the office of the manager of the Denver Department of Parks
and Recreation dated August 19b 19590 This letter requests
permission to tap the Cherry Hills Heights Water & Sanitation
District sewer line on Floyd Drive for service to the conces -
sion stand and two connected toilet.s located at the fifth
green of the Wellshire Municipal Golf Course in the manner and
for the reason statedo
The District is giving this matter intensive consideration and
is requesting from its counsel a legal opinion as to the
factors in thi.s requesto In the meantime» however» we would
appreciate any expression of opinion that the City of Engle ~
wood could off er in this connectiono

Mr o Babcock informed the Board of the drastic overloaded condition of the sewer mains
in the northeast section of the City which involves the particular line upon which
permission is sought for the sewer tap in question and stated that since the City is
still canmitted for 15 taps in the Cherry Hills Water & Sanitation District, he would
definitely not recamnend that any additional taps be allowed until the overloaded
condition can be remedied~
Mayor Scott indicated that he felt that all possible consideration should be given to
correcting the overloaded condition and that the request should not be immediately denied,
with Denver being ad,_rised that the City of Englewood desires to cooperate to any
extent possible o
After some further discussion,
Purcell moved,
Robohm, seconded., That the Utilities Director, Mr~ Babcock, be authorized to
express the opinilXl of the Board in a letter to the Cherry
Hills Heights Water & Si:1nitatian District, pointing out that,
while the Englewood Sewage Treatment Plant has ample capacity"i'
the capacity of the particular sewer main in question is in=
sufficient to permit the consideration, at this time ~ of any
additional sewer cormections beyond those previously canmit t ed
to the district; and further,
that Mayor Scott,· in a c·aimu.nication to Mro J. Eo Schlupp and

requested the decision of the City Council, I
would like to inform you of the following:

the City Council of Littleton voted unanimously to
authorize the installation of a Bypass line fran
the Littleton Sewer Plant to a point below Englewood's
water intake<>
I am this day notifying our Consulting Engineer,
Dale Rea, to proceed w.i.th preliminary plans iromediatelyo

As directed, by the Water and Sewer Board at the regular meeting of July 1, 1959 ,
Mro Babcock, Utilities Director~ presented a report and study to indicate the possible
increase in receipts for the various sewage and sewer funds deerned necessary to
qualify the City of Englewood for an additional bond issue to finance the construction
of the proposed enlargem.ent of the sewage treatment planto (See copy of' report attached
as a part of these ntinuteso) .,
After thorough cpnsideration of the entire report, it was the consensus of opinion
of the Board that no recamnending action should be taken relative to .any change in
rates, assesmnents ar taxes, relative to the purposes set out~ until contact has been
made by the Bater and Sewer ' Board by meeting with representatives of certain bonding
houses to varify the actual requirements that will be necessary for a new bond issueo
It was also felt, unanimously, by the Board ., after reviewing the pre;:>-.ent sewage disposal
rate schedu1ev that in any event, there were nUD1erous inequities in the rate structure
that should be correctedo

It, was determined by the Board that the Chairman should appoint a committee of Water
and Sewer Board members to maim the bonding house contact11 asking the City Clerk to
also be in attendance at any meeting or meetings; all endeavoring to secure the neeess~
infonna.tion to report at the next regular meeting of the Boardo
Mro Babcock was asked to make a further study and report on sewer rates and revenues 9
particularly with reference to the commercial catagories and multiple dwellings of
more than two units, both inside and outside of the City limits9 presenting his findings
along with his recanmendations for a tentative revised sewage disposal rate schedule for
consideration by the Board at it 1 s next regular moetingo
Lease and Agreement documents between the Tri=City Trust and the City of Englewood,,
were presented by Mr., Shivers, which 11 when executed,f) will enable the City of Englewood
to make use of 5~93 inches of water rights 11 held by the Tric-,City TrusttJ L"l the Denver
City Ditch at an annual fee to the Tri=City Trust of $10000 and payment by the City
of Englewood of all standard City Ditch assessments~

Mayor Scott informed. the Board that City Council felt that the Water and Sewer Board

ehall be due and payable in installments of one-half on the 2nd
day or .January and one-half on the 1st day of July except that
schools shall be billed monthlyo
Failure to pay sa..i.d rates and charges when due shall be
cause for discontinuance of water wervice or in the event any prop-
ert.y served by said sewerage system 1~ located outside the City
Limits of Enp,lewood, and the owner thereof sha.11 neglect, fail or
refuse to pay the rates and charges fixed herein.above, the City Clerk
shall certify the sald rates and charges due to the County Commission-
era of the County it which said delinquent users• property is located
and the same shall becorr.a a lien upon the real property so served by
said sewerage system, and callected in the manner as though they
were a part or the tax.as.
Section 2o The City Council hereby finds, determines, and
declares that this Ordinance is necessa.r.r for the immediate preser-
vation of the public peace, health, safety and convenienceo
Section 3o In the opinion of the City Council an emergency ,
e:xiat&J therefore, this Ordinance shall take effect and be in force
from and after 1t'o final passage and publicationo
