The Regular meeting of the City Planning and Zoning Commission was called to order at 7:05 P. M. by Chairman Judith B. Pierson. Members present: McBrayer, Senti, Carson, Barbre, Williams, Tanguma, Draper, Pierson D. A. Romans, Acting Ex-officio Members absent: Becker Also present: Associate Planner Alice L. Fessenden II. APPROVAL OF MINUTES. Mrs. Pierson stated that the Minutes of April 8, 1980, were to be considered for approval. Carson moved: McBrayer seconded: The Minutes of April 8, 1980, be approved as written. AYES: McBrayer, Pierson, Senti, Williams, Barbre, Carson NAYS: None ABSTAIN: Tanguma, Draper ABSENT: Becker The motion carried. III. WEST HARVARD GULCH Flood Hazard Area Delineation CASE #12-80 Mrs. Becker entered the meeting and assumed her place with the Commission. Mrs. Pierson asked for a motion to open the Public Hearing. Carson moved: Tanguma seconded: The Public Hearing on Case #12-80 be opened. AYES: Draper, McBrayer, Pierson, Senti, Tanguma, Williams, Barbre, Becker, Carson NAYS: None The motion carried. Mrs. Pierson asked Mrs. Romans if the Planning Commission made the final determination on the matter of flood hazard -2- area delineation? Mrs. Romans stated that this matter will have to be referred to City Council. Mrs. Pierson asked that Mrs. Romans present the staff report on this case. Mrs. Romans stated that she was asked to extend an apology for Mr. Wanush, who is not in attendance. The bid opening for the new Public Housing Project was Friday, April 18th; two bids were received, and presentations are being made to the Housing Authority this evening, and Mr. Wanush is attending that meeting. Mrs. Romans was sworn in, and testified that the Public Hearing concerns an amendment to the Flood Plain Ordinance, which is part of the Comprehensive Zoning Ordinance. Mrs. Romans stated that the City adopted amendments to the Flood Plain Ordinance by Ordinance #2 of 1978, and this brought the City up-to-date on the Flood Plain Requirements. Mayor Otis recently received a letter from Mr. Scott Tucker of the Urban Drainage and Flood Control District, stating that they had received notification from the Colorado Water Con- servation Board that the report prepared by Gingery Associates, Inc., entitled ''Flood Hazard Area Delineation, Harvard Gulch, West Harvard Gulch and Dry Gulch, had been approved by the Colorado Water Conservation Board on January 30, 1980, and was being referred to the Urban Drainage and Flood Control District. The Urban Drainage and Flood Control District, in turn, has referred this study out to the jurisdictions which are affected by the drainageways covered in the report for approval and adoption. There is a portion of West Harvard Gulch which runs through Englewood; most of this drainageway is encompassed within the Northwest Englewood Greenbelt. There are small portions of five properties, however, that are affected by this flood hazard area as delineated in the aforementioned study. These property owners were sent copies of the staff report to acquaint them with the matter under consideration. Mrs. Romans stated that the proposal is to amend §22.4B-3c of the Comprehensive Zoning Ordinance, including a reference in this section to the study prepared by Gingery Associates, Inc. The amended section would read as follows: "(c) Flood Plain District Boundaries. The boundaries of the Flood Plain District shall be identical to the areas of special flood hazard identified by the Federal Insurance Administration on the Flood Hazard Boundary maps for the City of Englewood, Colorado, Sheets H-01 through H-04, and the Flood Insurance Rate Maps for the City of Englewood, Colorado, I-01 through I-04, dated June 24, 1977. THE BOUNDARIES OF THE WEST HARVARD GULCH FLOOD HAZARD AREA SHALL BE AS SHOWN ON SHEETS 13 AND 14 IN A REPORT ENTITLED 'FLOOD HAZARD AREA DELINEATION, HARVARD GULCH, WEST HARVARD GULCH, AND DRY GULCH' DATED DECEMBER, 1979, PREPARED BY GINGERY ASSOCIATES, INC., AND APPROVED BY THE COLORADO WATER CONSERVATION BOARD ON JANUARY 30, 1980. The Flood Hazard Boundary Maps and Flood Insurance Rate Maps prepared by the Federal Insurance Ad- • -3- ministration AND SHEETS 13 AND 14 OF THE FLOOD HAZARD AREA DELINEATION HARVARD GULCH, WEST HARVARD GULCH, AND DRY GULCH, DECEMBER, 1979, GINGERY ASSOCIATES, INC., are hereby declared to be a part of this Ordinance, and the official maps shall be on file in the office of the City Clerk, Englewood City Hall, 3400 South Elati Street, Englewood, Colorado." Mrs. Romans stated that in the future when there is new con- struction along this flood hazard area, reference can be made to the elevations as set forth on the maps contained in the Gingery Associates, Inc., report. Mrs. Romans pointed out that there should be no conflict on the property owned by Mr. and Mrs. Reffel, inasmuch as the drainage on their property was worked out at the time they were granted a Subdivision Waiver last year. Mrs. Romans noted that there should be no problem with the property owned by Mr. Penner, either, inas- much as an easement was granted by Mr. Penner at the time his Subdivision Waiver was approved. Reference was made to maps showing the flood hazard area delineation for West Harvard Gulch. Mrs. Romans asked if there were any questions? Mr. McBrayer noted that the staff report had indicated that by delineating the flood hazard area, the property 9wners could obtain flood insurance. He