Cartwright for the change of zoning from R-2-A to R~4 of the east side of the 3200 block South Bannock be set for September 20, 1967. The property is to be posted, and publication given in the official City newspaper. The motion carried unanimously. V. DR. BRALLIAR STREET VACATION 2800 S. Emerson CASE #18-67B Mrs. Romans stated that notice had been sent to the Police and Fire Departments, Public Works Department and Utilities Department of the City, and the Public Service Company, stating that Dr. Bralliar has requested the vacation of a portion of South Emerson Street in the 2800 block. Not all departments have replied to this date. No action was taken. Love moved: Rice seconded: The meeting be adjourned. The motion carried; the meeting adjourned at 9:40 P.M. Gertrude G. CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION September 6, 1967 The regular meeting of the City Planning and Zoning Commission was called to order by Chairman Carlson. Members present: Woods; Touchton; Rice; Parkinson; Carlson Romans, Ex-officio Members absent: Love Also present: City Attorney Criswell ~ --- II .. APPROVAL OF MINUTES. Chairman Carlson stated the minutes of August 23, 1967, were to be considered for approval. Parkinson moved: Rice seconded: The Minutes of August 23, 1967, be approved as written. The motion carried unanimously. III. OLD BUSINESS. A. New Englewood, Ltd. Case #B9-64 Floyd Avenue Contract Mrs. Romans stated that no additional information had been submitted in regard to the Floyd Avenue Contract or any revision thereof since the June 21, 1967, meeting. She stated that she had attended a meeting earlier in the day with Mr. Brackton of Grimshaw Company, and Mr. Waggoner, Director of Public Works. At this meeting, Mr. Brackton had indicated that con- struction of a portion of Floyd Avenue on the north side of the New Englewood complex had begun. Discussion followed. B. New Englewood, Ltd. Case #12-67B Surf ace Parking Area Mrs. Romans stated that no further information had been submitted on this Parking Plan. C. Dr. Bralliar Street Vacation 2800 S. Emerson Rice moved: Parkinson seconded: The matter be raised from the table. The motion carried unanimously. Case #18-67C Mrs. Romans stated that notification of the requested street vacation had been sent to the various utility companies, and the Departments of the City which would possibly be affected Page 998 by this request. Replies received from Public Service Company, Electric and Gas Divisions; Police Department; Fire Department; and the City Water Department indicated they had no ob- jection to the requested vacation. Mr. Dobratz, Utilities Director, did suggest that a utility easement be retained. Mr. Waggoner, Public Works Director, recommended against the vacation for the following reasons: 1. Under the overall drainage plan layout as proposed by Hoskins and Associates there would be a need for a right-of-way for the installation of a 54 inch diameter pipe along the proposed street vacation. 2. I do not see any benefit to the City should the street be vacated nor do I see any hardship to the owner of the abutting properties should the street remain in its present status. 3. Should the street be vacated there would be a need for further dedication of street width North of the City Ditch crossing and there would also be a need for a cul-de- sac at the end of the traveled way . . The requested vacation was discussed. Mrs. Ro mans stated that one of Dr. Bralliar's questions had been that the former owner of the property had dedicated 12 ft. for street purposes, and he wondered whether or not it would be possible for the vacation to give him the 12 ft. plus one-half of the remaining dedication? Mr. Criswell stated he felt this was something that the two property owners would have to work out between themselves. Ordinarily, a street vacation returns half of the property to each property owner. He did not feel it was a problem for the City to solve. Mr. Carlson pointed out that there was a portion of the Dr. 's property that should be dedicated for street purposes just north of the Ditch to line up with the dedicated line of Emerson as it extends south from Amherst Avenue. The need for a cul-de-sac were the vacation to be approved was discussed. The Commission suggested that Mrs. Romans convey to Dr. Bralliar the need for the additional dedication from his property for the full street dedication, and the area needed for a cul-de-sac. Parkinson moved: Rice seconded: The matter be tabled until further negotiations on street right-of-way and the dedication of a cul-de-sac have been conducted. The motion carried unanimously. IV. NEW BUSINESS. A. Revision of Comprehensive Zoning Ordinance. Mrs. Romans stated that the Comprehensive Zoning Ordinance was in need of revision. She stated that she felt the procedure used in revising the Subdivision Regulations worked very well --a committee of two or three working out the proposed changes before presenting the revised ordinance to the Commission for their discussion. Mr. Criswell stated he might re- quest that the City Council appoint a special assistant on the revision of the zoning ordinance. Discussion followed. Mrs. Romans and Mr. Criswell were asked to proceed with the revision .. V. MEETINGS. Mrs. Romans reminded Commission members of the meeting sponsored by ICRPC to be held at the Cosmopolitan Hotel on September 12 at 6:30 P.M. Members wishing to attend were asked to notify the office for reservations. The meeting of September 20th was discussed. The Planning Commission had met at 5:30 P.M., September 6, 1967, and had viewed all four rezoning request sites, as well as Dr. Bralliar'.s property. Discussion followed.
