The regular meeting of the City Planning and Zoning Commission was called to order at 8:00 P.M. by Chairman Martin. Members present: Anderson, Brown, Jorgenson, Lentsch, Tanguma, Wade Members absent: Weist, Smith Also present: Director Supinger, Assistant Director Romans, Assistant City Attorney George Lee. II. APPROVAL OF MINUTES. Mr. Martin stated that Minutes o f March 19, 1974, and March 26th are to be considered for approval. Jorgenson moved: Tanguma seconded: The minutes of March 19, 1974 and minutes o f March 26, 1974 be approved as written.· AYES: Jorgenson, Lentsch, Tanguma, Anderson, Brown, Wade NAYS: None ABSENT: Smith , Weist The motion carried. III. ALLEY VACATION /EASEMENT RETENTION Block 78, Sheridan Ht. Subdivision 1700 block between Iliff and Baltic CASE #10-74 Mr. Supinger stated at the request of the Director of the Department of Utilities, City of Englewood that the proposed vacation of the alley and easement is being considered, as follows: The vacation of the alley in Block 78, Sheridan Heights Subdivision, with the retention of an eight (8) foot utility and drainage easement along the north eight (8) of the subject alley. An additional eight (8) foot easement is to be obtained adjoining the retained easement on the north. All of the property owners .o f the block have been notified. The sanitary sewer is owned by the City of Englewood and maintained by the Department of Utilities. The traveled way through Block 78 does not coincide with the location of the 16 foot alley as platted in March of 1888 in the Sheridan Heights Subdivision Plat. The traveled way lies approximately 12 feet north of the platted alley, centerline to centerline. Since the traveled way is seldom used, it is requested by the Department of Utilities that the platted alley be vacated and that an easement be retained across the north eight (8) feet for utilities and drainage. Associated with this request, is the fact that the City sanitary sewer lies along a line approximately four (4) feet north of the platted alley. It is suggested by the Department of Utilities that in order to maintain City access to the sanitary sewer, a 16-foot easement will be necessary. To this end, an easement should be retained across the north eight (8) feet of the alley and an additional eight (8) foot easement should be obtained immediately to the north of the retained easement. Block 78 is part of the area platted as the Sheridan Heights Subdivision in March of 1888. It appears that the traveled way has probably been located to the north of the platted alley for some time. In 1957 the City of Englewood annexed this area and in 1962, the Scenic View Sanitary Sewer District was formed. The engineering for the sewer line was completed in September of 1962 by personnel no longer with the City. Due to a field measurement error, the sewer line was located four feet north of the dedicated alley. Since that time, there has been little new construction in this block; consequently, no previous conflict with the sewer line has arisen. Now, however, the interest in developing this block is increasing and, as in the case of Barton Leasing (owner of Lots 21, 22, 23), who to build a retaining wall on the rear of the property, the location of the sewer line presents a problem. Therefore, in order to avoid any future conflict that may arise it is suggested by the Department of Utilities that steps be taken to protect the sewer line by having it within an easement. George Gorman - Mr. Supinger - Terry Fultz - Tito Garcia - Supinger - Tito Garcia - Supinger - Anderson - Lee - states he owns four lots which he recently had surveyed and the traveled way is on his land. He has no objection but questioned giving 8 ft. more. The alley would be vacated and just an easement of 8 ft. be maintained. The existing alley is from your south property line a distance of 16 ft. south. All of the alley would be vacated --just an easement maintained on the north 8 ft. of the alley. Would like to see the alley and sewer situation straightened out. Thinks the City should condemn the property and pay the property owner some compensation. Could we put a fence up on the property line? We normally permit a fence on an easement. Can the 8 ft. easement be included for real estate? Yes, it can. Most lots have easement for telephone and power poles. ft remains as part of your land. Your use of that 8 ft. would be restricted to some degree, you can't build a building but could use as a parking lot. Would each side get half of the alley? Each side would probably get half of it. I would have to see how the subdivision was written. Gene Sagrillo, City Engineer -stated where the existing sewer line is and stated he felt the City had some adverse possession. The traveled way has been there for at least 30 years. Anderson - Anderson - Anderson moved: Tanguma seconded: The City would be in the position of purchasing an easement and donating land back to owners. It seems seemed to be just compensation for the easement. I would like to see the division of the alley nailed down before the Commission makes a recommendation. To continue Case No. 10-74 -vacation of the alley until April 16, 1974 meeting. DIRECTOR'S CHOICE Supinger stated Packy Romans has requested the Commission to recommend which concept of the Platte Channel would be advisable. Tanguma - Anderson - Lentsch moved: Tanguma seconded: The soft channel would be rocks and natural environment. The hard channel would be a concrete ditch. The Planning Commission recommend approving Plan No. -Platte River Development -which would include soft channel -include all channel in the City wherever fea sible.
