The regular meeting of the City Planning and Zoning Commission was called to order at 8:00 P.M. by Chairman Martin. Members present: Jorgenson; Jones; Wade; Martin; Lentsch; Brown Supinger, Ex-officio Members absent: Tanguma; Smith; Weist Also present: Assistant Director Romans; City Attorney Berardini; Planning Assistant House. II. APPROVAL OF MINUTES. Chairman Martin stated that Minutes of July 9, 1974, July 16, 1974, and July 30, 1974, were to be considered for approval. Jorgenson moved: Wade seconded: The Minutes of July 9, July 16, and July 30, 1974, be approved as written • AYES: Jones; Brown; Wade; Martin; Lentsch; Jorgenson NAYS: None ABSENT: Weist; Tanguma; Smith The motion carried. Mr . Martin then asked Mr. Supinger. to bring the Commission up- to-date on the items to be considered for Public Hearing. Mr. Supinger stated that under the Englewood City Charter and the Comprehensive Zoning Ordinance, the City is given 120 days to place zoning on any property annexed to the City of Englewood. Mr. Supinger noted that this time limitation has long since ex- pired. Mr. Supinger stated that proposed zoning for the area has been considered on several previous occasions; instructions were .given to draft a new I-3 Heavy Industrial Zone District, which was done; then upon a second hearing, dlanges were made in the various zone boundaries from that as advertised, which necessitated a third hearing. Mr. Supinger noted that it was recommended by the · Commission in June, 1974, that the I-3 Zone District be amended to include all uses in the I-2 Zone District as permitted uses in the I-3 Zone District; this is one of the Public Hearings before the Commission this evening. The other Public Hearings are designation of zone classifications for the land in question . • • • -2- Ill. COMPREHENSIVE ZONING ORDINANCE AmendDient of I-3 Zone District CASE #26-74 Mr. Weist entered and took his place with the Commission. Wade moved: Brown seconded: The Public Hearing on Case #26-74 be opened. AYES: Jorgenson; Jones~ Brown; Weist; Wade; Martin; Lentsch NAYS: None ABSENT: Tanguma; Smith The motion carried. Mr. Martin asked that those persons in favor of the proposed amendment to the I-3 District speak. No one spoke in favor. Mr. Martin then asked that those in opposition to the I-3 amendment speak. No one spoke in opposition. Mr. John Gollub, representing land owners in the area, stated that he had just entered the meeting and would like to speak in favor of the amendment at this time. Lentsch moved: Wade seconded: The Public Hearing on Case #26-74 be closed . AYES: Lentsch; Jorgenson; Jones; Brown; Weist; Wade; Martin NAYS: None ABSENT: Tanguma; Smith The motion carried. Lentsch moved: Jorgenson seconded: The Planning Commission recommend to City Council that §22.4-15c(l) be amended to read: "Any use permitted in the I-2, General Industrial District." -- AYES: Martin; Lentsch; Jorgenson; Jones; Brown; Weist; Wade NAYS; None ABSENT: Tanguma; Smith The motion carried. IV. ZONE DESIGNATION R-1-C, Single-Family Lentsch moved: CASE #22-74 Wade seconded: The Public Hearing on Case #22-74 be opened. AYES: Martin; Lentsch; Jorgenson; Jones; Brown; Wade; Weist NAYS: None ABSENT: Smith; Tanguma The motion carried. • • •• I -3- Mr. Martin asked that those persons wishing to speak in favor of the R-1-C Zone designation do so. No one spoke in favor. Mr. Martin asked that those opposed to the R-1-C Zone designa- tion speak. No one spoke in opposition. Discussion ensued. Lentsch moved: Jones seconded: The Planning Commission recommend to City Council that the following described property be designated as R-1-C, Single-family Residence, which zone classification would be compatible with the existing development. Mr. Supinger pointed out that the staff report indicates the City Council had "approved" the proposal as it is being considered this evening; this is incorrect. Council accepted the Commission recommendation, and referred them back to the Commission for further hearings and recommendation. V. ZONE DESIGNATION CASE #23-74 I-1, Light Industrial Brown moved: Lentsch se<X>nded: The Public Hearing on Case #23-74 be opened • AYES: Weist; Wade; Martin; Lentsch; Jorgenson; Jones; Brown NAYS: None ABSENT: Tanguma; Smith The motion carried. • • • Mr. Martin asked that persons in favor of the proposed I-1 District designation speak at this time. -4- Mr. Tom Eitel stated he represented Mr. and Mrs. Mardesen, owners of 1590 West Tufts Avenue. Mr. Eitel recalled that at the previous hearing, the Mardesen property had been designated as R-1-C, and they had opposed such designation. Mr. and Mrs. Mardesen are in favor of the proposed I-1 designation. Mr. Martin asked if there were persons who wished to speak in opposition to the I-1 designation? No one spoke in opposition. Brown moved: Weist seconded: The Public Hearing on Case #23-74 be closed. AYES: Brown; Jones; Jorgenson; Lentsch; Martin; Wade; Weist NAYS: None ABSENT: Tanguma; Smith The motion carried. Discussion followed. Mr. Brown asked what affect zoning of the residential area cm Tufts to I-1 would have? Mr. Berardini stated that the residences could continue; they would be legal non~conforming uses. Mr. Ernest Helfer 1327 West Tufts Avenue -asked what the permitted height in the I-1 Zone District is. Could industries do "night work"? Mr. Supinger discussed Light Industrial, zone the building shall not on which it is located. Lentsch moved: the height limitations of the I-1, district, which states the height of exceed two times the area of the lot Further