The meeting was opened with a discussion between the City of Littleton, Sewer Committee ,
and the Englewood Water and Sewer Board, relative to the proper effluence fran the
newly enlarged Littleton sewage dispo~l pl;:mt into the South Platte River.

Mro Mullis, Chairman of the Littleton Conmittee , begi:m the discussion by describing the
proposed final Littleton treatment plant which could be made to include proper facilities
to provide for sewage effluence with a 00 D count below thitt required by the StAte Henlt h
Depu-tment which would, therefore, allow the effiuence to be discharged ~t any point in
the rivero
Hr o Prince was asked whether the State Board of Health would approve of such a plan, all
knowing that the City of Englewood South Platte River raw water intake was within such
close proximity.
hro Prince indicated that the State Board of Health would not approve of sucb a pl.An
and questioned the acr1isability of the plan since a municip.-ility could control the water
supply !or a distance upstream of somewhat more than that involved in the present question o
Hro Prince indicated 1"11.rtiher thllt it had been the experience of his office that no sewage
treatment plant could be expected to opsrate 100% ef'ficien~ and that if the Littleton
proposal was alloued to be carried out. the City of Englewood would be required, as would
the Health Department, to be constantly vigilant against the time that the I&ittleton
plant effiuence might not .be above standardso
It was pointed out by both Mr,o Shivers, Englewood Consultant, and Mro Prince that the
public relations problems which might arise from this situation might become inSUl'!llount.itbl e

At the request of the City of IJ.ttleton, the Water and Sewer Advisoxy
Board of the City of Englewood$ held a spec!Rl meeting on March 25, l95'9.s1 At
'
8tOO Po 11., for the purpose of discussing the essential new, or enlarged, by=
pass line to carry Littleton sewage down strerun below the w::iter intake of the
City of Englewood~ The members of the Littleton Water i:md Sewer Committee,
were unfortunately unable to attendo
The Englewood Bo~rd proceeded to discuss the matter, and was advised by
City Manager Rudd that under letter dated March l3t 19.59, enclosing a report by
Ilale Ho Rea, dated March 111 19591 the comparative costs of placing the necessary
by-piss line on the East and West sides or the P l;ttte river, respectively, had
been forwarded to the City of I..i.ttletono The same figu..-res were then presented to
the Englewood Boardo
The figures subnitted were thoroughly studied and discussed. Following di.Sc>
cuss1on1 it was the unanimous view of the Englewood Water and Sewer Advisory
Board that the present situation was the exact reverse of the situation in the
late 1940s and early l9.50s1 at which time the City of Englewood in establishing
its municipal water works system created a new condition upon the Platte River by
placing its intake below the sewage plant of the City of Littleton, thereby re•
quiring Englewood to make arrangements for the by"-passing of Littleton sewage past
its proposed water intakeo This obligation EJltlewood voluntarily, and without any
question, took upon itself' and paid the entire cost for installation of a. by-pass
line including right of way there.for, and all legal expenses in connection there-
witho
The present situation is that of the City of Littleton creating a new con-
dition upon the stream above Englewood• s water intake while being fUl.ly aware of
the location of that intake, and af'ter that intake was installed9
It was the general consensus of opinion among the membership of the Engle ..
wood Board, that since Littleton was proceeding with prior lmowledge of the lo•
cation of Englewood's Domestic Waterworks System intake, arv expense to correct
problens arising £ran that nev condition, should be paid by the City of Littletono
It was agreed, however, that no fiMl or definite decision in the IMtter be made
until a conference with the Littleton Water and Sewer Committee could be heldo

The letter st.ated, in effect, that the plans were quite accept;ab:ie provided that the
ef fiuence tram sai.d plant would be discharged downstream from any e·l!dxting municipnl
water .works syst.em intake along the river.
It was the consensus of the Englewood Wat.er and Sewer Board that the opinionS, expressed
in the letter of April 13:' 1959 (See aboVf)) should l'eJll8in ~o stand~
After members of the Littleton Committee departed, some further <;liscussion on the matter
was heldo ·
Purcell moved,
Kreil.ing, seconded,. That a letter be sent, over the signature of the Chairman of
the Englewood Water arid Sewer Board, to the Littleton City
Council, by registered mail9 stating that a meeting was held
with the Litt.1.eton Sewer Camnittee this date conceming the
necessity of a pipe line to by..,pass I..i.ttleton sewage ei'fluence
to a point below the raw water intake of the City of Englewood~
municipal water system on the South PVttte RiverJ that said

Littleton Sewer Committee stated that the matter would be
presented to the Littleton City Council on Tuesday, August
181 19$9Q Further, thAt the City of Englewood requests a
statement, in writing, on or before the 24th of August, 1959 ,

stall a by ... pass pipe-line, as requested, before the new Littleton
sewage treatment plant goes into operation, adequnte to give

A letter was received, under date of Jul;y 1 1 1959 8 over the signature of Mro Clarence
Lo Bartholic, Attorney, representing the Valley Water and Sanitation Distrlctf which
requested permission to include in the Valley Water District and the Valley Sanitation
Di strict, an area generally described as the Northerly 38.5 i'eet of the triangle of
ground south of Belleview Avenue, East of Lowell Boulevard and West of Linden Driveo
Mr o Babc ock, Utilitie s Director, stated that since the above application had been re-
ceive d, certain complications between the owners 0£ the land and the Valley Water
and Sewer Districts had arisen and that no expedience was neceasar.y in the handling
of the application for inclusiono

property into the Valley WRter and Valley Sanitation Districts

this necessary easement is the most !easible 1. and Mro Ba bcock .further advised the Board
that the proposed plan could be worked out in such a manner as to cause the City no
p!rticular inconvenience. Mr o Babcock also pointed out that the proposed new line
would pass through the contemplated new City Park area as we ll as through the water
filter plant grounds, all or which would be in need of certain sewer connections for
existing, as well as new, buil~g facilities and recommended to the Bo~rd that it such
easement should be granted, the City should not be required to pay South Arapahoe
Sanitation District feeso

out the necessity for proceeding with the budgeting for the 1960 portion of the program,
with the possible exception of iten Noo 4,, Acquisition of Land For Proposed New Raw
Water storage Reservoir, other lands and Western Slope Developnento
The Board indicated that the projects for 1960, as outlined should be pursued and
especially Item Noo 4, and recommend that all be included in the 196o budgeto

That a proper easement be granted the South Arapahoe SR.nitation
District to cross city-owned lands 1\long Big Dry Creek, in the
vicinity-of the proposed new City-Park and the water filter
plant grounds, with it• s new 42" sanitar-.>" sewer trunk line,
subject to the provisions that the plans and specifications
for same be approved by the City, and subject to the right of
the City to attach sewer service lines from aey city-owned
installations, on city-owned lands, without charge, the
City to retain use of ground surface, subject to the right
of the district to maintain and repairo
