The regular meeting of the City Planning and Zoning Commission was called to order by Chairman Hanson at 7:00 p.m. Members present: Also present: Members absent: Barbre, Schultz, Carson, Draper, Volkema, Such, and Hanson. Romans, Ex-officio. Mr. Fish arrived late to the meeting. Susan Hirsch, Senior Planner. None. II. APPROVAL OF MINUTES. March 22, 1988. Mr. Hanson stated that the Minutes of March 22, 1988 were to be considered for approval. Carson moved: Schultz seconded: The Minutes of March 22, 1988 be approved as written. AYES: NAYS: ABSENT: ABSTAIN: Barbre, Schultz, Carson, Draper, Such, Volkema and Hanson. None. Fish. None. The motion carried. III. PUBLIC HEARING CASE #3-88. CONDITIONAL USE FOR A DAY CARE CENTER AT 2315 SOUTH TEJON STREET Carson moved: Barbre seconded: That the Conditional Use hearing for 2315 South Tejon Street be opened. AYES: NAYS: ABSENT: ABSTAIN: Barbre, Schultz, Carson, Draper, Such, Volkema and Hanson. None. Fish. None. The motion carried. Mrs. Romans said that there is a need for child care in the residential area in northwest Englewood, the area between Evans and Vassar, Tejon and Zuni. The ordinance provides for child care for up to twelve children as a Condi- tional Use. The applicants had been working with the staff. If the Condi - tional Use is granted, the applicants will apply to the Board of Adjustment for permission to care for 15 children, which the State would permit them to -1 - do, given the size of their facility. Mrs. Romans said that when the Engle- wood Ordinance was written, it was not realized that the State permitted up to 15 children in this type of day care center; and she said that, in her opinion, our Ordinance should not conflict with State law in this case. Theresa Chavez 2003 West Caspian Way was sworn in for testimony. She said she has been a resident of Englewood for 34 years and owns the property at 2315 South Tejon Street. She is also an owner/builder of duplexes on Caspian; her children went to Scenic View. She has experience in early childhood supervision and taught the summer youth program for twelve years. She wants to provide a healthy, caring environment for children. She said that a large majority of women work, and their children need to be in good day care. They plan to make use of the recre- ation center programs, baseball and community resources, and to be part of the community. Mr. Fish entered the meeting. Mr. Hanson asked if she had read the staff report and would agree to the sug- gested conditions. Mrs. Chavez said she was aware of the conditions and would meet them. She said that the Building Division said there is adequate space for 15 children with three staff members. The children would be between 2 1/2 years old and 12. Bishop elementary will provide bus transportation to and from a bus stop in front of the facility for the school-age children. They will participate in Head Start in the Fall. , • Ms. Hirsch submitted Exhibit I, a plot plan of the proposed child care • facility. The Chairman asked if there were any other speakers in favor of the proposal. Eleanor Lucero 1593 South King was sworn in for testimony. She said she is Mrs. Chavez's partner. She ran a similar licensed business from her home from 1982 to 1986. She said child care in Englewood is in great demand. The neighbors agree there is a shortage. She said she hopes that, since the State allows fifteen children, the Board will permit them to have fifteen because that will make a difference in the service which they can provide. Andrew Gonzales 9419 West Nichols Drive was sworn in for testimony. He said he had installed a fire alarm system for the proposed child care center. He said that the appli- cants are trying to supply good quality day care which will benefit the community. The facility is spacious and would be good for the community. Ms. Hirsch entered Exhibit II into the record, a petition signed by neighbors, which states there is a need for child care in the area, and asking that the request be granted. -2 - • • • • There were no persons present who wished to speak in opposition to the request . Carson moved: Barbre seconded: That the Public Hearing for Case #3-88 be closed. AYES: NAYS: Barbre, Fish, Schultz, Carson, Draper, Such, Volkema and Hanson. None. ABSENT: None. ABSTAIN: None. The motion carried. Carson moved: Draper seconded: That a Conditional Use for a child care facility for twelve children be granted in Case #3-88 for a facility to be located at 2315 South Tejon Street. AYES: NAYS: Fish, Barbre, Schultz, Carson, Draper, Such, Volkema and Hanson. None. ABSENT: None. ABSTAIN: None. The motion carried. The Chairman ruled the Conditional Use was granted. IV. PUBLIC FORUM . There was no public present. V. DIRECTOR'S CHOICE. Mrs. Romans said there had been a court ruling on March 18, 1988, in the City's case about property at 1109 West Quincy Avenue. The judge gave the owner 30 days to clear the property, or the City could clear it and put a lien on the property for that expense. She said that she had talked to Kells Waggoner about a left turn signal for south bound traffic turning east at Floyd and Broadway, and he said they only put such signals "on warrant", and there has not been sufficient warrant to install such signals. They will, however, watch that intersection in the fu- ture. Mr. Draper said he appreciated her efforts, but he is still of the opinion that the intersections at Floyd and at Hampden are dangerous without left turn signals. Mrs. Romans said that she had talked to Leon Kuhn, Di rector of Parks and Recreation, about attending a study session to discuss the Parks section of the Comprehensive Plan, and this will be arranged. She said that the Court had ruled against the City in the case brought by the car dealers, but it was on a procedural question of the number of days of public notice. The City may appeal the ruling. In the meantime, City Council will study the B-2 section of the Ordinance regarding car sales lot. There -3 - will be a committee composed of representatives from City Council (Mr. Clay- ton), the Greater Englewood Chamber of Commerce (Mr. Marx), Mr. Bahne of Val- ley Motors, Mr. Greg Thompson, and a representative of the Planning Commission. The Commission voted that Mr. Hanson and Mr. Carson represent the Planning Commission on this committee. Mrs. Romans said she would contact the rep- resentatives as to when a meeting can be arranged. VI. DIRECTOR'S CHOICE. Mr. Fish asked about a report on the Downtown Development Authority and Urban Renewal Authority. Mrs. Romans said that Nancy Reid will write an opinion, as requested by the Commission on March 22nd, and will submit it to the Commission. Mr. Schultz asked for copies of the old Minutes from the time he joined the Commission. The meeting adjourned at 7:25 p.m. -4 - , • • •