discussion followed. Wade seconded: The . ZONE DESIGNATION I-2 Zone District Weist moved: CASE #24-74 Lentsch seconded: . The Public Hearing on Case #24-74 be opened. AYES: Jorgenson; Lentsch; Martin; Wade; Weist; Brown; Jones NAYS: None ABSENT: Smith; Tanguma The motion carried. Mr. Martin asked if any one wished to speak in favor of the I-2 Zoning designation. Mrs. Edna Carlton stated that her property is surrounded by proposed I-3 Zoning; she stated that she now wanted I-3 zoning with the I-2 uses included as permitted uses. Mrs. Carlton stated that if her prospective buyer determines he does not want the land, she will have to have a wrecking yard or some- thing similar on her land; this would not be permitted in the I-2 Zone District. Mr. Lentsch noted that the action of the Commission is not to "expand" the wrecking yards, but only to allow those people so engaged in business to make a living. Mr. Carlton asked why she couldn't .have the same zoning she had in the County? Mr. Martin stated that he felt the Commission recommendations to Council will coincide with the former County zoning as closely as possible. Mr. Martin stated that as he recalled at the last hearing on June 18th, Mrs. Carlton asked for I-2 zoning. Mrs. Carlton stated she felt she had indicated she wanted the I-3, provided a pre-stress concrete plant could be a .permitted use in that qistrict. Mr. Weist stated that sometime back the Commission had made the decision to try to accommodate the existing uses, which he feels the Commission has done. ALLEY VACATION • CASE #27-74 Block 9, Logandale Mr. Supinger stated this is a north/south alley between Lipan and South Windermere Streets, extending north from Lehigh Avenue • This is a 16 ft. wide alley bounded on both sides by property owned by Metal Fabricators, Inc., and serves as access to the storage areas for Metal Fabricators, Inc. Mr. Supinger stated that the application for vacation has been made by Metal Fabri- cators, Inc., and the staff feels there is justification for the vacation. Mr. Charles Rhyne stated he was counsel for Metal Fabricators, Inc.; it is the intention of this company to have gates on the north end at approx~mately the lot lines of Lot 30 and Lot 19, as well as the gate· from Lehigh Avenue. Mr. Rhyne stated that the Company has been in Englewood since 1953, and have finally acquired .the entire · block. Mr. Rhyne stated that it is the desire of Metal Fabricators to fence the alley in an effort to prevent children playing in the storage yards. He stated there is a 10" sewer line in the alley, but no other utilities. Brief discussion followed. Lentsch moved: Brown seconded: The Planning Commission recommend to City Council the alley in Block 9, Logandale, be vacated; an easement f or utilities shall be retained. This action is recommended for the following reasons: • • • -12- 1. The owner, Metal Fabricators, Inc., is the sole owner of block 9, Logandale, and public access is not needed or desirable between the principal building and the storage area for the business. 2. An easement would be retained for the existing 10" sewer line and for any future utilities that may be needed to service the property. The owners would not build over the easement lines and would provide gates or moveable fence sections at both ends of the alley for maintenance access. 3. Access for fire protection or other public vehicles would not be needed through the alley since all buildings are easily accessible from the surrounding streets. 4o It is desirable to fence the open storage area for reasons of health and safety. The materials stored in the yard could be an attractive nuisance to children in the area. It is also desi~able for the owners to include the alley within the fenced area as it is necessary to the operation of the business that there be free access between the principal building and the storage area. 5. Mr. Martin stated that he understood Mr. Emmett Curry of the First National Bank planne·d to be here around 9: 00 P.M. to discuss the extension of Hampden Place and the develop- ment of the surrounding bank-owned property. X. DIRECTOR'S CHOICE Mr. Supinger stated that tre R-3 Standards Review Committee has • been formed, and had their third meeting earlier in the day. Mr. James Keller is Chairman; Mr. George Allen is Vice-Chairman. Mr. Supinger stated that new members would be added, and the JEeting times have been changed to evenings. A tour of the apartment developments is being planned. Mr. Jones noted that Council had taken action at the meeting of August 19th to proceed with the vacation of Cherokee Circle. Mr. Jones stated that the property owners agreed to have all the structures removed or demolished before the construction season comes to a halt • • • • -13- Mr. Supinger noted that the staff has made recommendations to Acting City Manager Waggoner regarding new regulations for moving and demolition of buildings. Mr. Supinger stated that the staff has recommended Planning Commission approval be secured for buildings to be moved into and within the City. Time limitations and bond requirements are also being recommended XI. COMMISSION'S CHOICE Mr. Lentsch discussed the apartment fire at 3690 South Pennsylvania, and asked if there is some way fire alarm systems could be re- quired on buildings over three stories in height? Mr. Berardini stated that it can be required on new construction. Mr. Lentsch noted that electrical wiring, etc. must be brought up to code on existing structures; why could not this be required as a safety factor also? Mr. Berardini