The regular meeting of the City Planning & Zoning Commission was called to order at 7:00 P. M. by Chairman J. C. Schultz. Members Present: Schultz, Shoop, Draper, Dummer, Glynn Wanush, Ex-officio Members Absent: Daviet, Gerlick, Tobin (all with previous notice) Mr. Covens entered the meeting at 7:05 P. M. II. APPROVAL OF MINUTES May 21, 1991 Chairman Schultz stated that the Minutes of May 21, 1991 were to be considered for approval. He asked if there were any corrections or amendments to the Minutes. Draper moved: Shoop seconded: The Minutes of May 21, 1991 be approved as written. ZONING DESIGNATION Enclave Annexation Areas CASE #3-91 Chairman Schultz stated that this matter is a Public Hearing on zoning desig- nation for the areas recently annexed by the City of Englewood. He asked for a motion to open the Public Hearing. Shoop moved: Draper seconded: The Public Hearing on Case #3-91 be opened. AYES: NAYS: ABSENT: ABSTAIN: Draper, Dummer, Glynn, Schultz, Shoop None Tobin, Covens, Daviet, Gerlick None The motion carried. Mr. Covens entered the meeting and took his seat with the Commission . Mr. Schultz reviewed the procedures to be fo 11 owed in the conduct of the Public Hearing. All persons who wish to address the Commission will come t o -1 - the podium and be sworn in. Mr. Schultz asked that staff make their presentation. Mr. Richard Wanush, Director of Community Development, was sworn in. Mr. Wanush entered into the record the Notice of Public Hearing which was published in the Englewood Sentinel on May 16, 1991, and the Certification of Posting on the 10 signs required to adequately post the properties. Mr. Wanush asked that the Staff Report and maps also be entered into the record of this Hearing. Mr. Wanush stated that in considering the zone designations for the area, staff considered: (1) The existing land use and zoning of the subject property prior to annexation. (2) Consistency of existing land uses with adjacent properties and with the Englewood Comprehensive Plan. (3) Consistency of previous Arapahoe County zoning with the proposed En- glewood zoning . Maps indicating the areas recently annexed and the surrounding Englewood zone classifications, Arapahoe County zoning, and proposed Englewood zone designa- tion were displayed to the Commission and the audience. The properties on West Belleview Avenue (Home Lumber and Arapahoe Rental) are proposed to be zoned B-2, Business. Th ere is B-2 zoning to the south and west of these properties, and the Belleview Park land is zoned residential. Mr. Wanush stated that an agreement regarding the nonconforming status of the Home Lumber Company under the B-2 Zone classification has been signed. Arapahoe Rental will be a permitted use in the B-2 Zone District. The resident i a 1 properties a 1 ong South Mariposa Ori ve are suggested to be zoned R-1-C, Single-family Residence, as is the one property facing on West Tufts Avenue. Properties in the 1500 block of West Tufts Avenue and on South Windermere Street are proposed to be zoned I-1, Light Industrial. Mr. Wanush stated that two residential properties in the 1500 block of West Tufts will be non-conforming under the I-1 District, but the property owners may continue their residential use. Mr. Wanush stated that he would respond to questions regarding the proposed zoning designations. Mr. Schultz asked if Commission members had questions they wished to ask Mr. Wanush. Mr. Covens asked whether the improvement of South Navajo Street would affect the traffic flow and impact the residential uses on West Tufts Avenue. Mr. Wanush discussed the "S" improvements from Windermere over to Navajo, and com- mented that it does not appear there will be any major taking of properties to accomplish this alignment/improvement. Mr. Schultz commented that he was under the impression that the truck route would terminate at Navajo and that large trucks would not be allowed to use Tufts Avenue east of the Tufts/Navajo intersection. Mr. Wanush stated that he was not sure of the truck route in this area. -2 - • • • • • • Mr. Draper asked if there were some properties on South Mariposa Drive which were already i n the City. Mr. Wanush stated that this is correct, and indi- cated those properties on the map. The resident i a 1 deve 1 opment on the east side of South Mariposa Drive is zoned R-1-A, Single-family Residence; and on the west side of South Mariposa Drive the existing and proposed zoning is R-1- C, Single-family Residence. Mr. Wanush pointed out that the R-1-A District is the most restrictive Single-family Residence District in the City; the R-1-C, while also single-family, allows smaller lot and house size. Mr. Schultz asked if there were any proponents who