BlfGLBWOOD HOUSING AUTHORITY Board of Commissioners Regular Meeting October 31, 1990 CALL TO ORDER The Regular Meeting of the Englewood Housing Authority Board of Commissioners was called to order at 6:15 p.m. by Acting Chairman R. J. Berlin. Members Present: Members Absent: Also Present: STUDY SESSION R. J. Berlin, Vice Chairman Roger Koltay, Commissioner Norleen Norden, Commissioner Bradley Zieg, Commissioner Thomas J. Paul Malinowski, Executive Director Ron Schmidt, EHA Accountant Mary A. Ryan, Recording Secretary The E/0, Paul Malinowski, informed all present that the reason that Mr. Netherton, Mr. Kashtanko, and Mr. Stranger were in attendance at this study session was to review the audit for fiscal year 1989. Mr. Netherton stated that during the audit of FY '88, his firm absorbed approximately $3,000 to $4,000 in audit costs. He stated that the audit of FY '89 caused another overrun in audit costs (more than $6,000), but his firm would be absorbing the costs due to the fact that they did not inform the EHA of the cost overrun per their contract with the EHA. Mr. Netherton stated that at the meeting held tonight, he was requesting his firm be released from the contract for auditing FY '90's books. nm1/EHABOCMinutes/Oct3190EHAMinutes EHA BOC Regular Meeting 10/31/90 Discussion ensued regarding questions the EHA had on varying aspects of the audit for FY '89. The E/D stated that Dennis Fodness of HUD will be at the EHA on November 15 to go over questions the EHA has on various entries which are HUD related. Steve Stranger assured all present that the accounting software now being used by the EHA conforms one-hundred percent to the HUD chart of accounts as of January 1, 1990. Commissioner Norden stated that after this discussion with all parties involved she felt that the questions raised were ones that could be worked out and resolved. Commissioner Zieg stated that his bottom line is that he needs to receive assurance from the auditing firm that all questions have been satisfactorily answered. MINUTES Commissioner Zieg pointed out the second motion shown on page 9 which listed Thomas J. Burns as one of the commissioners voting when Chairman Burns was gone from the meeting at that time. The Recording Secretary thanked Commissioner Zieg for his perspicacious observation and assured all present that this motion would be corrected posthaste. V'I. PRE-SCHEDULED VISITORS There were no pre-scheduled visitors at the Regular Meeting of the Englewood Housing Authority Board of Commissioners held October 31, 1990. DIRECTOR'~ REPORT A. Narrative Report Commissioner Norden asked if there was any more information on the fair housing complaint. The E/D said that after a preliminary review, a HUD mediator had asked the EHA to purge the warning letter from the resident's file in exchange for HUD dropping the case. The E/D declined and stated the EHA will await the investigation. Commissioner Koltay questioned the status of the Urban Homesteading Program. The E/D informed Commissioner Koltay and the other commissioners present that the EHA had received a preliminary approval from HUD. He further stated that HUD had some concerns over our legal documents and the assistant city attorney, Daniel Brotzman, was addressing these. He stated we are still some time away from implementing the program. B. Program Reports Occupancy Status Report, Maintenance Status Report, Rehab Status Report noted~ The Rehab Delinquency Report was discussed briefly. The E/D stated that rehab loan No. 8 has been brought current as of October 1, 1990. DISCUSSION ITEMS, MOTIONS AND RESOLUTIONS: A. Ratification of telephone poll regarding 3846 South Cherokee Street. This property was a foreclosed property through the rehab program that was listed with Milt and Miriam Senti a few months ago. The EHA put an additional $15,000 worth of rehab into it through the Rehab Program and put it on the market for $69,900. It was stipulated that the EHA would give a priority to CHFA-eligible buyers through the rehab period; after rehab was complete, any buyer would be eligible as long as the house stayed owner-occupied. -3- EHA BOC Regular Meeting 10/31/90 On October 19, we were presented with an offer of $67,900 from a couple who had sold a business and home in Sedalia and wished to move into Englewood. A telephone poll was conducted that day. The motion and the results of the telephone poll follow: M.QX.1.QN. APPROVE EXECUTING A CONTRACT WITH GEORGE AND CHRISTA EHNES FOR THE SALE OF 3846 SOUTH CHEROKEE STREET IN THE AMOUNT OF $67,900 PLUS SELLER PAYMENT OF TWO LOAN POINTS. Ayes: Nays: Abstained: Absent: Burns, Berlin, Koltay, Norden, Zieg None None None The E/0 recommended the Board ratify the telephone poll in which the EHA agreed to enter into a contract for the sale of 3846 South Cherokee Street with George and Christa Ehnes in the amount of $67,900. He informed the Board that the seller-paid points had been lowered to 1.25% resulting in a substantial savings for the EHA. He added that we will break even on the sale and