noted that such inspections and code compliance are usually on buildings that have deteriorated badly. . Mr. Supinger stated that he has been informed smoke detectors will be required in the new Fire Code. Mr. Martin noted that •some time ago, the matter of a "building review committee" was mentioned. He asked if this could be looked into. Mr. Lentsch stated that he felt it should be dis- cussed; he also noted that at the last two ASPO Conventions he attended, the matter of architectural review, design review, or building review committee was discussed, and the idea seemed to be "frowned" on. Mr. Martin noted that he had traveled around the State of Colorado recently, and structures such as those on the Larwin Site are all over the State; he noted they were equally unattractive in other locations. Mr. Supinger stated he would like to present a recommended Ordinance to the Commission and show some slides of what can be done under such an ordinance. Mr. Jones noted that the matter of architectural review had come up in discussions on the R-3 Standards Review Committee, and it was noted it was controversial because it comes down to a choice of architecture. He urged that if this process is approved, that it be done a "step at a time"; he noted that the slower implementation and educational process might avoid some adverse reaction. Mr. Berardini noted that the idea of architectural review is not new; many cities and states use it very successfully. Mrs. Wade noted that even discussing such an idea might well make members of the Commission more aware of what to look for hen considering new developments. Progress on the Floyd Park was discussed • Mr. Supinger stated that he felt there would be arequest for an Occupancy Permit on Phase I of the Larwin project very shortly. • •• • -14- Mr. Lentsch asked how much open space there is in Phase I -- in each phase, and the total development? Mr. Supinger noted that many of the individual phases do not meet the minimum standards; however, the total project does. Mr. Lentsch noted that no retaining walls here shown on the plans; they should have been shown. Mr . Brown asked if another look shouldn't be taken at the Comprehensive Plan for the City. Mr. Martin agreed that this should be considered. Mr. Lentsch asked what type of Ordinance or Building Code could be drafted to require construction of apartment units with more than four dwelling units to have a brick exterior. Mr. Supinger stated th~s would require a change in the Building Code. Discussion followed. Mr. Martin noted that Mr. Curry was now in attendance, and discussion on the extension of West Hampden Place would begin. Mr. Curry noted that the matter of West Hampden Place had begun several years ago; when the Bank acquired the property to the north of present West Hampden Place in 1970, an agreement was workec out with the City whereby the bank re- linquished title to 11 ft. of land on the north side of West Hampden Place. He stated that the extension of Hampden Place through to South Bannock was planned to tie in with Hampden Avenue. Mr. Curry noted that the Bank has now acquired the property abutting Cherokee Circle; he felt the Bank and the City should work together to improve the traffic flow in the immediate area. Mr. Jones noted that the Voorhees Report had advocated the extension of Hampden Place in an effort to improve the traffic circulation. Mr. Jones stated that the City Council has re- ferred the matter of traffic circulation to the City Planning and Zoning Commission for study. Mr. Jones asked if the ex- tension of Hampden Place would be in conformance with any plans for development the Bank might have. Mr. Curry stated there are no particular plans for development of these properties on Cherokee Circle. Discussion followed. Mr. Supinger pointed out that the Voorhees Report has never been adopted. Mr. Supinger stated that he felt the Bank and City should certainly work together, inasmuch as a traffic pattern that could affect the Bank's long range interests is being discussed. Discussion on a work session ensued. Mr. Lentsch noted that there is a lot of background information regarding the traffic patterns that should be considered. DATE: August 20, 1974 SUBJECT: Vacation of Alley -Block 9, Logandale RECOMMENDATION: Lentsch moved: Brown seconded: The Planning Commission recommend to City Council the alley in Block 9, Logandale, be vacated; an easement for utilities shall be retained. This action is recommended for the following reasons: 1. The owner, Metal Fabricators, Inc., is th€ sole owner of Block 9, Logandale, and public access is not needed or desirable between the principal building and the storage area for the business. 2. An easement would be retained for the existing 10" sewer line and for any future utilities that may be needed to service the property. The owners would not build over the easement lines and would provide gates or moveable fence sections at both ends of the alley for maintenance access • 3. Access for fire protection or other public vehicles would not be needed through the alley since all buildings are easily accessible from the surrounding streets. 4. It is desirable to fence the open storage area for reasons of health and safety. The materials stored in the yard could be an attractive nuisance to children in the area. It is also desirable for the owners to include the alley within the fenced area as it is necessary to the operation of the business that there be free access between the principal building and the storage area. 5.
