tives o! the Valley Sanitation . District, appeared to enter into the discuss i on on the mattero
These gentlemen indicated that they felt the fee was exhorbitant and possibly discrim1natory"

It waa brought out that the City of Englewood is not involved in the contract or agre mt.mt

Re: Water Service for South Broadway
Heights Addition, Arapahoe County,
Coloradoo
Several property owriars h!lve recently filad a Petit.ion with the Board or
Directors of the Southwest Cherry Hills Water District requesting that their
land be included within the boundaries of the districto
The tracts of land involved are Blocks 1, 2,· J and 16, South ~oadway ·
Heights Addition, and a parcel situated East of Blocks l arxl 16 , bounded on
the North by East Oxf ord1 on the East by the Cherry Hills Golf Course am
on the South by East Quincy AvemJe .~
The contract between the South'ifest Cherry HUls Water Dist.rict am the City
of Englewood provides that-service may be extended to areas contiguous to
the boundaries of the original district only after the City of Englewood
has consented theretoo. Last year you. agreed to serve Blocks 14 and l),
South Broadway Heights Addition, and the procedure followed in that ease re-
quired that the property owners involved obtain a relea.8a fr<m the Boe.rd
of Water Collll1isaionera ot the City atvi County ot Denver ~.
Such a letter, a copy of which is enclosed, has been obtained from Denver 's
Board or Water Commissioners extending its release so as to include the
larger area abore describedo It is my understanding that you have given
verbal approval of extension o! service based upon this recent letter9
In view or the tact that the decision of the property owner• to seek 1n-
clu.aion in the district becomes irrevocable when an order to that errect is
issued by the District Court and thereby such property-a11nera become liable
for general taxes levied by the district, will you please mail to me a
written conf'irmation of your previous verbal commitment, subject, ot ccm-se,
to all applicable terms am conditions ccntairied in the contract between yoo
and the Southwest Charry Hills Water Distzicto

referred to, from the Denver Board of Water COlllllissioners to the Southwest Cherry Hills
Water District, under date or January 3, 19S7o
Mro Babcock, Commissioner., pointed out that the request to the Southwest Cherry Hills
Water District was signed by ten property owners; however, due to the restrictions to
large building sites, the potential ml:mber or water taps in this area would probabl3 not
be more than twenty and would not jeopardise the water suppl\V' of the City or Ehgl.ewoodo
After some discu.ssicn,
Oliner moved,
Milligan, seconded, That the water Advisory Board recanmend to Council that the
Southwest Cherry · Hills Water District be alla.ed to annex,
to that dietrlct, by supplemental agreenent, the following
described land and that the Red Line be extended to include
