DATE: October 4, 1967 SUBJECT : Vacation of portion of 2800 Block of South Emerson St. RECOMMENDATION: The Planning Commission recommend to City Council that the portion of South Emerson Street south of the City Ditch and north of East Bates Avenue be vacated; a 16 ft. utility easement is to be retained through this vacation. DATE: October 4 , 1967 SUBJECT: Highway Needs within the City of Englewood. RECOMMEN DATION: The Planning Commission recommend the following order of priority for City needs to be met by the Colorado Department of Highways: 1. The construction of an interchange at Broadway and Highway 70. 2. The construction of an interchange at Dartmouth Avenue and Santa Fe Drive as an interim measure to accommodate traffic from New Englewood until such time as the Columbine Freeway is constructed. 3. The improvement of . intersections on Highway 70 from Broadway east to the City limit , with emphasis on the intersections of Colorado 70 with South Clarkson Street ; South Lafayette and Hampden Avenue; and the KLZ Site development. 4. The designation of Clarkson as a State Highway from Highway 70 South to Arapahoe Road. By order of the City Planning and Zoning Commission. Gertrude G. CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION October 18, 1967 The regular meeting of the City Planning and Zoning Commission was called to order by Chairman Carlson at 8 ;05 P.M. Members present: Woods; Touchton; Rice; Love; Carlson Romans, Ex-officio Members absent: Parkinson Also present: City Attorney Criswell Planning Aide Joe Magers Page 1008 II. APPROVAL OF MINUTES. Chairman Carlson stated the Minutes of the Dctober 4, 1967, meeting were to be considered for approval. Love moved: Rice seconded: The Minutes of October 4, 1967, be approved as written. The motion carried unanimously. ---- --- --- -- -- - - - --- - ----- III. JOHN B. CARTWRIGHT (3200 block South Bannock-east side) REZONING R-2-A to R-4 CASE #20-67 Rice moved: Touchton seconded: The Public Hearing on Case #20-67 be opened. The motion carried unanimously. Mrs. Romans reviewed the application; Mr. Cartwright made application on August 18, 1967, to rezone a portion of the east side of the 3200 block of South Bannock Street .from R-2-A to R-4. The application does not encompass the entire block, inasmuch as the south 230 feet of the block is zoned B-1 (business). The public notice was given in the Englewood Herald on October 2, 1967, and the property was posted on September 29, 1967. The reason given by the applicant for the request is: "To apply land to the highest and best use by utilizing said land to meet the increased demand within the area for R-4 zoned property. Such demand is necessitated by the absence of R-4 property within the area and the fact that off-street parking is becoming a premium in the area. Such use would economically apply the land to its highest and best advantage and be consistent with the surrounding area ." Mrs. Romans pointed out that uses permitted in the R-4 zone, other than residential, must provide screening when abutting or adjoining a residential use or zone classification ; such uses must also have a minimum frontage of 100 ft. Mr. Carlson asked for proponents of the request to speak. Mr. Moore stated he was attorney for Bannock Street Associates and Mr. John B. Cartwright, a partner of the Associates. The application was filed in the name of John B. Cartwright. Mr . Moore stated he and his clients felt the change of zoning would make the entire block compatibly zoned. They also felt there is a need for the R-4 zone classification in this area. He stated that the Bannock Street Associates are owners of the Continental National Bank, which is scheduled for completion in May of 1968. At that time, additional off-street parking will be needed to accommodate tenants and employees of the bank. He felt that by providing an off-street parking site for these tenants and employees, their automobiles will be off the streets, and will not be a bother to the residents. Mr. Moore submitted folders with pictures of the subject area and a map showing the property that the applicant owns. Mr. Moore stated the parking lot would be screened from the resi- dential areas as required by the Comprehensive Zoning Ordinance, and that the screening will be maintained. Mr. Love asked where the screening of the lot would be? Mr. Moore stated the ordinance re- quired screening beginning 25 ft. back from the front property line and along lines adjoining or adjacent to any residential use or classification. Discussion followed. Mr. Rice asked if there had been that much change in the proposed occupancy of the building since