DISCUSSION_ITEHS.i_HOTIONS AND_RESCLUTIONS • • A. W.A.N.D. Project Design RevieN Originally, it was planned to construct the modular units on the vacant land and sell thea to single families and then begin t he rehab of t he units f or sale and rent. The Execut i ve Director r ecommended to the com~issioners that it would be a o re prudent at this time to begin the rehab work, using housing funds to match Rental Rehab Program funds, to accomplish rehab on some of the WAND units which need rehab done noN. The Executive Director stated that it NOuld be expedient to have the EHDC take title on the properties which would use Rental Rehab Prograa funds for rehab work since this program issues a voucher to qualifying families residing in the units being rehabbed. A conflict of interest situation would exist if the EHA held title on the units receiving rental assistance through the Section B Existing program. He stated that the EHA would get these units back after permanent financing has been secured. It was the recommendation of the Executive Director that the title on 3316 South Pennsylvania be transferred to the EHDC and that matching funds be loaned to the EHDC in order to qualify for rehab NOrk through the Rental Rehab Program. UNIT LOCATED AT 3316 SOUTH PENNSYLVANIA TO THE ENGLEWOOD HOUSING DE'VELOPNENT CORPORATION <EHDC) AND COMMENCE REHAB THROUGH THE RENTAL REHAB PROGRAM AND ULTIMATELY RENT THIS UNIT THROUGH THE SECTION BEX. EHA BOC Regular Meeting 04/27/88 ... The Executive Director reported he has had discussio with Boettcher concerning Certificates of Participati relating to the permanent financing for EHA/ units. Boettcher would work Nith a '"host• bank, to provide the funds for acquisition and rehab. There would be a tNenty-year co .. itaent on the funds at 8.78X, and the progra• has •any costs related to getting the funds. There also has to be c red i t enhanceaent b y the housing authority (the EHA woul d have to put up a certain aaount of funds, sotnellllhere around $100 ,000 for this>. The Executive Director stated this was the EHA's first offer on permanent financing~ and both Boettcher and the Executive Director felt that with changes in the aarket and changes in the bond market a better package aight be available lat e .r . The Executive Director reported that he had spoken with CHFA regarding permanent financing. He feels that CHFA and Boettcher will be more willing to provide pennanent (better> financing if they see a permanent Section B Ex. commi tm.ent . The per1nanent Section B commi taent could pc,ssibly come through the Housing Act in the fortn of •Project-Based Assistanceu. This assistance would provide for 15X of the EHA's housing vouchers and certificates to be placed at a project with:e fifteen-year commitment. Under this Project-Ba Assistance, rather than a tenant taking the certificate o r voucher w i th them when they vacate a unit, the Section 8 Ex . assistance stays with the unit for fifteen y ear s . The E x ecutive Director reported that the EHA did not r eceive the one-year loan for W.A.N •. D. rehab from the State Division of Housing because permanent financing had no t been s ecu r ed. This was despite the letter from Tom Dinkel at F i rst In t e r stat e Bank of Englewood, which stated the EHA had a long histo ry of good credit with First Interstate. t!QI!Q~ IT WAS MOVED BY GARY L. EHA BOC Regular Meeting 04/E7/BB • B. Resolution No. 2, Series of 1988, Authorizing Execution of Documents to Participate in COI-ELP Progra•. The Executive Director reported that the EHA's attorney had examined the COHELP documents and found nothing to prevent the EHA from participating in the COI-ELP Program. IT WAS MOVED BY GARY L. Ayes: Nays: Abstained: Absent: • • Burns, Zieg, Kozacek., Berlin None None Norden The Chairman declared the motion carried . c • D. 1988 CDB6 Application The Executive Di rector ,-eported that the Hearings before the State of Colorado Department of Local Affairs <DOLA) for 1988 CDBG Applications would be held April 28, 1988. The City of Englewood Rehabilitation Department had r equested $453,359 for housing rehabilitation and mobile hoae replacement. The application submitted by the Rehab Department had received overall DOLA staff ratings of "High•. He reported that Ti• Schultz, Executive Director of DOLA, was i n Englewood viewing the prograMs administered by the EHA. The Executive Director stated that Mr. Schultz was very i,npressed with the EHA's projects; so much so that he had expressed an interest in bringing the Governor of Colorado with hi• the next time he was Englewood to view the EHA's projects. Request to Use Section 8 Reserve Funds at Orchard Place The Englewood Housing Authority had r equested that HUD issue an opinion regarding whether a public housing agency may use Section 8 Ex. Housing Program Operating Reserve Funds to develop two additional apartment units in a Low-Rent Public Housing apart111ent project (Orchard Place) . -5 - ::HA BOC Regular Meeting )4/27/88 ..... VII. E. HUD informed the EHA that if the EHA is per•itted t.o develop two units in Orchard Place using Section · Operating Reserve Funds, once those funds are used i . that manner, they will lose their Section 8 Operating Reserve Fund character and cannot be recaptured fro• rents generated by the Project (Orchard Place> even though those rents received fro• those apart•ents NOuld be based on 30X of adjusted incoae in the saae aanner as the Public Housing/Section 8 Prograas. HUD quoted paragraph 2.4<c> of Part II of the Section 8 Ex. Housing Annual Contributions Contract stating:• ••• the PHA must use funds in the Operating Reserve to pay administrative expenses in excess of progratn Receipts. [and] if there remain funds in the Operating Reserve, the PHA may use such funds for other housing purposes cons _istent with state and local law.• HUD stated further that the two units, if developed, NOuld have to be •aintained, operated and in all other respects treated in the same manner as the other units in the Project <Orchard Place>. It was recommended analyze the cost specifications to from contractors to that the Englewood Housing Authority to develop these two units, get develop the units, and request bids do the NOrk. Potential Site Acquisitions The two units considered to be potential acquisitions were discussed. The Executive Director suggested that since the EHA is so involved with the W.A.N.D. Project currently, and since the EHA did not get the State Division of Housing Funds to do the W.A.N.D. rehab work~ that the EHA wait on these potential s i te acquisitions until a later date. The commissioners concurred. FINANCIAL _REPORT The Executive Di rector reported that the auditor did not have a problem with showing the interest earned on the W.A.N.D. collateral CD on the Simon Center Financial Report; and the interest expense on W.A.N.D. loan be shown on the W.A.N zD. Development Cost Statement. Insurance costs were noted. Termination of Services From R. J. Sylvester The Executive Director advised the co-issioners that accounting services front R. J. Sylvester, CPA had been terminated. He stated that the audi tor did r ecom111end that the EHA have an a uditor c o•e i n once a IM>nth to l c,ok over t h e EHA' s books. The EHA wi 11 contact persons who do housing audits and see what the cost would be through the bidding process. B. National Housing Week Procla.•ation: Noted Mith brief discussion. C. D. E . l Insurance Costs FY'BB: Update for the coat11issioners records noted briefly. Mobile Home Par k Ar ticle: Noted with brief discussion. NAHRO Conference f or Commissioners and Administrators. The commissioners agreed that the EHA would pay for N0 1-leen Norden's r egistration fee and for expenses for the two days at the conference applicable to the EHA.