recoup totally the original rehab loan made to the previous owners. M O T 1. Q N IT WAS MOVED BY COMMISSIONER. Consideration of purchase of three vacant lots on West Hillside. The E/0 stated that he had been approached a number of times over the past two years about purchasing three vacant lots in northwest Englewood owned by one owner. At the time, the EHA was either in the midst of a large project such as the WAND new construction, or the price seemed too high. The E/0 felt that the time was probably right now, and the · price might be, also. -4- EHA BOC Regular Meeting 10/31/90 The E/D said that if the EHA is going to administer the City's proposed new land acquisition and homebuilding program, these properties might be worth looking at for that program. Since the proposed new program won't be funded until 1991, he stated the EHA could look at these parcels to either: (1) hold until the City program is up and running; (2) develop the parcels on our own outside of the framework of the proposed new City program; or (3) just hold the properties for future sale or development. Property analyses were presented and reviewed. The E/D said that the Hillside area of Englewood is an area in which the housing stock appears to be in need of upgrading. He further said that this area tends to be very interesting for development in that there are some vacant lots, some residential sites and a very beautiful greenbelt area running through it. Vice Chairman Berlin felt that acquiring land in this area would help to upgrade the entire neighborhood. Discussion ensued regarding payment of the paving assessment for these properties. Vice Chairman Berlin stated that the E/D should propose to the present owner that one-half of the paving assessment be paid for by the housing authority and the other one-half be paid for by her from the sales proceeds. COMMISSIONER NORDEN SECONDED THE MOTION. Discussion ensued. Commissioner Zieg stated he had a problem with the acquisition of vacant land when there are houses in the City of Englewood which need rehab work, and he felt that land banking was different from developing housing. The impact of the new airport on housing needs was discussed in relation to the development of housing and land banking for future development. Vice Chairman Berlin said that the purchase of vacant land supports the concept of putting houses on vacant properties which ties into the City's proposed new housing program. -5- ---------~ -~-----~----------------------------------- EHA BOC Regular Meeting 10/31/90 Commissioner Zieg felt that rehabbing existing housing stock was more important than purchasing vacant land for future development into houses. He wondered why the present owner of these three sites had come to the EHA to purchase these lots if she could get her asking price from anyone else. Commissioner Koltay stated he felt this was exactly the kind of property the EHA should acquire with the intention of developing new housing stock for homeownership. He said that City Council has heard numerous times that there are more than enough people who are looking for new housing in the price range the EHA has asked in the past. He felt it was a positive step for the Authority to purchase these lots with the idea of developing houses for homeownership. Commissioner Zieg asked that this be sent back to staff for more conclusive information on how much it would cost to develop these sites into houses targeted for homeownership. He stated he wanted to see a market plan in order to determine if there was a demand for houses in this area; how many units in this area were vacant; and what price could be asked for houses in this area. Commissioner Norden wanted the minutes of this meeting to reflect that she agreed with Commissioner Zieg. She felt the EHA was talking about two totally different types of homeownership programs i .e., WAND vs. West Hillside. She wanted to know if the Authority was planning on developing single-family detached homes or duplex units on West Hillside, and if the EHA was thinking about building stick-built homes. Vice Chairman Berlin stated that the Housing Task Force wanted to see Englewood become more family oriented, and the people who came to those meetings wanted to see more single-family detached homes built as opposed to multifamily rentals. Commissioner Koltay asked for a statement from the Sentis on where houses are moving best in the City of Englewood. He wanted to see a market place analysis especially in the West Hillside area, and especially on these three lots. He felt that the Community Development Department should have some type of demographic information which would address the Board's concerns mentioned here. He also felt that having the Authority administer the program and targeting CHFA income guidelines was important. -6 - EHA BOC Regular Meeting 10/31/90 Ayes: Nays: Abstained: Absent: The vote was called for on the foregoing motion. IT WAS MOVED BY COMMISSIONER ZIEG TO SEND ITEM VII.B. -CONSIDERATION OF PURCHASE OF THREE VACANT LOTS