the Planning Commission approved the parking ratio of the Continental National Bank? Mr. Moore stated that there will be some occupants who will generate a greater volume of traffic per square foot of occupied space. Mr. Jim Cartwright stated that it was difficult to determine the amount of .space needed for parking during the preliminary construction of an office building. The tenants which will lease space in the . building are the determining factor, and until the leasing is completed, no accurate estimate can be made. Mr. Touchton asked how many spaces they expected to put on this proposed parking lot? Mr . Moore stated they were planning 60 spaces; there would be bumper guards, and the lot will be patrolled and maintained by the Bank. There were no further proponents wishing to speak; Mr. Carlson asked for opponents who wished to speak. Mr. Wm. Beier 3167 S. Bannock Mr. Watson 3252 S. Bannock - presented a petition protesting the rezoning of the subject area signed by residents and owners of the area. He stated that there were residents in attendance this evening who had not signed the petition, but were opposed to the request. Mr. Beier summarized the petition by stating there is presently extensive off-street parking in the immediate area. There has been no change in the area to warrant a change in zoning; Mr. Beier emphasized that the shopping center development has not changed the area. He stated the opponents did not feel this rezoning request would be good zoning practice if approved. stated he lived next door to the proposed parking lot. He stated that if the applicant proposed to construct the parking lot on the back lot line, the alley would be cut off, as he did not think it was a dedicated alley. To the south the alley dead ends, and does not go through to Floyd Avenue. He stated he wanted the area to remain residential. Mr. Woods asked if the alley was dedicated, and if not, the length of time it has been used as such? Mr. Watson stated he did not think it was a dedicated alley, and it has been in use since he moved there that he knew of, which was in 1948. Mr. Woods asked if Mr. Watson felt people in the block would be willing to dedicate an alley? Mr. Watson stated he did not know; he personally would be willing, but he could not answer for others. I I I I I I Page 1009 Mrs. Romans referred to the Land Use Map; records show that the alley is dedicated to a 16 ft. width from Eastman south to the north line of Mr. Watson's property. Mr. Gill 3251 S. Bannock -stated he had never seen a parking lot in the middle of a block as it would be in this case. He stated he felt it would be a safety factor, with the increased traffic and turning movements into and out of the parking lot. He stated he would like to see the area remain residential. Mr. Carlson asked for those opposed to the rezoning living on the east side of South Bannock Street to raise their hand. Four persons indicated opposition. Mr. Carlson asked for those opposed living on the west side of South Bannock Street. Give persons indicated opposition. Mr. Carlson asked for those living in the general area who were opposed; twelve persons indicated opposition. ' Two persons indicated they were in favor of the rezoning request. Mr. Moore stated he felt there had been a change in the area, and that the bank, upon completion, will further change the area. Mr. Cartwright stated they feel the bank and tenants leasing space therein will up-grade Englewood. Mrs. Romans pointed out that the property adjacent to the subject land on the east and on the south is pointed B-~ (business), and has been for a number of years. The areas to the west and north are zoned for two-family use. Touchton moved: Love seconded: The Public Hearing be closed. The motion carried unanimously. Love moved: Rice seconded: The matter of Case #20-67 be tabled for further consideration. The motion carried unanimously. Discussion followed. Rice moved: Love seconded: The matter of Case #20-67 be raised from the table. The motion carried unanimously. Discussion followed. Mr. Rice stated he realized that there is a problem, but he did not feel it should be solved at the expense of the residents and property owners of the area. He further commented that perhaps the rezoning in this area was premature. Further dis- cussion ensued. Love moved: Rice seconded: The Planning Commission not recommend approval to the City Council of the rezoning application made by John B. Cartwright for rezoning of the portion of the 3200 block South Bannock (east side) that is presently zoned R-2-A to the requested R-4. The Commission does not feel that it is the appropriate time for