October 18, 1977
I. CALL TO ORDER.
The regular meeting of the City Planning and Zoning Commission
was called to order at 7:00 P.M. by Chairman Judith B. Pierson.
Members present: Tanguma, Wade, Lathrop, OWens, Parker,
Pierson, Draper
Wanush, Ex-officio
Members absent: Williams, Smith

II. APPROVAL OF MINtrrES.
C ~~r ~n Pierson stated that Minutes of October 4, 1977, were
to be considered for approval.
Parker moved:
Wade seconded: The Minutes of October 4, 1977, be approved
as written.
AYES: Draper, Lathrop, Parker, Pierson, Wade
NAYS: None
ABSTAIN: Owens, Tanguma
ABSENT: Williams, Smith
The motion carried.

Subdivision Waiver
3730 South Sherman
C airman Pierson asked for the staff presentation.
CASE #18-77
Assistant Director Romans stated that the matter before the
Commission concerns a request for a waiver to the requirement
of filing a Subdivision Plat for property in the 3700 block
of South Sherman Street. At the time the area was platted in
1923, this parcel had been sold off, and was not included as
a part of the Subdivision; however, the lots in the Subdivision
of Wynetka Heights were numbered to accommodate this parcel,
which, if divided into four lots, would be Lots 9, 10, 11 and
12-. Mrs. Romans pointed out that all utilities are in, there
is proper and sufficient access to the site, and there is nothing
to be gained by the city or the public by requiring the filing
of a subdivision plat. The land is zoned R-2-C, Medium Density
Residence, which allows a single-family or two-family residence
on 50 ft.; this is a 100 ft. site, and the property owner
wishes to construct two duplexes on this land. Mrs. Romans

stated that the staff recommends approval of this request for
a Subdivision Waiver.
Mr. Parker stated that the duplex under construction on the
site now does not appear to have a basement. He stated that
the site has been vacant for many years, and the City has to
keep after the property owner to cut the weeds every year.
He felt the development of the site would be an improvement
to the entire block, and that the request should be approved.
Mr. Tanguma asked if off-street parking would have to be
provided? Mrs. Romans stated that this would be a requirement
of the Comprehensive Zoning Ordinance which the property owner
will have to comply with; the matter before the Commission at
this time, however, is the division of the land into two 50
foot sites.
Mrs. Pierson asked that the Minutes reflect that the applicant
and property owner was not present at the meeting.
OWens moved:
Wade seconded: The Planning Commission approve the request of
Mr. L. J. Wichman and grant a Subdivision Waiver
to divide the property at 3730 South Sherman
Street into two fifty (50) foot sites, the
property being more fully described as:
Commencing at a point 993.92 feet North of
South Boundary line and 702 feet east of the
West Boundary line of the South 1/2 of the
Northeast 1/4; thence North parallel with the
West Boundary line 100 feet; thence East 125
feet; thence South 100 feet; thence West 125
feet to if · point of beginning."
AYES: Wade, Draper, Lathrop, Owens, Parker, Pierson, Tanguma
NAYS: None
ABSENT: Williams, Smith
The motion carried.
IV. INTERPRETATION

Mrs. Pierson stated that she understood this request has been
withdrawn, and the applicant does not intend to reapply for
Commission approval.
V. DIRECTOR'S CHOICE
Mr. Wanush discussed the problems that could have come about
had the interpretation request in Case #20-77 not been with-
drawn; he noted that this is an extremely small site, and that
severe traffic problems could have been created. However, to

be consistent with past Commission action, there were no
grounds for recommended denial. Mr. Wanush noted that Broadway
is becoming very auto-oriented, and suggested that the Commission
should determine if they want more of this type of operation
along Broadway. Discussion ensued. Mr. Wanush stated that
requirements on a minimum lot size, required landscaping and
number of service bays and parking spaces might be enacted;
the use could be prohibited, or concentrated in a specific
area. Further discussion ensued. It was determined that the
staff would look into this matter, and report back to the
Commission.
VI. COMMISSION'S CHOICE
Mrs. Pierson reminded members of the Commission of the tour
of the Boulder Mall on October 26th, leaving Englewood City
Hall at 9:00 A.M. and hopefully returning no later than 3:00
P.M. Mrs. Romans stated that the Downtown Review Committee
is trying to get as much background information as they can
for their project, and want to go to Boulder to talk to the
businessmen about the impact the Boulder Mall has had. Mrs.
Romans stated that those on the tour will meet with members
of the Boulder Planning staff, Chamber of Commerce, Merchant's
Association and individual businessmen. Mrs. Romans stated
that the staff needs to determine the number of people who
will be going on the tour to make arrangements for the trans-
portation. A poll of the Commission indicated that Messrs.
Draper, Parker, Owens, Tanguma and Lathrop would attempt to
go on the tour.
Mrs. Pierson stated that on November 9th at 7:00 P.M., Mr.
Kirk Wickersham, a Boulder Planner and Attorney, will be
present to discuss the "Special Permit System". Copies of
an article by Mr. Wickersham were before the Commission,
and Mrs. Pierson stated that this article might be of interest
to the Commission as background for the meeting.
Mrs. Pierson asked if there was anything to report on the
Comprehensive Plan Review Committees? Mr. Wanush stated that
November 14th is the next meeting date of the Residential
Preservation and Redevelopment Review Committee.
Mr. Tanguma discussed the matter of unprotected railroad
crossings in the City of Englewood or in near proximity ---
such as Tufts and Quincy crossings. Mr. Tanguma stated that
there have been two fatalities at these crossings already
this year, and there was a serious accident at the Quincy
crossing on October 17th. Mr. Tanguma suggested that the
County Commissioners be urged to provide protection at these
railroad crossings.

Mr. Wanush pointed out that the long-term solution would be
the grade separations which the City has asked for in the
Highway Work Program.
Mr. Tanguma asked that the staff draft a letter to the rail-
roads, County Commissioners, and Governor Richard Lamm ex-
pressing the concern of the Planning Commission over the lack
of crossing protection at these intersections. Mr. Lathrop
suggested that a letter should also be sent to the State High-
way Commissioners. He urged also that the grade separation
construction schedule be advanced as much as possible because
of the "bottleneck" that is caused by the train traffic.
Mrs. Wade asked how the City of Littleton got the railroad
crossings in their jurisdiction protected? Mr. Wanush stated
that the staff would research this matter, and draft a letter
accordingly. Further discussion ensued. Mrs. Pierson stated
that letters of concern should also be sent to the City Council
and to the City of Sheridan.
Mr. Draper asked for clarification of a matter mentioned in
the City Council minutes regarding Hampden Professional Park.
He asked what this pertained to, and the location? Mr. Wanush
stated that the Hampden Professional Park is a proposed sub-
division of the southwest part of the Larwin site at Lafayette
and U.S. 285. Mr. Thomas Regan is the applicant, and the
Planning Commission approved the subdivision plat early this
year. The matter has been before the City Council since that
time, and has been postponed several times to give the applicant
and opponents an opportunity to reach a solution equitable to
both.
Mrs. Pierson asked the result of Mr. Littlehorn's appeal to
City Council on the denial of his rezoning request? Mr. Wanush
stated that the City Council upheld the Planning Commission's
action and denied Mr. Littlehorn a hearing before the City
Council.