wished to speak on the is- sue. No one indicated a desire to speak. Mr. Schultz asked if there were any opponents to wished to address the Commission. Don Noyes was sworn in, and testified that he owns the property at 4590 South Windermere Street, which property was zoned 1-2, Heavy Industrial in Arapahoe County. Mr. Noyes stated that he wants to retain the heavy industrial zone designation in the City of Englewood; that to downzone his property to 1-1, Light Industrial, will result in a reduction of the potential value of his property when he sells. Mr. Noyes stated that he has discussed the possible change of zone designation on his property with several realtors, who have all agreed that this will result in a reduction of the potential value, but they also refused to cite "figures". Mr. Noyes stated that with the proximity of his property to a railroad spur, the 1-2 Heavy Industrial zone designation will be much more valuable. Mr. Noyes stated that in his opinion, the poten- tial brewery at the former Cedar Lumber site will also increase the value of his property as 1-2, Heavy Industrial. Mr. Noyes discussed the waste that comes from brewing operations, and is of the opinion that his site could potentially be used as a waste collection site. Mr. Noyes stated that he wants to retain the 1-2 Zone designation of his property, and feels the City is taking money out of his pocket by trying to downzone to 1-1, Light Industrial. Mr. Schultz stated that when the Commission considered the issue of allowing a brewery in the 1-1, Light Industrial District, on May 21, the matter of waste generated by such a use was also addressed. The gentleman who proposed the brewery use was present at the May 21 meeting, and satisfied the Commission on his treatment of waste products generated by the brewery. Mr. Wanush emphasized that the matter of the brewery in the 1-1 Zone District is not finalized; City Council will hold a Public Hearing on the proposed amendment of the Zone District regulations on June 17; proponents and oppo- nents to the proposal may attend that meeting to voice their opinions. Mr. Schultz asked if anyone else wished to speak in opposition to the proposed zone designations. No one else indicated a desire to speak. Mr. Schultz asked the Commission if they wished to recall anyone for further testimony or questions. No one was recalled for further testimony. Covens moved: Glynn seconded: The Public Hearing on Case #3-91 be closed . AYES: NAYS: Covens, Draper, Dummer, Glynn, Schultz, Shoop None -3 - ABSENT: Daviet, Gerlick, Tobin ABSTAIN: None The motion carried. Mr. Covens asked if the zone designations for all the parcels were to be acted on as a "package". Mr. Schultz stated that the issue has been presented as a package, but that there could be separate actions if the Commission so desired. Mr. Shoop asked if the property formerly used by the South Drive-In Theater would always be "park" property. Mr. Wanush stated that he cannot give any guarantees on that; the property is currently owned by South Suburban Metropolitan Parks & Recreation District, but they are not actively pursuing a development plan on that portion of their ownership, and are concentrating on the old fairgrounds property south of Belleview. Mr. Wanush stated that SSMPRD is free to sell the theater portion to whomever, and it may be devel- oped for any use in the B-2 Zone District, which is the zone designation for the site. Mr. Draper asked for cl arifi cation on the zoning of the two properties on South Windermere. Mr. Wanush stated that the Arapahoe County zoning designa- tion was I-2, Heavy Industrial; City staff proposes I-1, Light Industrial zoning for both parcels. Covens moved: Glynn seconded: AYES: NAYS: ABSENT: ABSTAIN: Draper, None Davi et, None The Planning Commission recommend to City Council that the properties on West Belleview Avenue (1155 West Belleview Avenue and 1225 West Belleview Avenue) be zoned B-2, Business. Dummer, Glynn, Schultz, Shoop, Covens Gerlick, Tobin The motion carried. Discussion ensued on the remaining parcels in the Tufts/Windermere/Mariposa area. Mr. Covens asked what types of uses could Mr. Noyes use his property for under the I-2 District that are prohibited in I-1. Mr. Wanush pointed out that within the industrial corridor south of U.S. 285, there are no heavy in- dustrial uses; uses that could be permitted in the I-2 District would include such uses as commercial incinerators, manufacture of chemicals, junk and auto- wrecking yards. Mr. Wanush emphasized that this is not to say what Mr. Noyes might sell his property for, but they are some of the heavy industrial uses that are permitted. Mr. Wanush pointed out that there is I-2, Heavy