The regular meeting of the City Planning and Zoning Commission was called to order at 7:00 p.m. by Chairman Tanguma. Members present: Williams, Jones, Jorgenson, Parker, D. Smith, E. Smith, Tanguma, Wade Romans, Ex-officio Members absent: Pierson Also present: Associate Planner House II. APPROVAL OF MINUTES. Chairman Tanguma stated that Minutes of April 6, 1976, and April 13, 1976, were to be considered for approval. Williams moved: E. Smith seconded: The Minutes of April 6, 1976, and April 13, 1976, be approved as written. AYES: Wade, Williams, Jones, Jorgenson, D. Smith, E. Smith, Tanguma NAYS: None ABSTAIN: Parker ABSENT: Pierson The motion carried. III. GENERAL IRON WORKS Vacation of S. Elati in 2700 Block south; Vacation of West Yale 450-500 Block west. Jones moved: CASE #9-76A March 16, 1976 D. Smith seconded: The matter of Case #9-76 be raised from the Table and brought before the Planning Commission for consideration. AYES: Tanguma, Wade, Williams, Jones, Jorgenson, Parker, D. Smith, E. Smith NAYS: None ABSENT: Pierson The motion carried. Mr. Tanguma stated that the members of the Planning Commission and staff had met at the site before the meeting, and asked if the staff had anything they wished to add for discussion? Mrs. -2- Romans stated that the staff had nothing further to add. Mr. Tanguma then asked Mr. Stephens, President of General Iron, and Mr. Reiger, Counsel for Stearns-Roger, if they wished to add any comments? ·Mr. Stephens stated that he felt there was nothing further he wished to add, but would answer specific questions that members might have. Mr. Don Smith noted that a great deal of the discussion had centered on a drainage problem that would occur with the vacation of the street. He stated that he recalled Mr. Stephens mentioned something about installing a culvert to carry the drainage and asked for clarification. Mr. Stephens stated that it is their intention that the drainage, as it flows to- day, will be maintained, and the flow will not be redirected. Water flowing onto their property would be handled through the drainage ditch, and, Mr. Stephens emphasized, they will keep the flow the same as it is now. Mrs. Wade noted there is a considerable drop in elevation of the street with the General Iron property to the west; she asked if they planned to level this off? Mr. Stephens stated that some fill might be added, but they planned to leave the grade pretty much as it is now. Mrs. Wade asked if th~ culvert would be needed if they did add fill? Mr. Stephens stated that the culvert would be needed; where they plan truck access, the grade will have to be raised, and the culvert would allow the drainage to flow. The culvert could only be under that portion of the property that was raised. Mrs. Wade asked who would maintain the drainage system through the site? Mr. Stephens stated that it will be maintained by General Iron. Mr. Don Smith asked if Mr. Stephens was aware that should the street vacation be recommended, there would probably be a re- quest for dedication of land abutting the west line of the Delaware/Elati alley for street purposes? Mr. Stephens stated that this is not what they requested, but he is aware that it has been discussed as an alternative. Mrs. Wade asked how many General Iron employees presently parked along South Elati Street in1he 2700 block? Mr. Stephens stated there were none; there is off-street parking in the block right to the south. Mr. Ed Smith asked if it was because the employees had sufficient parking provided for them, or if it was the con- dition of the street that kept them from parking in the 2700 block on Elati? Mr. Stephens stated there is sufficient parking provided to the south and west of the general plant; however, employees ·do prefer to park as close to the front gate as possible, and some do park on the streets for this reason. Smith seconded: The Planning Commission recommend to City Council that the 2700 block of South Elati Street be vacated, subject to the retention of a utility ease- ment in the street to facilitate the maintenance of existing utilities; the recommendation to vac ate the right-of-way is based on the condition that sufficient land adjoining the west side of the Dalaware/Elati alley in the 2700 block be dedicated to prov ide a street which is to be designated as a truck route. The idth of such