a change of zone classification in the area; and the location of the proposed parking lot in the center of the block of residential develQpment is felt to be inappropriate also. Further discuss~on followed. Mr. Touchton commented that Mr. Moore had s~ated they were planning on 60 spaces in the parking lot; he stated that he figured they could get roughly 30 to 40 spaces in the proposed lot. Further discussion ens~ed. Mr. Woods asked ~f a decision must be made at this particular time; he stated that there was no indication the applicant needed an immediate decision. Discussion followed. Mr. Love stated he had no objection if the motion were tabled. Mr. Woods moved: Mr. Love seconded: That Case #20-67 be tabled for further consideration. AYES: Woods; Love NAYS: Touchton; Rice; Carlson The motion failed. Mr. Carlson called for the vote on Mr. Love's motion. AYES: NAYS: Touchton; Rice; Love; Carlson Woods The motion carried. A lengthy discussion of Commission policy followed. IV. CONTINENTAL NATIONAL BANK Parking Layout CASE #3-67 Mrs. Romans read a memo from Chief Building Inspector Wallace asking approval of the proposed parking lot layout of the Continental National Bank. She displayed the latest plan submitted by the Bank. Mrs. Romans pointed out that Mr.Von Frellick nas promised the City a 60 ft. street on Girard Avenue, and it was the City's understanding that this would be from South Elati Street to South Bannock Street. The property, however, that was sold to Continental National Bank by Von Frellick Associates does not, on this particular plan, show what would be that portion necessary for a 60 ft. street dedication. Discussion followed. Page 1010 Rice moved: Touchton seconded: The matter of the proposed parking lot be tabled and the Planning Director City Manager, and City Attqrney be asked to proceed by whatever means possible to obtain a 60 ft. dedication for Girard Avenue. AYES: NAYS: Touchton; Rice; Love; Carlson Woods The motion carried. V. NORTHWEST ENGLEWOOD MEETING Mrs. Romans reviewed the meeting held in Northwest Englewood recently to discuss with these residents problems of their area. As a result of this meeting, inquiries have come to the attention of the Planning Department concerning the zoning of the block bounded by South Raritan, South Tejon, West Baltic Place, and West Iliff Avenue. This block was zoned resi- dential but was changed in 1963 when the Comprehsnsive Zoning Ordinance was adopted. Mrs. Romans asked the opinion of the Commission on an "open house" for residents of that block to come into the Planning Department to discuss the zone classification for that block. Discussion followed. Date for the open house was set for November 1, 1967, and the members. of the Commission agreed to be at the open house to meet the residents. Mrs. Romans stated that there was concern on the part of some of the residents in the area on the streets that were not fully dedicated. A Mr. Hollifield has indicated to Mrs. Romans that he would be happy to contact people in the area in regard to dedication of land for street purposes if the City would prepare the necessary papers to be signed. The Director is working with the City Attorney to prepare the deeds. Mr. Hollifield also indicated that some of the people in the area were interested in obtaining Federal aid to improve their homes. VI. MILLERS FOOD STORE Mr. Rice stated that research through City Council records had been done, and the fact that a wall along South Bannock Street on the Miller Food Store parking lot had been agreed to is indeed so. A portion of this wall has been removed. Mrs. Romans stated that she had talked to the Engineering Department about this wall, and it is the recollection of some of the personnel in that Department that the wall was taken out by the City several years ago when construction was underway on Floyd Avenue to permit temporary access to the store off of South Bannock Street. Discussion followed. It was the opinion of the Commission that this matter should be pursued further to determine who should be responsible for the replacement of the wall along South Bannock Street and re- quested City Attorney Criswell to look into the matter . VII. OLD NORTH SCHOOL 3000 S. Bannock ....,. - - -- ·cASE #23-67 Mr. Carlson stated he had been approached by Mr. Kramer of the Englewood School system on zoning of the property at 3000 South Bannock to permit storage of automobiles and employee and customer parking. No application for rezoning has been filed to this date. Mrs. Romans stated the attorney for Schomp Motors has filed for a variance from the Board of Adjustment and Appeals. Discussion followed.