ON WEST HILLSIDE --BACX TO ENGLEWOOD HOUSING AUTHORITY STAFF FOR ANALYSIS OF WHAT SHOULD BE BUILT ON THESE THREE VACANT LOTS; HAVE ERA STAFF REVIEW THE PLANNING AND ZONING RECOMMENDATIONS IN THE COMPREHENSIVE PLAN TO DETERMINE HOW THE PURCHASE AND DEVELOPMENT OP THESE LOTS WOULD PIT INTO THAT PLAN; AND HAVE EHA STAPF DETERMINE WHICH TAPS STAY WITH THE PROPERTIES ON WEST HILLSIDE. Action of possible foreclosure for rehab loan No. 192 This loan is 120 days delinquent. This loan is a somewhat unique situation in that one-half of the rehab loan originated from CHFA's Co-Help Loan Program. The EHA contacted CHFA's representative for any requirements they might have on defaults. CHFA can dictate whether or not the EHA would foreclose on this property. The E/0 did not recommend proceeding with the standard foreclosure action. He stated that Janet Grimmett has been in touch with the homeowner who has stated she is trying to bring her first mortgage current and will then bring the rehab loan current. The E/0 suggested that the City Attorney send a demand letter which seems to get a more positive reaction with follow-up action at a subsequent Board meeting for further foreclosure action if the Board so wishes. -7- EHA BOC Regular Meeting 10/31/90 IT WAS MOVED BY COMMISSIONER ZIEG TO REQUEST THAT THE ENGLEWOOD CITY ATTORNEY SEND A LETTER OF DEMAND. Recommendations to Englewood Planning Commission regarding the housing element of the plan. Discussion ensued. Commissioner Zieg vehemently questioned numerous portions of the proposed housing element of the proposed comprehensive plan for the '90s. He questioned to what extent the City of Englewood could dictate and/or enforce several areas proposed by the housing element of the proposed comprehensive plan for the '90s. Commissioner Zieg also requested that EHA staff review the "Recommendations" section, particularly, subsection 3 "Maintain or Establish Suitable Housing for the Elderly" to ensure that it was in conformance with HUD regulations. He further suggested that the wording "low and moderate income families" be used and not just "low income families". COMMISSIONER ZIEG FURTHER MOVED THAT THE EXECUTIVE DIRECTOR PUT IN WRITING THOSE ITEMS WHICH DIRECTLY RELATE TO HOUSING FOR THE PROPOSED HOUSING ELEMENT OF THE PLAN; AND HE FURTHER MOVED THAT THE PLANNING AND ZONING COMMISSION BE REQUESTED TO WRITE OUT THE WORDS "ENGLEWOOD HOUSING AUTHORITY" AND NOT USE THE INITIALS "EBA" IN THE PLAN. COMMISSIONER NORDEN SECONDED THE MOTION. Consideration of change in rehab policy for FY 1990 CDBG funds. Janet Grimmett, Rehab Financial Specialist, had communicated a problem which has occurred in the processing of applications for the rehab program. Because of the priority system in place, households earning less than 50% of median income utilized all of our 1989 CDBG funds. Households over 80% of median income have virtually unlimited access to bank funds. However, households between 50% and 80% of median income have effectively been shut out of the program. Since a new CDBG allocation will be coming in December, the EHA would like to experiment with set-aside allocations by group to open up the program more fairly. The Rehab Financial Specialist had several ways which could possibly solve this situation. She recommended: 1. To disregard any difference between very-low-income and low-income families and process the applications only by the date of receipt of the preapplication; or 2. To set aside a portion of each funding allocation for very-low-income and low-income families, e.g. 50% for very-low-income families and 50% for low-income families. If the allocation for very-low-income families is more than needed, then the balance of the funds could be used for low-income families until the funding is exhausted; or 3. To set up a point system that evaluates the "need" of a preapplication. Applications with the most points would be processed first. Commissioner Norden felt that the EHA is here to serve the very-low-income person and that a 70/30 split was equitable. Commissioner Zieg asked if the persons on the waiting list would be carried over from the '89 CDBG funds to the '90 CDBG funds. He felt the waiting list should be treated separately for the two separate funds. Commissioner Norden felt it would be very unfair to ask persons who have been on the rehab waiting list for two to three years to reapply for rehab funding every time a new fund amount was awarded. -9- ERA BOC Regular Meeting 10/31/90 Commissioner Koltay suggested the ERA ask the City for the amount of money needed to fund the persons on the current waiting list who cannot be helped with the CDBG funds we now have and from that point on purge the waiting list every year. Commissioner Koltay stated if we gave him the request, he would carry it to the City. Setting of date for special meeting on 1991 budget and finances Discussion ensued regarding various proposed dates for the special meeting on the Englewood Housing Authority's 1991 budget and to discuss the finances of the