dedication shall be det ermined by the Public Works Department, the Planning Staff, and representa tives of Ge1eral Iron. Mr. Ste phens asked if the dedication for street purposes would be the alley plus whatever is determined is needed for a street? Mr. Jones stated that it would be his intention that the alley width would serve as part of the street right-of-wa y. Mrs. Wade questioned whether an opaque fence would be installed as a barrier between the industrial use and the residential devel opment? Mr. Don Smith stated that Lhis is required as a part of the Comprehensive Zoning Ordinance, and would have to be installed. Discussion ensued regarding the vacation of Yale Avenue, and what steps Denver might take on this matter. Mrs. Romans poin~ed out that Denver has already vacated the north one-half of Yale Avenue west of South Elati Street, and have permitted construction to go right to their City Bo undary line west of South Santa Fe Drive. Further discussion ensued. Mr. Jones suggested that Mrs. Romans discuss the matter with a representative of the InnPer Planning Office prior to sending the recommendation to the City Council . -4- The vote was called: AYES: D. Mrs. Romans noted for the information of Mr. Stephens and Mr. Reiter that the recommendations would be received by the City Council at their meeting of May 3rd. Mr. Stephens stated he wished to thank the members of the Com- mission for their consideration and efforts; he stated that he appreciated their help. Mr. Jones asked Mrs. Romans to advise Public Works Director Waggoner of the Commission's action, and that she ask Mr. Waggoner to work with General Iron representatives on this matter. Mrs. Romans indicated she would do so. IV. FINDINGS OF FACT a. Plaza de Medico Case #11-76 Mrs. Romans stated that it was suggested at the City Council meeting of April 19, 1976, that a statement be included in the Findings of Fact on Plaza de Medico Planned Development to the effect that storm water runoff would be limited to the historic flow; this would require the applicant to maintain any runoff in excess of that now leaving the property. Mrs. Romans noted that the Public Works Department had approved the drainage plan as shown on the plans submitted by the applicant. Mr. Don Smith stated that this had been discussed at the City Council meeting, and that Councilman Sovern had suggested the wording of "historic flow", rather than spelling out specifics such as retaining ponds, etc. Mr. Jones stated that the City Ditch was an interceptor of the flood water for a long time; now that the Ditch will be covered, he stated he questioned the intent of the applicant and asked if there will be a solid curb along the south side of the property, or would water be allowed to flow across the Spa property? Mr. Don Smith stated he recalled that the applicant indicated he would slope the parking lot so the water would not drain onto the Spa property. Mr. Smith stated that the addition of • the "historic flow" provision would insure that no more water could run off the site than now runs off the site, and that the flow would run in the correct direction. t -5- Mrs. Romans suggested that the Commission might approve an addition to the effect that the storm drainage design shall meet the requirements of the Department of Public Works. Don Smith moved: Wade seconded: The Planning Commission approve the Findings of Fact, as amended, on Case #11-76. AYES: Don Smith, Ed Smith, Tanguma, Wade, Williams, Jones, Jorgenson, Parker NAYS: None ABSENT: Pierson The motion carried. b. Mardesen Annexation Lot 6, Bel Isle Gardens Arapahoe County, Colo. Brief discussion on the Findings of Fact ensued. Williams moved: Case #12-76 Jones seconded: The Findings of Fact on Case #12-76, the Mardesen Annexation request, be approved and adopted as written. AYES: Parker, Don Smith, Ed Smith, Tanguma, Wade, Williams, Jones, Jorgenson NAYS: None ABSENT: Pierson The motion carried. v. MISCELLANEOUS ANNEXATIONS Street Rights-of-way CASE #15-76 Mrs. Romans noted there are two locations within the City of Englewood where street rights-of-way were not included in the annexation action by the City. One is on the north side of U.S. 285 extending from University Boulevard to Lafayette Street; the other area is on the south side of East Amherst Avenue be- tween South Downing Street and