Mro .Babcock, Utilities Director, reported brie.fq on the b:isnnial hearing, held earlier
this date at Hot Sulphur Springs 1 Colorado, relative to showing diligence on the Cabin-
Meadaw Creek water rightso
He stated that the evidence submitted by him and Mro Shivers,, Water and Sawer Bo:r d
Consultant, was sufficient t.o warrant a continuance by the Judge for another two years o

placement items and estimates of cost occasioned by proposed 72" water conduit construction
across City of Eng:Bwood by Denver Boo.rd of Water Commissioners, previouszy distributed to
all m9mbers, was discussedo (See attached copy of report as a part of these minutesc Also

Scott moved,
Purcell, seconded, That the Water and Sewer Board recommend to City Council that all
points enumarated in the report from Mr. Rudd, dated June 31 19601
concerned with the proposed 72" Denver water conduit be embodied
1n a permit to be granted to tha Denver Bo .'.ll"d of Water Commissioners a
adding thereto a specific time limit which would prohibit the storage
of pipe and ot:tsr obstructive naterials fer a period of more than
two weeks prior to actual installation and/ or use; negotiations to
be carried on by the City Mamger.-City Attorney and the Water
and Sewer Board Consultant.o The Board .further recommands that the
engineering firm. that will be doing the storm drainage study, in
the City ot EnglewoodJ> be contacted to determine whether or not
this installation would interfere with their probable recomnendationso

Herewith please finl enclosed a copy of a Petition from
Ruth Williams May and Mar;r Susari Langerak in connection with the
annexation of their property to the District and the connection of
their property to the faciUties of the Valley Sanitation Districto
Subject to the a)proval of the City of Englewood as to
the connection of the property c.nd the admission of the property
to the Valley Sanitation District, it 1s the desire of the Valley
Sanitation District Board of Directors that such property be added
to the District and the facilit ies of the D;tstrict extended to cover
this property o
As I ~rstand it, th property is to be used for a
Phillips n66n Filling Station and that the restrictions heretofore
prescribed by Mro Dale Ho Rea co:ooerning a settlement table and
the disposal of the water from he wash rack will have to be com-
plied with in any connection that will be madeo Mro Rea has pre ...
vious~ required that the water from the wash rack would have to
be emptied into an adequate retention basin where all settleable
solids are removed and that the disposal £1eld is adequate and
capable of extension should tro~ble occuro

The Board wae reminded_. at thi.8 time 1 tha . the above matter had been anticipated for action
as early as January ll, 1960, since the Utilities Director had been contacted by a represent-
ative of the Valley Sanitation DiJ trict, rior to that time, who had indicated that a letter
of request would be forthcoming,, ~he let -er was actually received under date of June 3. 1960e
In the discussion which followed• it was brought out that, while the Valley Sanitation Distric
was proba'bly in the position to serve the site best and possibq the only means of sewer
servicesi the fact remained that the location i8 within the City of Littleton and that ap-
provaJl for service by the City of Englev1 d through the Valley Sanitation District system
should be obtained from the City of Littl tono

COST OCCASIONED BY PROPOSED 72" WATER CONDU :i'r
CONSTRUCTION ACROSS CITY OF ENGLEWOOD BY DEN"V'ER
BOARO OF WATER COMMISSIONERS
Following requests and diz·ectives froru proper
bodies and with the City Engineer's report in view , I
offer the following points of suggestion and information:
lo That a competent and qualified inspector be
selected to represent t h-e Ci ty of Englewoo d
during the construct:i.on a nd replacement
operations, and that the costs for such
services be paid by Dem· er, either directly
or as a reimbursement to Englewood o An
inspector will cost $500 -$600 per month.
2o That Denver be required to replace all of the
present paving, according to original specifi-
cations and grade lines 9 on E~st Radcliff
Avenue from South Pennsylvania Street to
South Washington Street including the
recently paved intersections of East Radcliff
Avenue with South Logan Street, South
Pennsylvania Street, South Pearl Street and
South Washington Street o The City
Engineer estimates a minimum cost of $7 9 500
for these itemso In case any present
curbs 9 gutters , and/or sidewalks in this
area ai~e damaged, such should be replaced
at current unit priceso
3o That there are varying widths of old oil
surfacing along other stretches of East
and West Radcliff Avenue which will be
destroyed together with some possible
d amage to existing curbs , gutters and
sidewalkso The City Engine e r has recorded
the various widths and has made photographic
record of all of East and West Radcliff
Avenue as it now lays and existso Denver
should be required to replace all of the
existing facilities which ~ay be damaged 9
together with the base course underlaying
the old oil stripsQ It is suggested that
the proper amount of replacements be laid
at the City Engineer~s grades and at
locations so that such work will meld and
connect with any later pavement wideni ng
and/o r concrete workc Unit prices should
a p ply i n such work and the total c ost
under t he above requirements should n o t
exceed the cost of promiscuous re p lace -
ments o
4 o That there may be conseque n t i a l damage
to facilities on t he side s t reets
approaching t he v ar ious i ntersections
wi t h Radcli f f Av enue because of pipe and
material storage and heavy equipment
movements or from other causeso The

5o That any gravel surfacing disturbed or
destroyed by this conduit construction be
replaced by Denver in full amount as soon
as final backfill and compaction is
accomplishedo
60 That the crossing of South Broadway at
Radcliff is a special phase of constructjon
because South Broadway has State High ay
designationo The Colox·ado Department of
Highways will not require a permit from
their agency since Engle ood maintains
that part of the State Highway system.
Howeverv Englewood has an obligation to
enforce State Highway requirements that
construction, preferably during night
hours 9 be so conducted as to provide one
northbound lane and one southbound lane
at all times. Also 9 that the fulles t
compaction be had and that the paving and
any damaged concrete work be re placed by
Denver according to original specif i-
cations and grade lineso Current unit
costs should prevailo
7o That Mro R. Co Panesi 9 Senior Design
Engineer for Denver 9 has been contacted
and been posed with the general theme of
all of the above suggestionsQ Be has
indicated to City Engineer Davies that he
sees no trouble or objection in meeting
the various requirementso The set of
sample specifications given to Davies by
Panesi indicate to Davies that in
following such specifications during
construction of the water conduit 9
practically all of the requirements
suggested above will be meto
8. That» although the proposed grade line
for the new conduit appears to pass
above existing Englewood and South
Englewood District sanitary sewer lines
and Englewood water lines 9 there should
be properly designed concrete encasements
required at each pipe line crossing so
as to eliminate foreign pressures and
stresses upon the local sewer and water
installationso This matter was not
posed to Mro Panesio
9o That there should be a general savings
clause in any contractual agreement or
permit which will require thatany un-
anticipated damage to any existing City
owned facility caused by the conduit
construction will also be repaired or
replace do
