November 20, 1984
I. CALL TO ORDER.
The regular meeting of the City Planning and Zoning Commission was called to
order by Vice Chairman Becker at 7:00 p.m.
Members present: Carson, Stoel, Tanguma, Venard, Barbre, Allen and Becker.
Romans, Assistant Director of Community Development.
Members absent: McBrayer and Magnuson.
Also present: Susan T. King, Senior Planner
Jack Olsen, City Attorney
II. APPROVAL OF MINUTES.
November 13, 1984
Chairman Becker stated that the Minutes of November 13, 1984, were to be
considered for approval.
Venard moved:
Carson seconded: The Minutes of November 13, 1984, be approved as written.
AYES: Carson, Stoel, Tanguma, Venard, Barbre, Allen .
NAYS: None.
ABSTAIN: Becker.
ABSENT: McBrayer and Magnuson.
III. COMPRE HENSIVE ZONING ORDINANCE .
Mrs. Romans reviewed the changes made in the Comprehensive Zoning Ordinance
at the previous meeting of the Planning Commission. She noted that in Section
16.2 b "Trespass" was changed to "Inspect". Mr. Olsen approved, and Mr.
Tanguma a g reed . In Section 16.2-3, "Certificate of Occupancy", the wording was
changed by the Commission to read: "After the effective date of this Ordinance
or any amendment hereto, when a building permit is required, a Certificate of
Occupancy shall be required prior to the occupancy of the building or structure."
Mrs. Romans also noted the shortening of the time required for legal notices
and posting of property.
Mrs. Becker asked the City Attorney for a list of responsibilities, rights and
power of the Planning Commission.
A typographical error was noted on page 8, line 22. Mrs. Romans called the
Commission's attention to the Administrative Variance section, and she discussed
it with Mr. Olsen.
Mr. Olsen left the meeting at 8:00 p.m., asking that he be called at home if
the Commission needed legal advice.
Mrs. Romans noted changes in Section 16.3, saying that the new Ordinance would
require that all th e owners of the land to be rezoned sign rezonin g applications.
Unzoned property must have zoning initiated within 90 days. A meeting between
the staff and applicants would be required before any rezonin g hearing so that
applicants will know the City requirements at the first stage of th e rezonin g

process . Minutes of these meetings will b e required. The conclus ion of the
Department will not be binding on the applicant or the City. Rez on ing appli c a-~
tions shall expire after o ne yea r if they have not been fina l ized, b ut provision
is made for a si x-~o nth e x tension.
Mrs. Romans said that quarterly rezoning h e a rings would be continued, but
hardship could :hange the me eting dates . I t was n o ted that the public notice
and p os ting t i .e s were not chang ed o n page 5 to conform with the chan g es alre ady
made; a nd the Commission asked that they be changed. Mrs. Romans s a id that
p e rmi t tin g the rezoning hearing to be recorded by an electro nic recording
dev i c e go es alo ng with t he Englewood Municipal Code which a l lows recording. She
said tha t r e zonings approv ed by the Commission will be sent to the City Council.
Rezonings which are denied by the Commission wil l be sent to Council only if
the applicant appeals. The Council must hold a hearing if the applic nt appeals
the Commission's decision, and Council is given 90 days for action.
In Se ction 16.3-7, applicants are not permitted to file for a second rezoning of
a pr p erty within 12 months.
In Section 16.4 b, Mrs. Romans not ed the changes proposed concerning vehicles
parked or stored in residential zon es . The Commission asked that (a) be struck.
Mr . Tanguma and Mr. Allen obj ected t o the limitation of the number of vehi cles
stored on residential property . Dis c ussion ensued.
The Commission asked that the section be rewritten. The Commissioners suggested
that (7) and (10) be c o mbined and c larified.
The Commission stated that it recogn i zes that a grea t deal of Mrs. Romans' time
went into the Zoning Ord i nance, and stated that it appreciates her efforts.
Mrs. Romans said tha t t h e next meeting of the Planning Commission will be held
on Decemb e r 4 , 1984, a nd she said that it wo uld be devoted to the Zonin
Ordin ance. Mr. Carson asked that meetings be he l d in Conference Room A for
all Ordinance work .
There was no Commissioner's Choice.
The meeting adjourned at 9:20 p.m.
