property. The type fencing to be used was discussed. Screening requirements of the I-1 zone distric t were cited, which set forth requirements for a "closed-face fence" or "masonry wall" for the portion of the parcel that is adjacent to a residential use or a residential district. Mr. Love suggested a trial period for the proposed operation rather than unconditional approval. Commission members concurred, but felt it should be considered by the City Attorney. Mr. Miller stated he would have an initial investment of $5,000 or more. Mr. Carlson asked if any of the operation could be moved i f it did not prove successful? Mr. Miller stated only the trucks could be moved ; the bins would be set in concrete. Commission members discussed a possible meeting to view the property prior to making a recommendation. Rice moved: Parkinson seconded: The Planning . Commission meet to view the subject property; also the Planning Director be directed to discuss the proposal and whether or not a time limitation could be imposed with the City Attorney. The motion carried unanimously. VI. ENGLEWOOD HIGH SCHOOL STUDENT PLANNERS. Larry Barton and Linda Douglas, students of Englewood High School, gave a presentation on their study of water pollution and the South Platte River. Mr. Barton stated the students had taken trips along the Platte River from above Waterton to its confluence with Cherry Creek and had seen the dumping of refuse done by industrial and municipal uses. A committee, Student Organization Against Pollution (SOAP), was formed to. extensively study the pollution problem. Several high schools participated in this committee; among them were: Colorado Academy, Englewood High School, Mapleton High School and East High School. It is the goal of the students to promote development for recreational purposes along the River. Mr. Barton displayed photos of the river in San Antonio, Texas, and discussed the development of the river-recreational facilities in that City. Mrs. Romans introduced Mr. Ragsdale, publisher of the "Biopholist". Mr. Ragsdale has been quite active in the pollution study, and has given these students mention in his publication. Mr. Ragsdale commended the students for their interest in the problem, and stated he felt they were doing a very good job. Commission members expressed their appreciation for the presentation, and also commended the students for ther interest in this problem. VII. FUTURE MEETINGS. Mr. Woods discussed future meetings of the Planning Commission. March 30, 1966: Englewood Shopping Center groundbreaking at 1:30 P.M. An evening meeting had tentatively been planned to discuss the plans for the shopping center. However, it has been suggested by Mr. Davis, President of New Englewood, that the meeting be held in the a f ternoon following the groundbreaking. Members discussed the time change for the meeting. It was their opinion the meeting should still be held in the evening, inasmuch as some members of the Council and Commission would not be able to conveniently be away from their businesses during the day. April 6, 1966: Joint meeting with the Parks and Recreation Commission. I I I I I I Page 905 Commission members discussed a date .and time to view Mr. Miller's proposed operation on South Raritan. They decided to meet March 26, 1966, 7:00 A.M., at Harold's Pancake House for breakfast, and then view the property. It was moved and seconded to adjourn the meeting. The motion carried, and the meeting adjourned at 9:30 P.M. Gertrude G. CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION March 30, 1966 Special Meeting The Special Meeting of the City Planning and Zoning Commission was called to order at 6:10 P.M. by Chairman Woods. Members present: Love; Parkinson; Rice; Touchton; Woods Romans, Ex-officio Members absent: Carlson II. R. A. MILLER 2400 S. Raritan SECTION 22.5-19 Trash Transfer CASE #6-66A March 23, 1966 Mr. Woods discussed the March 26, 1966, meeting of the Planning Commission, at which time the property Mr. Miller is considering for use as a "trash transfer" business was viewed by the Commission. It was the feeling of the Commission, and of City Attorney Criswell, that a contract should be written; Mr. Miller has indicated he will agree to this. Limitations as set forth in the 1963 Comprehensive Zoning Ordinance which will affect .the proposed use were also discussed. It was questioned whether or not the property will have to be screened along South Tejon Street, inasmuch as the use will not extend that far westward, but will be much closer to South Raritan Street. It was suggested that perhaps screening or fencing, could be placed along the western boundary of the use itself, with the entire operation subject to yearly review. Mr. Rice c0mmented that the entire northwestern area o f the City is developing , and this development itself will have an e ffect upon the subject property -- it is possible the use can not afford to be continued with the increased value of the land. City Attorney Criswell entered and took his place with the Commission. The discussion was reviewed for Mr. Criswell. Mr. Criswell pointed out that the Building Department was ready to let a contract to have the property cleaned up as per Court per- mission. The bill f or such contract will be given to the Court, which will give the City a lien on the property. The possibility o f obtaining an agreement from the lessee that he will clean the property at his expense will aid both the City and the prospective lessee.