South Franklin Street. Both areas have presented policing problems, particularly the area on U.S. 285. Neither Cherry Hills Village nor Englewood have jurisdiction over this right-of-way, and Police Chief Holmes has urged that this strip of right-of-way be annexed to solve the policing problem. The right-of-way along East Amherst Avenue was created when the Denver annexation extended to the centerline of the street, and the Englewood annexation extended only to the south line of the street, leaving the south one-half of the right-of-way in neither City's jurisdiction. Mrs. Romans stated that she had met with City Attorney Berardini on this matter , and there is some confusion on the matter because the annexation act does not specifically cover the annexation of right-of-way . Further investigation will have to be done to -6- determine who would sign the annexation petition. Discussion followed. ~ Don Smith moved: Jones seconded: The Planning Commission request the City Attorney and Planning Staff to draw the necessary documents for the annexation of the north side of U.S. 285 from University Boulevard to South Lafayette Street, and the south one-half of East Amherst Avenue from South Downing Street to South Franklin Street; this is to be presented to the Planning and Zoning Commission for further recommendation. AYES: Jorgenson, Parker, D. Smith, E. Smith, Tanguma, Wade, Williams, Jones NAYS: None ABSENT: Pierson The motion carried. VI. DIRECTOR'S CHOICE Mrs. Romans noted that in recent review of the Handbook, the quarterly rezoning hearings were considered and felt to be of merit. There has been a rezoning application filed, and the applicant would like to have the rezoning hearing held before June 22nd, the date of the Quarterly Hearings. Mrs. Romans discussed the area involved in the application, and previous approval of a Subd~vision Waiver for this applicant. Brief discussion ensued. It was the concensus of the Commission that the Commission will follow the procedures and guidelines set forth in the Handbook, and that the rezoning hearings will be held on a Quarterly basis, the next Hearings to be held on June 22nd. VII. COMMISSION'S CHOICE Mr. Tanguma asked what was on the next meeting agenda? Mrs. Romans stated there would be a zoning hearing on the recently approved annexation request of Mr. and Mrs. Mardesen. Mr. Williams inquired about the vacant house on Mr. Garrett's property. Mrs. Romans stated that there was discussion with Mr. Garrett on the three houses which he had stored on the property, and that the City asked him to board up the windows of these structures. Since that time, Mr. Garrett has removed two of the three houses, and he plans to move the last one as soon as possible. Mr. Tanguma asked what was being constructed on the parcel of land proposed for the Hilton Hotel? Mrs. Romans stated that a Burger King is being constructed. Mr. House stated that he understood there was to be a shoppette constructed on the site also, but no permits have issued. -7- Mr. Don Smith asked if there was anything Planning and Zoning Commission members would like the City Council to discuss at their retreat? Mr. Jones stated that some questions have been raised about whether the City Council members on the Commission should be voting members on the Commission. Mr. Williams commented that he felt this sometimes placed the Councilman- Commission member in an awkward position. Mr. Smith stated that he did not feel this was a problem, and that very often new facts are presented to the City Council that were not brought out at the Commission meeting. Brief discussion ensued. The meeting adjourned at 8:05 p.m. MEMORANDUM TO THE ENGLEWOOD CITY COUNCIL REGARDING ACTION OR RECOMMENDATION OF THE CITY PLANNING AND ZONING COMMISSION. DATE: April 20, 1976 SUBJECT: Vacation of 2700 Block of South Elati RECOMMENDATION: Jones moved: D. Smith seconded: The Planning Commission recommend to City Council that the 2700 block of South Elati Street be vacated, subject to the retention of a utility ease- ment in the street to facilitate the maintenance of existing utilities; the recommendation to vacate the right-of-way is based on the condition that sufficient land adjoining the west side of the Delaware/Elati alley in the 2700 block be dedicated to provide a street which is to be designated as a truck route.
