Uro William Wo Wheeler of Wheeler and Wright=' Consulting Engineers, appeared to present,
for consideration by the Board~ a proposal for engineering services regarding the prepara-
tion of plans and specilica.tions for the proposed raw water storage reservoil.~ and damo
1,U.o wi~ight pointed out that. this proposal provides for construction to be dona in stages
or as a canplete projec·t; and that the fees submitted are less than those suggested by the
American Society of Engineers due to the accessibility of the dam site and conditions
encountered thereo

After considerable discussion, it was determined by tl1e Board that rtir. Babcock and Mro Shivers
be asked to make a study of the proposal presented and be prepared to make i-ec0!1lll1f3ndatians
at the next nneting of the Wat,er and Sewer Bo . .:irdo
It was reported to the Board that the loa bid for construction of the access road and
bridge across the Highline Canal from County Lina Road to private property was ~;,9 ,640nOO,
submitted by Leon Ko Su..hmo
This amount exceeded that vJhich was previously authorized by the Boai"d, which was to alloo
a maximum expenditure of not more than lcr,t over the original engineer's estimated cost of
$7 ,lOO.OOo (See Water and Sewer Boa.rd 'Mi11utes of October 10, 1960.) However: since the
the Gngineer, in the meantime had admitted t..~at his esti.m9.te on the bridge was too low, i~
was determined that the lcm bid of $9 1 640.00 was fair and reasonableo
I.fro Shivers reported, at. this time, that; Ur,, Kamphau.sen, who will benefit most from this
project, had originally agreed to pay only $,SOOoOO toward tl".J3 cost of the project but,
in negot,1a·cing with him further, since receipt, of the above mentioned low bid_, he has now
agreed to pay $2000"00 . of the costs provided ths City will allow him ·c.o continua to pasture
five horses on land sold by him to the City unt.il January 1, 1962 or until construction. of

Chairman Frantz next reported that, in light or the above developments, he had polled the
Water and Sewer Board membership for approval to proceed to award the contrac"'c on the basis
of the low bid of $9,640000 received October 18, 1960, with the follmving results:

polling the membership by telephone to authorize the City
Manager to award the contract for construction of a road and
bridge to provide access across the Highline Canal from

Upon advice from Mr. Babcock to the Board that notices of annual meetings have been received,
McCabe moved,

proxy to represent the City of Englewood at the annual meeting
of the Nevada Ditch Holding Company, to be held at 2:00 Po Mo,
N011ember 71 1960, in City Hall, Littleton, Colorado, and that
it be recommended that City Council confirm this a.ctiono

between the City of Engl.ewocxi and Cherry Hills Heights
Water and Sanitation Districto
Dear Sir:
The Charry Hills Heights Water and Sanitation District has received
an application from Ro Jo Blanz, 3330 South Clayton Blvd., for a
second sewer tap to serve Lot 21 Block 6, Cherry Hills Heightso
One sewer connection permit has already been issued for this lot

to serve an existing residenceo The additional sewer connection
is required to serve an additional residence to be built on the
prorartyo A Property Onnare Committee of Cherry Hills Heights
has approved the division of Lot 21 Block 6 1 into t~o separate
parcels with a single family residmce on each pa.rcelo All of
Lot 2~ Block 6, is, of course 8 within the area described in the
above captioned Connector's Agreenento
Paragraph 9 of the above captioned Connector's Agreement reserves
to Englewood the right to refuse connections to tm Cherry Hills
Heights VIater and Sanitation District sewer system after the
making of 47 connections to the Cherry Hills Heights sewer systemo
I do not believe that 47 connections have yet been madeo Never-
theless, this figure was originally used in antioipation that it
would permit one sewer connection for each residence er building
site in the District existing as of the date of the Agreement.
Autharization by the District of a second sewer connection for
Lot 2, Block 6, would result in 48 potential connections rather
47 and create the possibility that a residence CJ1.' building
site existing as of the date of the Agreement might be deprived
of a sewer connection when needed. In order to permit the Cherry
Hilla Heights District to grant the application for a second sawer
connection for Lot 21 Block 6, and at the same time protect the
rights of residences and building sites which were in existence at
the date of the Agreement, the Cherry Hills Heights District r~
quests that paragraph 9 of the above captioned Agreement be amended
to refer to 48 taps rather than to 47 tapso This amendnent could
be accomplished very simply in letter form provided the letter was
signed by the proper officers of both the City and the Districto
Please advise me if this ameru:hoont and the proposed form of the
amendment are acceptable. If so, I will draft a letter from the
Cherry Hills Heights District to the City and submit it to you.

