CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION April 6, 1966 Regular Meeting Page ·907 The regular meeting of the City Planning and Zoning Commission was called to order at 8:00 P.M. by Chairman Woods. Members present: Love, Rice, Touchton, Woods Romans, Ex-officio Members absent: Carlson, Parkinson Also present: Denver Planning Director Braman Assistant City Attorney Paup Mr. R. A. Miller II. APPROVAL OF MINUTES. Chairman Woods stated Minutes of the meetings of March 23, 1966, and March 30, 1966, were to be considered for approval. Love moved: Touchton seconded: The Minutes of the March 23, 1966, and March 30, 1966, meetings be approved as written. The motion carried unanimously. III. R. A. MILLER 2400 S. Raritan 1963 Comprehensive Zoning Ordinance Trash Transfer Station CASE #6-66B March 30, 1966 March 23, 1966 Mr. Paup of the office of City Attorney, presented members copies of an opinion requested by the Planning Commission on Mr. Miller's proposed trash transfer station. Mr. Paup stated that he understood the question of the Commission was whether the trash transfer use was governed by Section 22.4-13b(2) of the 1963 Comprehensive Zoning Ordinance, or by Section 22.5-19. Section 22.4-13b(2) reads" The sale at wholesale, the warehousing and/or storage of any commodity, except live animals, commercial explosives or above-ground bulk storage of flammable liquids or gases, unless and only to the extent that such storage of liquids or gases are directly connected to energy or heating devices on the premises or to service adjacent railroad locomotives." Section 22.5-19 reads: "Uses not Mentioned. Upon recommendation of the Planning Commission, a Building Permit may be issued for any lawful use not provided for in this Ordinance, when, in the opinion of the Commission such use is compatible with and not objectionable to nearby property by reason of odor, dust, fumes, gas, noise, radiation ; heat , glare or vibration or is not hazardous to the health and property of the surrounding areas through danger of fire or explosion." Mr. Paup reviewed decisions of the Colorado Supreme Court, wherein it is stated ordinances should be construed"in favor of the right of the property owner." Mr. Paup discussed the opinion of the Attorney's office. It was his feeling the proposed trash transfer could better be controlled, and enforcement more effective, were the Com- mission to grant permission under Section 22.4-13b(2). Discussion followed. Mr. Touchton commented that "storage of commodities" could lead to a very undesirable situation. Mr. Love was also concerned about "warehousing" and storage; he pointed out that while Mr. Miller had stated in his written request there would be no "storage", it is a possibility. He felt this would, in effect, be allowing a "dump" in an I-1 District. Mr. Rice discussed the screening requirements of the I-1 District, which states that an I-1 "Building site" abutting a Resi- dential Zone District shall provide screening. Mr. Paup stated the definition of "building site" could determine what area would have to be screened. Love moved: Rice seconded: The Planning Commission recommend to the Building Department that permits needed for the proposed trash transfer station be granted Mr. Miller under Section 22.4-13b(2) of the 1963 Comprehensive Zoning Ordinance. Discussion followed. It was suggested that emphasis be placed on Section 2214-13j, Limitations on External Effects of Uses; and Section 22.4-13k, Screening; in the granting of the permits and the subsequent operation of the trash transfer. Upon the call of the role: AYES: NAYS: Love; Rice; Touchton; Woods None The motion carried. IV. MASTER STREET PLAN CASE #2-65L Mrs. Romans introduced Mr. James Braman, Denver Planning Director, who was present to discuss the Denver Transportation Plan. Page 908 Mr. Braman stated the metropolitan area is cooperating on the Denver Metropolitan Area Transportation S t udy; Denver has devised a "traffic corridor" system, and has recommended it be studied further. Some of the proposed traffic corridors will have an affect on the street pattern of Englewood. The Denver Planning Board has adopted a network system of arterial routes, such as Colorado Boulevard and Santa Fe Drive; approval has been given the specific streets in this system. Mr. Braman stated it was unlikely the Planning Board would give final approval to a major freeway designation at this time. It was determined, after con- siderable study, that the Denver Metro Area would be a low density community for some time, thus placing heavy reliance on the automobile for transportation. This has necessitated the consideration of "freeways", which, it is felt, will benefit the area. Mr. Braman stated that Highway 70 is projected as a "limited access freeway" within the next few years by DMATS and the Denver Planning Board. The importance of proper development of Highway 70 to Englewood was discussed. Mr. Braman stated that right-of-way for a freeway is 250 ft. to 300 ft.; much of this could be obtained on Highway 70 at the present time, however, the State Highway Department does not seem interested. Mr. Braman stated that in his opinion, the "ideal" freeway is "depressed"; it was mentioned that the Commission had discussed the depression of Highway 70 with Highway Department representatives, and the plan did not meet with approval. It was suggested by Mr. Braman that any recommendations on the Highway be submitted to DMATS before June, 1966, and that a priority or staging of development be set forth. Mr. Braman briefly discussed the proposed Columbine Freeway; it is proposed to extend along South Zuni Street, angling to the general area of Platte Canyon Road. Mr. Braman stated that Denver has for some time designated Yale Avenue as a major arterial, and it will continue to be so designated. He suggested the possible designation of Quincy Avenue as a major traffic corridor also. Commission members expressed their appreciation for Mr. Braman's presentation. V. FUTURE MEETINGS. The next regular meeting of the Plannirg Commission is April 20. The Chairman and Director will be attending the ASPO Convention. It was determined that the next meeting would be held on April 27, 1966, unless a matter of immediate concern would arise in which event, a meeting could be called for April 13, 1966. Touchton moved: Rice seconded: The meeting be adjourned. The motion carried, and the meeting was declared adjourned at 9:30 P.M. Gertrude G. Welty Recording Secretary * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION April 26, 1966 In lieu of the rescheduled regular meeting of April 27, 1966, members of the Commission and staff attended a special discussion held at the County Welfare Auditorium by the Arapahoe County Planning Office and County Commissioners. The discussion, with Mr. Beier and l\'1r. Linvahl of the State Highway Department, and Mr. Brandt of Inter-County Regional Planning Commission, was on the System 4B of DMATS. Even though a plan for System 4B was presented, there were no volume figures available for this phase of the study. It was thought they would possibly be available for consideration sometime next week. I I I