asked why property owners would want to get this insurance for property "on the side of a cliff?" Mrs. Romans stated that where the property cannot be developed, the property owners probably won't apply for federal flood insurance. For property owners whose property is in a flood hazard area and can be developed, the federal flood insurance will be available. Mr. Williams asked if the map of the flood hazard area which the Commission was considering was the official map? Mrs. Romans stated that the map as identified in the Gingery Associates, Inc., study is the official map. Mr. Williams noted that at the time the amendment to the Flood Plain Ordinance was adopted in 1978, there was no mention made of West Harvard Gulch. Mrs. Romans stated that the flood hazard area for West Harvard Gulch had not been delineated at that time. As the flood hazard areas are identified, local communities are being asked to adopt them. Mr. Williams asked the latest date this delineation could be adopted for West Harvard Gulch and still allow property owners to be eligible for flood insurance? Mrs. Romans stated that no date was given for the adoption of the West Harvard Gulch flood hazard area. Mr. Williams asked the last time there was flooding in Harvard Gulch, and how serious was the flooding? Mrs. Romans stated that she was not aware of any severe flooding on West Harvard Gulch. The primary advantage to identifying the flood hazard area along West Harvard Gulch would be to guide the City if some- one wanted to build on their property, or to bring in fill on the property, changing the flood hazard boundaries of the Gulch. Mrs. Romans stated that she regarded this as a rather minor drainageway, but felt it was important to continue to -4- participate in the program. Mrs. Romans stated that it is also important to have the flood hazard area of the drainage- ways delineated, and pointed out the problems that have been experienced on Big Dry Creek since the course has been changed due to development. Mrs. Romans stated that the procedure now is to refer any application for development to the Urban Drainage District before permits are issued. Mr. Williams asked if the Urban Drainage and Flood Control District gave the information requested by the City voluntarily? Mrs. Romans stated that they do, and that they are very helpful. Mrs. Pierson asked if anyone else would like to address the Planning Commission on this matter, or to ask questions per- taining to the flood hazard area delineation? Mr. Reffel, one of the adjoining property owners, stated that he had no questions to be asked of the Commission or of the staff. Tanguma moved: Carson seconded: The Public Hearing on Case #12-80 be closed. AYES: Carson, Draper, McBrayer, Pierson, Senti, Tanguma, Williams, Barbre, Becker NAYS: None The motion carried. Mrs. Pierson asked the pleasure of the Commission. Mr. Williams asked if there would be requests for approval of flood hazard area delineations before the Commission from time-to-time? Mrs. Romans stated that she felt this could be anticipated. Mr. Williams asked if the Commission could have a study session on the matter of flood plain, flood hazard areas, flood ways, etc. He stated that he felt the Commission needed to clarify this. Mrs. Romans stated that she felt such a study session would be very informative. Mrs. Romans asked that the staff report be included in the record of the hearing . Mrs. Romans also stated that the property had been properly posted, and notice of the public hearing was given in the official City newspaper. Mrs. Pierson stated that this would be noted. IV. PUBLIC FORUM. There was no one present to address the Commission under Public Forum. V. DIRECTOR'S CHOICE. Mrs. Romans stated that there has been no further contact from the Country Club Joint Venture property owners. However, the new owners have indicated that they would like to meet in a study session with members of the Commission in the near future. The owners seem very "market conscious", and realize that whatever they do must be marketable. Mrs. Pierson asked if they were really considering going ahead with the development at today's interest rates and economic condition? Mrs. Romans stated that they are; they apparently have financing for the first phase of the develop- ment . Mr. McBrayer stated that those in his business have noticed a "softening" of the interest rates in the last two weeks, and also that lumber prices have dropped to the lowest it has been in over a year. VI. COMMISSION'S CHOICE. Mrs. Pierson acknowledged receipt of an anonymous letter per- taining to traffic situations surrounding Greenwood Plaza. She asked that copies be made for members of the Commission. -6- Mrs. Pierson asked if the Commission was going to have a study session following this meeting? Mrs. Romans stated that with Mr. Wanush absent from the meeting, it had not been planned. Mrs. Pierson asked if another time should be set for the study session? She stated that she would like to set up an agenda of regularly scheduled speakers to talk to the Com- mission on different matters of concern . Mr. McBrayer stated that some of the speakers could be in-house staff. Mrs. Pierson stated that she would like to have both staff people and invitees from other jurisdictions, etc . speak to the Com- mission. There being no other business before the Commission, the meeting was adjourned at 7:35 P .
