Gentlemen:
Pursuant to a Connector's Agreement entered into
between the City of Rnclewood and Glencoe Builders,
Inco dated May 6, 1957, the Glencoe Builders, Inc o
or its assigns have bought and ~id for 122 sewer
taps at the rate of $100.00 per tapo The Carey
Construction Company is presently enea,ged in the
construction of forty (40) hones which will fall
under the above mentioned agreemento
As you will recall, prior to the payment of the $100000
per unit tap .fee, considerable discussion was had be-
tween your board and the undersiened relative to the
:}lOOoOO fee, it being the undersigned's contention
that ~;J.OOoOO per tap was an excessive fee for many
reasonso HO\'tever.11 the board felt, due to the necessity
of additional construction on the part of the city
and for other reasons, th.at this fee muld have to be
charged. G:inco ths.t tine it is my underatandine thot
this board has approved other sir.til.ar taps at the rate
of ~50o00 per tap; also it is my understand.inc that the
additional construction that was contemplated at the
tiI:le the ~~100.00 fee was set has not been constructedo
Therefore, I respectfully request that the board reconsider
the tap fee applicable to the above mentioned Connector's

portion of the district has already paid the tap fee based on $100000 per tap, it would
bo discriminatory to charge any less fee to the remainder or that dietricto

Mro Shivers stated that he did not agree that well water, even though clorinated, should

excerpt from a memorandum dated September JO, 1958, from the Bnglewood Chamber of Commerce
to the Mayor and City Council~ relative to the F.nglalfood Cii?f Budget for 1959:
11 It will be noted that a mill levy of 1% for the Water bond fund is set UPo It
is our feeling that a publicly owned water or other utility should pay its own way
and should also pay to the city an amount equivalent to property truces which would be
chareeabla to a comparable privately owned utilityo Based ul)on this premise, the
Englewood City Water system should eventually pay to the city about $80 1 000 per year
in taxes - - -and thus add to the revel'Dl8 of the City instead of money being paid by

the Cit,y to the Water Tundo This is proposed for the future, since v.ie realize that
reserve for depreciation and additional capital improvements need to be made to our
relatively younc water systemo
It is also felt that the equitable method of cha.rein(; .for water is by i;he amount
used, which can best be accomplished by water r.ieters~ Perhaps n0"1'1 units of three
(or possibly as few as two units) might be required to install meters during
cons tructionp"

It was also stated by the Association Board members that:

·rhe main topic or discusslon was the matter of how the Association w.rnld
function after they were beine served with F.nglewood water. It was agreed
that the change-ove1 could be !esolved by means of one of the following
alternates:
.Alternate Noo 1: A. detemination of a fair amount per member
that they would expect to.recover taking into consideration the value to
each member of the water tap that they already havea Thus, enabling the
City~ if it would so elect to pay the Association a pre-determined amount
in a lump sum and thereby tal-cillg over the water system with no further
obligations to the AssociaM.on. It was brought out that each member had
to pay auproximately ~180~00 for the original eoptract plus additional
misceD.aneous expenses, maki.'1.g a total of approximately t 200 00 per member ..
llJ.ternate Noo 2: For the Association to operate under its
present status with a contract w1:lih Englewood for furnishing the water for
a definite stipulated timeo Uton the expiration of such pre-determined
time the Ci.ty would take over the system fr·ee of charge. In the meant:tme
the members would receive a pro-rated share of the r venue received f~om
the sale of additional taps within their prescribed area
TLere was a third alternate discussed but did not meet with
n~ch favor, na.~ely, operating status quo until a definite prescribed
nuir.ber of taps were sold.
Mr. Kelly asked if the City would consider making a proposition or offer
to the Association so they would have something to take to the members
for approval or disapproval. This, Mro Babcock said, he could not promise
but suggested that i·c might be better if the Association first express to
the City its ideas a.s to what might be considered a fair settlement, par ..
ticularly in line with Alternate Noo 1.
The Association of'fic rs stated that they would immediately arrange for
the services of an Attorney who would meat with the City's Water Board
Council with the idea of drawing up a preliminary agreement between the
City and the Association.
Mro Babcock stated that he would present the ma.~ter to the
Water Advisory Board at their next meeting for any reco11I100ndation that
they might have to offero

accordance with Section A Paragraph 27 of Ordinance Noo 15, Series
of 1956» shall be as follows:

For regularly shaped lots or tracts within Residentially
and C0011nercially zoned areas, the assessront for connect.ion to
City-cr.vned water mains shall be $3050 per front foot of property
served, regardless of the size of the main inst.a.lied in the street,
and such ficure shall include and cover lot depths up to 140 feeto
The f ollowine exceptions shall apply:
(a) In cases where such lots or tracts are of sufficient
depth to enable the ovmer ·to divide each lot into a?;>roxi.':la tely

original depth; and other tap assess~ants will be required for