In- dustrial zoning on the former General Iron site and in northwest Englewood. Mr. Wanush also pointed out that when the Commission considered the amendment of the I-1 District regulations to permit a brewery, the consideration was not limited to one site, but to the entire I-1 District. Mr. Wanush further em- • • phasized that there are controls that can be applied to development of any • site for brewery purposes, such as requiring Planned Development approval for any site over one acre in size, and there are controls on emission of dust, noise, smoke, fumes, etc. -4 - • Draper moved: Shoop seconded: The Planning Commission recommend to City Council that the following properties be zoned R-1-C, Single-family Residence: 4685 South Mariposa Drive; 4655 South Mariposa Drive; 1450 West Tufts Avenue; and 1460 West Tufts Avenue. The Planning Commission further recommends to City Council that the following properties be zoned I-1, Light In- dustrial: 4590 South Windermere Street; 4695 South Winder- mere Street; 1510 West Tufts Avenue; 1530 West Tufts Avenue; and 1540 West Tufts Avenue. Mr. Dummer pointed out that the West Tufts Avenue/South Santa Fe Drive inter- section is to be closed, and that if heavy industrial development were to oc- cur in this area it would be very difficult to access the area. Even though Mr. Noyes is concerned about the "reduction in value" of his property if it is zoned I-2, the property is now and can be used for light industrial develop- ment. The I-1 designation will give him "manufacturing" privileges. Mr. Dum- mer also suggested that the I-2 District will allow a higher volume of noise to be emitted by uses. Mr. Wanush stated that I-2 deve 1 opments could have noise levels to 75 decibels at the property line, vs. 70 decibels in the I-1 Zone District. Mr. Glynn asked if Mr. Noyes' use of his property could expand under the I-1 Zone classification. Mr. Wanush answered in the affirmative, and pointed out that the present use of the site is light manufacturing. Glynn, Schultz, Shoop, Covens Davi et Mr. Wanush stated that the recommendations of the Commission will be forwarded to the City Council, which body is also required to hold a Public Hearing. The properties will again be posted and public notice will have to be given in the Englewood Sentinel . Mr. Wanush estimated that the Pub 1 i c Hearing before Council will be sometime in July. IV. FINDINGS OF FACT CASE #4-91 I-1 Zone District Amendment Mr. Schultz stated that the Findings of Fact for Case #4-91 are to be con- sidered for approval. Draper moved: Shoop seconded: The Findings of Fact for Case #4-91 be approved as written. AYES: NAYS: ABSENT: ABSTAIN: Dummer, Glynn, Schultz, Shoop, Covens, Draper None Gerlick, Tobin, Daviet None -5 - The motion carried. v. PUBLIC FORUM No one addressed the Commission under Public Forum. VI. DIRECTOR'S CHOICE. Mr. Wanush distributed a letter from Mayor VanDyke asking for volunteers to spread the word on the Recycling Pilot Program for northeast Englewood. Mr. Wanush suggested that the meeting of June 18 be canceled, and the next meeting of the Commission would be on July 2. For that date, he will try to arrange a meeting with the Parks & Recreation Commission to review the pro- posed section of the Comprehensive Plan. Mr. Wanush stated that the Englewood Urban Renewal Authority is in default on repayment of the bonds as of June 1, 1991. There is a revenue stream, which continues to increase; however, this revenue stream is insufficient to meet the full interest payment due on June 1. Revenues that have been co 11 ected have been wired to the Trustee, who will make the partial payment on June 10. Mr. Covens asked if there is a possibility the bonds would be renegotiated. Mr. Wanush stated that it is doubtful the bonds would be renegotiated. The bonds mature in 2005, and payments will be made through 2007. Mr. Covens asked for an up-date on Project Build. Mr. Wanush stated that two sites have been purchased --a basement house in the 4700 block of South • Huron, and the former Quincy Fi re Station site on East Quincy Avenue. The • fire station has been razed, bid packets have been sent to 10 contractors and are due back June 7. The contractors are asked to design and build a minimum 3 bedroom, 2 bath house; the structures would be priced at the top of the price range for each particular neighborhood. Brief discussion ensued. VI. COMMISSIONER'S CHOICE. Brief discussion ensued regarding Mr. Noyes' property and his allegation of diminished value due to the I-1 Zone designation. Other developments in this immediate area, such as the proposed brewery, were discussed. Mr. Schultz asked if there was anything else members wished to discuss.
