over sewer matters in the City of Sheridan~ was received and discussedo

Mro Rudd 8 City M.a.nager 8 reported. the written offer of John Clapp to remove the two
dwellings and accessories on the sewage treatment plant lands for $1 8 $00 and including
his off er to rent the original brick dwelling for $36000 per month on a month to month
basis; also, that Mro Clapp has made his offer contingent upon a JY"..rmit to move the
two dwellings to adjacent lands which are industrially zoned and not eligible to receive
these buildingso
It was pointed out that the contract with the Clapp brothers permit them to occupy the
premises until July 23, 19590
After discussion, and in view of the highly qu.alified bid, and the unliklihood of Mro
Clapp•s request being granted,

involved on sewage treatment plant lands according to the terms or the existing contracto

Because of a water service failure in the South ... F.ast Englewood Water District on Sunday,
June 28~ 19591 am the City being subjected to much undue publicity and crit1c1811l, a general
discussion was held relative to this specific, am similar type incidents~

When the matter of inclusion of the Jones-
Morrow.,,,Evans lands into the South ... East Englewood Water
District came before the City Council on June 15ih1 it
appeared to be a perfunctory movement since it has been
recommended by the Water and Sewer Board, and the necessa.ey
documents had already been e:x.ewted by the District officers
and were availableo
However, the point was raised by some of the
Council members that sane other applicants had recently
been denied annexation to the District by action of the
District Board of Directorso The on1y information avail ...
able during the Council session was quoted rrom your
ori.gina.1 letter of May 15th, that the proposed lands lie
UV:lthin the service area previously approved by the City",,
and a .further thought advanced that probablz the lands or
other applicants lie outside of this:ierVice areao
After considerable discussion" and in conse-
quence of the question not being fully answered, the
matter of the annexation was tabled, and w.Lth a directive
to this office to form this letter .. asking for cla.rit:i-
cation by your Board as to the reasons for approval of
certain areas for annexation and denial to otherso
Any information on this question which you may

In reply to you letter dated June 17 in reference to the
inclusion of the Jones-Morrow-Evans lands into South-East Englewood
Water District, I regret that my letter to you and the City Council
did not contain sufficient inf'ormation to identify the particular
location of this land in reference to the District boumarieso

The Petitioners• lan::ls are located in Section 14, Townsllrl.p 5
South, Range 68 West, which is bounded on the South by Orchard
Avenue 9 on the East by South University Boulevard , on the North by
East Belleview 1 and on the West by South Clarkson Street o The
specific location within the Section is on South Clarkson Street,
South of the City of Englewood Reservoir and right of way lecding
from South Clarkson to the Reservoiro Section 14 has been a City
approved service area of the District for over two yearso
In reply to your inquiry concerning "approval of certain areas"
tor inclusion in our District, and "denial of other areas", I wish
to advise that no areas have been denied inclusion into the District
which were located within the service area as defined by the Englewood
Council am Water Boardo Any rumors or suggestions to the contrary
are untrue and not based on f aet.
The Board has had inquiries concerning the possibilities of in-
clusion from owners of property located as far East as the Valley
Highway and South into Douglas County, as well as West of Broadwqo
The uniform answer given to all such persons has been that until the
City Council of Englewood permits an extension of the service area,
the District cannot consider the inclusion of lands lying outside of
the presently defined service area. Our District expansion is limited
by, .first, the available i.,->ater supply allocated to the District by the
City; secon1ly, by the capacity of the District storage and distribu-
tion facilities; and thirdly, by the general best interests of the
electors of the Districto The first factor 11 water, is solely
within the control of the City0 The second factor, engineering,
is within the joint. control of the City and · the Districto Tbs
third matter of "best interests" is one of Dist.rict policy.
It should be observed that the District is always interested
in increasing its tax base in order that the cost of the District
diistribution .facilities may be more rapid1y liquidated,, and fran
this standpoim, expansion is desirable, subject always to the
overriding considerations of water supply and engineeringo
The Board of Directors of the District has consistently sought
to formulate policies which are in accord with the policies adopted
by the City of Englewood Water Board and the City Council, to the
end that the nmtual problems of the City and the District could be
solved in a cooperative and friendly manner 0 The Board has appre ..
ciated the cooperation given it by the City Water Board and the City
Council in the past, and we anticipate a continuation of this friendly
relationship in the future .~

After sane discussion, it was agreed by the Board tt;at the salary ref erred to in
the letter just received should be paid through the Tri-City Trust and Mro Scott
was asked to so advise Mr o Williams, by letter.

Mro Scott reported that a meeting of the Metropolitan Cooperative Commission would be
held at 3:00 P. Mo Monday, Jul.y 61 1959, in the Governor's Conference room in Denvero
~he purpose of the meeting,, at which Repo Byron Johnson will be in attendance.., will be
to discuss the problems of stream pollution,, particularly along Clear Creeko
The Boa.rd asked that Mro Kreiling, Councilman and Water and Sewer Board member and
Mro Babcock, Utilities Director, attend the meeting as representatives of the City of

Mr 0 Shivers, Conaultant 8 reported that the change in point of diversion, Case Noo 3502
in Park County, has been settled.o Mr . and Mrs. Farrar agreed to giving up one cfs of
water to the riverci. The case involved the water right of the Chapelle Ditch in South
Park 9 (See Water and Sewer BG!:l.rd Meeting minutes March 4, 1959.)

Mro Shivers~ Consultant, reported that a restraining order against Latimer Construction
Canpany9 et al, to stop the proposed dumping of surface drainage water into the Nevada
Ditch and it's tailway, has · been effected with same being continued temporarily by
agreemento Further action will be reported latero (See Water and Sewer Board Meeting
minutes June 10, 19590)