~,fro Babcock reported that according to City of Englewocxi records, only thirty taps
have been issued to the Cherry Hills Heights \'Tater and Sani'bl.tion Districto
In the discussion which followed, it was brought out that sewar,e from this area contributes
to the badly overloaded condition of the existing sEn~er laterals in Northeast Englewood
which has been a source of much justified complaint due to the backing up of sewage into
basements of some residences~
It was determined by the Board that,, due to this overloaded condition and, inasmuch as
there are apparently 17 unused taps rernain:ing in the original allotment far this district,
the Board should not recoI1111Bnd any addition to this allotment at this timeo
Uro Babcock was asked to determine the current status of administrative plans for the
correction of the overloaded condition of the sewer laterals in the area and attempt to
be in position to report his findings to the Board at the next zooetingo
~fro Babcock was also asked to advise the Cherry Hills \1fater and Sanitation District by
a letter to Mr., Kelly 0 1 Neall, Jro that the City is not in position at this tine to grant
any additional taps, outside the City in this area, beyond those previously authorized arxl
to indicate in that letter that should the district decide to use one of the previously
authorized unused taps for the second residence on Lot 2 1 Block 6, Cherry Hills Heights~
the Water and Sewer Board will look favorably toward granting necessary additional taps
when the authorized taps have all been used provided, by that time9 t he overloaded condition
in the area has been rectifiedo

Mro Babcock repor-ted to the Board that, the South-East Englewood Water District have
received bids for the installa.tion of alarm equipment to cover activities at their
elevated storage reservoirs and pumping stations and are planning to ha-,,.e the light
and alarm panel :installed at the Englewood Filter Plant as was tentatively approved in
previous discussionso
Mro Babcock poL'l'lted out that this service is badly needed by both the dist,ric:-li and the
City inasmuch as when trouble develops in the area which effects the water pressUJ."e of
the users,, the City continues to receive the complaints and in many past. cases withau·t.
any means of trouble detection, it has been a considerable length of time before the
trouble can ba reported, located and correctedo
Since a Filter Plant operatar is on duty 24 hours per day, it is felt that this is the
logical location for the panel sil.tce., in case of detection of trouble, the plant operatar
can imnediate:cy notify the distric~u' s maintenance psrsonncl so that the difficulty can
be quickly located and remediedo
In a short discussion, it was poin·ted out that~ while the City should cooperate and
participate in the operation of this system, it should not find itself :in a position o£
liability or responsibility in case of human or mechanical failureo

McCabe, seconded, That the Water and Sewer Board recamnend to City Council that
warning system covering the elevated storage reservoirs and
pumping stations of the South-East Englewood Water District,
with the light and al.arm panel located in the City of Englewocxl
filter plant for observation by the plant operator, be approved,
provided, the warning system is adequate to the specifications
of the City Manager; and, that a proper document be executed
which is approved by both the City of Englewood and the South=
East Englewood Wat.er District, absolving the City of any
l"eaponsibility or liability resulting from any activities con-
nected thereYJitho

Mr~ Shivers reported that negotiations for the land anned by 1-!ax Moore and Associates,
for use in the proposed raw water storage reservoir and dam,, have been completed and
the land has been purchased for $279,000oOO a part of which is not payable until 19610

Further consideration was given at this time to the determination 0£ a proper assessment
to be charged the Larsen-Kilpatrick Ccsnpany, 2740 South Platte River Drive, for a sewer
connection recently allowed on the sewage treatment plant outfall line below the planto
(See minutes of meeting of October 101 1960.)

Robohm, seconded, That the Viater and Sawer Bourd recommend to City Council that
the Larsen-Kilpatrick Company be assessed $150.00 conmi:tion fee
and provide for an annual billing of $l0o00 "carrying charge" for
use of the City lllleo
The other members of the Board felt that sufficient study has not yet been given to the
situation and that a sound basis should be used :in arriving at the charges to be mde.
