The regular meeting of the City Planning and Zoning Commission was called to order by Chairman Hanson at 7:00 p.m. The meeting was held in the Miller Building at 3600 South Elati Street. Members present: Barbre, Fish, Schultz, Carson, Draper, Volkema, Such, and Hanson. Romans, Ex-officio. Members absent: None. II. APPROVAL OF MINUTES. April 19, 1988. Mr. Hanson stated that the Minutes of April 19, 1988 were to be considered for approval. Hanson moved: Carson seconded: The Minutes of April 19, 1988 be amended in the last paragraph of page 6 to read: "Mr. Hanson expressed the opinion that these plans MAY not comply with the mini- mum ZONING standards for landscaping ... " AYES: NAYS: Barbre, Schultz, Carson, Draper, Such, Volkema, Fish and Hanson. None. ABSTAIN: None. The motion carried. Barbre moved: Schultz seconded: The Minutes of April 19, 1988, as amended, be approved. AYES: NAYS: Barbre, Schultz, Carson, Draper, Such, Volkema, Fish and Hanson. None. ABSTAIN: None. The motion carried. III. FINDINGS OF FACT. CASE #3-88 CONDITIONAL USE FOR 2315 SOUTH TEJON STREET The Chairman stated the Findings of Fact in Case #3-88 should be considered for approval. IV. DIRECTOR'S CHOICE. As a point of information, Mrs. Romans said that City Manager Mccown has an- nounced that he would be resigning at the end of the week. In regard to the zoning enforcement at 1109 West Quincy Avenue , which issue had been rais ed by .a member of the Commission at a previous meeting, she said that a full crew and a half had been working for two days to clear the proper- ty. This is a case that has gone on for approximately ten years, f i na 11 y resulting in a Court Order that the owner clear the property. When he did not, the City was empowered to clear it and the charges are to be paid by the mortgage company. The neighbors have been very supportive of the effort by the City to correct this situation. Mrs. Romans said that a meeting with City Council had been arranged for 7:00 p.m. on May 24 in the Library Conference Room I (the George Perrin Room). The Commission decided to cancel the regularly scheduled meeting of May 17th, be- cause several members would not be able to attend. Mrs. Romans said that the City Council had held a public hearing on the Land- scape Ordinance on May 2, 1988 and had requested that the Planning Commission consider several additional changes to the Ordinance. Mrs. Romans distributed copies of the proposed amendments as they were referred to the Council by the Commission after its public hearing on February 17, and she also distributed copies of the changes suggested by members of the City Council following its public hearing on May 2nd. These changes included an addition to Section 16- 4-18 B 2 which provides for the procedure the property owner may follow when it is not physically possible or feasible to provide for landscaping on the site . This addition , which would come after Section a, which allows for a deposit to the Beautification Account in the Public Improvement Fund, would state, "b. Improye the appearance of the street side exterior of the build- ing located on the land in an amount not less than the sum equal to $1 x 10% of the total area as measured in square feet . The Director may require docu- ments to substantiate the sum paid for improvement." Councilman Clayton had also suggested that in Section 16-4-18-C 1 c, (1), (2) and (3) Minimum Requirements, be deleted. Councilman Kozacek had suggested that Subsection (4) be changed so that the minimum size of rocks and stone be reduced from 3/4 inch to 1/2 inch, and that only two inches of depth be re- quired for beds of stone or rock. It was further proposed that the the fol- lowing statement be added to the section, 11 (5) A weed barrier cloth material intended and designed to stop weed growth, sha 11 be used as an underlay for beds of rock, bark or wood chips." Councilman Clayton had also proposed the elimination of the requirement that street trees be of a deciduous type, (Section 16-4-18 1 f). Mrs. Romans said that it was Councilman Clayton's position that deciduous trees are more expen- sive initially and require more upkeep, and that, in any case the owners should be able to decide the type of trees they want to install . As a result of the amendments proposed by Council man Clayton and Councilman Kozacek, Council voted to table action on the proposed amendments until the -2 - , • • • meeting on May 16th, in order to give the Planning Commission members an op- portunity to consider the suggestions of members of the City Council for modification of the amendments proposed by the Planning Commission. Mr. Hanson said that, in his opinion, allowing the property owner to spend landscaping money on the improvement of his building would not benefit the City. He said that he would be opposed to the use of evergreen trees as street trees because t hey shade snow and ice in the winter, and are a traffic hazard because of the growth at the lowe r levels. Most businesse s would prefer deciduous trees, because conifers would hide their signs and display areas. He sa i d tha t trees wi th t wo inch trunks can bet ter withstand va ndals, and that the two i nc h standard is in the requirements of other cities. He said that a two inch barrier cover is not enough to hold the barrier down, and a depth of four inches would not requ i re a barrie r and is probably cheaper. Mr. Fish said that at Home Club there was only a ten dollar difference between one-inch caliper trees which are selling for $10.99 and two-inch trees which are selling for $19.99. Mr. Hanson suggested that the matter could be discussed with Council at the May 24th meeting . The Cammi ss ion members r eviewed the extensive study that has gone into the amendments to the Landscape Ordinance and noted that Council has the authority to make any changes to the Landscape-Ordinance that it wishes. The Commission members said that they have r esearched the amendments which they referred to the City Council very carefully and are of the opinion that the Ordinance should be approved as i t was recommended to the City Council following the public hearing on February 17 , 1988. Volkema moved : Carson seconded: That the Landscape Ordinance, as recommended to the City Council on February 17, 1988 and as printed in Council Bill No . 16, be returned to Council with a recommendation that no further changes be made. AYES: NAYS: Barbre, Schultz, Carson, Draper, Such, Volkema, Fish and Hanson. None. ABSTAIN: None. v. ADJOURNMENT. The formal business meeting was adjourned at 7:35 p.m., and the Commission preceded to a presentation by Traffic Engineer Joe Plizga . -3 -
