CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION February 16, 1966 Special Meeting The Special Meeting of the City Planning and Zoning Commission was called to order at 8:05 P.M. by Chairman Woods. Members present: Carlson, Parkinson, Rice, Woods Romans, Ex-officio Members absent: Love, Touchton Mr. Woods introduced the Commission members to the audience. II. ERNEST CONRAD 3800 S. Inca St. REZONING R-1-C to R-4 CASE #3-66A January 19, 1966 Chairman Woods stated the public hearing on the Conrad rezoning request was scheduled for this meeting. The property was posted on January 31, .1966, and publication -was given in the official City newspaper on the same date. Parkinson moved: Rice seconded: The Public Hearing be opened. The motion carried unanimously. Mr. Arken stated he was attorney for Mr. Conrad, owner o f the Bingo King Company. He stated the Bingo King Company had acquired property on the west side of the 3800 block of South Inca. This property has two foundations, apparently for houses, on it, but has not been further developed. The requested zone change, he felt, would encourage development of the entire area. Mr. Arken stated the Bingo King Company is requesting the zone change to permit a parking lot for their employees. At a future date, an office building will be constructed on a portion of the site for employees of the Bingo King Company. Mr. Touchton entered and was seated with the Commission. Mr. Arken stated he had discussed the requested zone change with some of the area residents; the majority opinion seemed to favor the requested change. Mr. Arken cited the permitted uses in an R-4 zone district. Page 900 Mrs. Stapleton 3910 South Inca -stated she had contacted FHA to see what effect the requested zone change would have on property values. She was informed that FHA would not give a loan value on property adjacent or adjoining an industrial zone district. Mr. Parkinson pointed out that the R-4 zone s not industrial or commercial; it is a residential district with limited professional uses also permitted. Mr. Bennett 4040 S. Inca -stated the use, not the zone, would affect the loan value of an adjacent or adjoining piece of property. He said that in his opinion FHA would still loan, but it would be a lesser amount. Mr. Rice stated that the R-4 Zone has been applied in several areas of the City; in these various locations, it has been the attraction to residents and people interested in developing the districts. Mr. Parkinson stated that the R-4 serves as a buffer between the industrial district to the north and west, and the more densely developed residential area to the south and east. Mrs. Cinkle 3995 South Inca -stated she felt the houses that were in the subject area were nice homes; and she further felt the entire area could be developed into a very nice residential area. She stated she would like to see the area "up-graded" rather than "down-graded", and stated the buffer could be at the alley. Mr. Rice asked the Planning Director to further review the R-4 Zone District classification. Mrs. Romans gave a history of the R-4 Zone; it serves as a buffer between two incompatible or unlike zones. Screening is required whenever a non-residential use abuts, adjoins, or is adjacent to a residential use or a residential zone district. Mr. Bennett stated the property owners on Jason purchased their property unaware that the land immediately to the west was zoned for industrial uses. He stated he felt it was very poor planning to have allowed houses to be constructed in that area. He asked if the R-4 zone would increase traffic in the area, and create problems with the pedestrian traffic in the area? Mrs. Romans pointed out that a minor traffic problem exists at the present time, in part due to inadequate off-street parking for the industrial uses in the area. She stated she felt that the proposed parking lot will aid in the elimination of at least a portion of the problem, in that the Bingo King employees will not be parking on the street; motorists will then per- haps have a better view of the children and will be aware that a child could cross the street suddenly. As it is now, children are entering the street from behind parked cars. Mr. Bennett stated that if the R-4 zone was approved, that a buffer zone should be placed along Mansfield Avenue. Mr. Arken pointed out that the one plot of land on the northeast corner of Mansfield and Inca was willed to the School Board to be used for nothing but educational purposes. This cannot be changed. Also, the R-4 has the screening provision required, which would be applicable on the northwest corner of Mansfield and Inca, should a use other than residential be developed. Mrs. Yurk 3837 South Inca -asked if there was any assurance the area would develop if the zoning was approved? It was pointed out that the only way the City could assure development would be to purchase the property and develop it. Mr. Bennett asked if there was a need for this type of zoning in this area? Mrs. Romans replied that she, as a staff member, felt there was. Mr. Bennett then asked if there was a need for the proposed use? Mrs. Romans again replied she felt there was. Mr. Bennett asked if it was possible to zone the west side of the street R-4 and zone the east side R-2? Mrs. Romans pointed out that the R-2 uses are permitted in the R-4 District; she also pointed out that the Commission and City Council have tried, wherever possible, to break zone districts on an alley line, not in the middle of the street. Mr. Heltman 3897 South Inca -asked if trucks would be parked in the lot? Mrs. Romans stated they could not be "stored" there; the lot would be for employee parking during the work-day. She pointed out that trucks making deliveries to a business, home, or school, may use any street. Routine heavy truck traffic, however, must be confined to truck routes. Mr. Parkinson requested a show of hands for those favoring the zone change request, and those opposing the zone change request. Five persons raised their hands as opposing the request. Four persons raised their hands as favoring the request. Mr. Conrad stated that the Bingo King CoIIJ>any has kept their premises neat; he felt it was a credit to the area, and stated that the proposed development will also be kept in a neat manner. Mr. Heltman agreed that Mr. Conrad had kept his property clean, and commented he wished the entire area would develop in a similar manner. He then stated he was in favor of the rezoning. Mr. Heltman had not particiated in the called vote. Touchton moved: Parkinson seconded: The Public Hearing be closed. The motion carried unanimously. I I I I I I Page 901 Mr. Woods told the citizens present that if the zone request was recommended to the City Council , that the area would again be posted, and Council would hold a Public Hearing on the request, also . Discussion followed. Rice moved : Touchton seconded: The Planning Commission recommend to City Council that the zone change request made by Ernest R. Conrad for a change from R-1-C (Single-family residential) to R-4 (Residential-Professional) be approved for the following reasons: 1. The R-4 Zone District will serve as a buffer between the Industrial District to the north and west and the R-1-C Zone District. 2. The area has not developed under the present zone classification, and at least one- third of the subject area is subject to development at this time . 3. The applicant has stated he is interested in developing his property for an off-street parking lot for the employees of his concern, which is adjacent to the property on the west; this is needed, and will aid in clearing congestion of the streets in this area. 4. The Commission believes this is a good and proper application of R-4 zone classification in this area, and consistent with south zoning practice and conforms with the over-all zoning plan of the City. The motion carried unanimously. III. SOUTH ENGLEWOOD K-Mart Store REZONING R-3-B to B-2 and R-4 CASE #21-65B January 5 , 1966 Mrs. Romans stated that the Planning Commission had voted to initiate rezoning of the K-Mart iroperty south of West Belleview Avenue at Broadway from R-3-B to B-2. This was made necessary by a rezoning by the County Commissioners while the area was under litigation. The proposed structure will be within 80 ft. of the property line. She stated that Mr . Heister, the attorney f or the K-Mart developers, had discussed the zoning with her. She had suggested to Mr . Heister that perhaps the west 50 ft. of the subject property could be zoned R-4 rather than the B-2. This was agreed to by Mr. Heister. Discussion followed . Rice moved: Parkinson seconded: The motion of January 5, 1966, setting the Public Hearing date for the K-Mart rezoning to B-2 from R-3-B be amended ; the rezoning be the west 50 ft. of their property be zoned R-4 from R-3-B, and that the remainder of the property now zoned R-3-B be rezoned B-2. The motion carried unanimously . Rice moved: Carlson seconded: The meeting be adjourned. The motion carried, and the meeting was declared adjourned at 9:45 P.M. Gertrude G.