Authority. Further discussion concerned the ·November/December Regular Meeting of the EHA. -12- EHA BOC Regular Meeting 10/31/90 IT WAS MOVED BY COMMISSIONER ZIEG TO SET THE DATE FOR THE ENGLEWOOD HOUSING AUTHORITY FISCAL YEAR 1991 BUDGET AND TO DISCUSS THE FINANCES OF THE EBA FOR NOVEMBER 28, 1990. THE NOVEMBER/DECEMBER REGULAR MEETINGS WOULD BE COMBINED INTO ONE MEETING TO BE HELD ON THURSDAY, DECEMBER 6, 1990. BOTH MEETINGS TO BE HELD AT THE OFFICES OF THE EBA COMMENCING AT 5:45 P.H. (MST). FINANCIAL REPORT The E/D stated that detailed financial information would be presented at the November 28 Budget and Finance Meeting. CONSENT AGENDA Letter from HUD dated September 27, 1990, regarding their civil rights review was noted. The letter stated that the Housing Authority of the City of Englewood was in compliance with Title VI requirements and Title VI regulations with respect to application taking and processing, tenant selection and assignment, amenities/facilities, maintenance and modernization, and other services and treatment. HUD expressed their appreciation of the cooperation and assistance provided by EHA staff during the Review. GENERAL DISCUSSION A. Commissioners' Choice Discussion ensued regarding Mr. c. J. Netherton's request on behalf of his firm, Denton, Netherton, and Company, P.c., that they be released from the contract with the EHA to perform the audit of fiscal year 1990. Commissioner Zieg suggested this item be tabled until Mr. Netherton can check the EHA's chart of accounts and review the improvements that have been made in the accounting function. Commissioner Norden stated that she felt some degree of irritation over Mr. Netherton's "alarmist" statements, and with his behavior which seems to violate accounting ethics. -13- EHA BOC Regular Meeting 10/31/90 The E/D told the EHA Board that he had met with Mr. Netherton on October 30. At that time, Mr. Netherton had stated he wished to be released from the contract to audit the EHA's 1990 books of account because of the expense incurred over and above the contracted amount for the years 1988 and 1989 and which his firm had to absorb through their oversight in not informing the Board. The E/D stated at that time that Mr. Netherton stated no other reasons for their wish to be released from the contract. The E/D stated that he had, at that time, given Mr. Netherton his (the E/D's) list of concerns over the FY '89 audit. The E/D gave the Board a number of concerns he had, including concerns over the client relationship existing between the auditing firm of Denton, Netherton and Company, P.C. and the EHA. He was also concerned with the quality of the audit itself. IT WAS MOVED BY COMMISSIONER KOLTAY TO RELEASE THE AUDITING FIRM OF DENTON, NETHERTON AND COMPANY, P.C. Commissioner Norden asked if the EHA is doing something for the residents of Simon Center, Orchard Place and Malley Center for Christmas. The E/D stated that the staff of the EHA is doing a one act Christmas play for these people. The title of the play is Whatever Happened to Ebenezer Scrooge? He stated that the EHA has also been able to get some turkeys donated. Commissioner Norden asked if there was a way the EHA could help fund gifts or food for this party. The E/D stated that staff is working on getting donations; but if a little extra funding was needed and we could go to the agency for it, that would be great. -14- EHA BOC Regular Meeting 10/31/90 He said that EHA staff, on their own, came up with the idea of donating money to purchase gift certificates from King Soopers. A drawing would be held of the persons who come into the agency for assistance to win the gift certificates for Thanksgiving. Commissioner Norden stated she would also like to donate for this particular item and further stated that Brad Zieg, Roger Koltay, and R. J. Berlin would also like to donate to this worthy cause. Commissioner Zieg stated that it would be unconscionable for the Commissioners to let staff do this all by themselves. HQ~~Q~ IT WAS MOVED BY COMMISSIONER NORDEN THAT THE ENGLEWOOD HOUSING AUTHORITY BE PREPARED TO DONATE TO THE CHRISTMAS PARTY POR THE RESIDENTS OP SIMON CENTER AND ORCHARD PLACE TO BE HELD AT MALLEY CENTER UP TO $100.00 IP SUCH PUNDING IS NEEDED. Commissioner Zieg asked about the goals and objectives for the Englewood Housing Authority for 1990. He felt the agency could come up with new goals which would be more consistent with the direction in which the agency is proceeding. Commissioner Zieg presented for Board perusal his design for a sign to be placed on the EHA office building. After brief contemplation and facetious discussion, the Board thanked Commissioner Zieg for his efforts and agreed to submit the sign to the City for approval. The Executive Director is to fill in the substantial amount of detail left out by Commissioner Zieg. IT WAS MOVED BY COMMISSIONER KOLTAY TO APPROVE THE PROPOSED SIGN DESIGN PRESENTED BY COMMISSIONER ZIEG AND SUBMIT THE DESIGN TO THB CITY OP ENGLEWOOD PLANNING DIVISION OF COMMUNITY DEVELOPMENT POR APPROVAL.
