for the Englewood Water and Sewer Boardo

Mro Sam Olschansky,, owner of the Bell Court .Motel, 2935 South Santa Fe Drive, appeared to
discuss the recent sewage treatment rate increase so far as it concerned his motel busines s
on South Santa Fe Driveo Mro Olachanslq' stated that the annual charges, tor sewage treat=
ment !or his twenty=two unit mot.el, under the new rates effective January 1£> 19609 represent s
a 300% increase over previous charges and wished to point out that since traffic has been
drastically diverted due to the change in the main highway routes, hie business is virtually
at a standstill except for three SW11J1er months of the yearo Jlro Olsch~ stated further
that, in view of these circumstances» it did not seem .fair that rat.ea should be increased
so mucho
It was pointed out to Mro Olschanslc;y that his bill actually represented less than 50¢ per
month, per unit1 whic:h no doubt was the c!leapest rate paid !or ae much serviceo It was
further pointed out t.hat the previous rates were inequitable and were not. furnishing
au!.ficient rsvell11e to cover ee•r plant operations and developnent.; also, that flat rates
could not be adjustecl to location, but only to catagory o! use o

At the regular meeting of the Board of Directors ot Soutb=:Eaet
Englewood Water District held January 14. 19601 a petition for inclu=
sion of the lams of 66 CorporationlJ and ReaJ.cy-Developnent Canpany,
legally described as followsa
The South one=half of the Northeast one=quarter of
Section 24,, Township 5 SouthlJ Range 68 West of the
6th PoMo 1 Arapahoe County, Col oradoJ
was presented to the Board of Directors for considerationo
Also a request for inclusion into the District was received from
Dream House Acres, Inca, of the following described property:
A tract of land approximately SS acresr located in
the Northeast one=quarter ot Section 241 Township
5 South, Range 68 Weet, Arapahoe County, Colorado o
The Board of Directors ot the District def erred action on both
requests for inclusion until an engineering report waa received by the
Board concerning the feasibility of serving these lands with the facil-
ities of the District, and until the City ot Englewood Water and Sewer
Board had advised concerning the right or the District to include these
additional areas into the Districto -
It ls the Board's understanding that no .further inclusions into
the District can be made until such time as the City or Englewood g ives
1 ts consento It was the reeling of the members o! the Board that it
could not act with aey degree of certainty in the~ matters until an
expression had been received from the City of its dispoaition to allow
these inclusions into the Districto

ers of the first above described parcel, and Mro .Elenbogen,, President
of Dream House Acres, Inco 1 the owner of the second above described
parcel wel"f~ advised to contact the Engle wood Water and Sewer Board in
reference to this matt~ro Accordingly 1 you mq-expect a direct approach
by either or both of these partieeo
Our Board of Directors meets again February 11th, at which tm
we should have a complete engineering report concerning the servicing
ot the proposed areas.. azxi it would be desirable if we could have an
expression .f'rom the City of its desire in this matter at that meetingo

We have acquired approximately 5.S acres in the Northwest
Quarter ot Section 24, Township 5 South, Range 68 West,,.
which is directly across the street from our Cherry Hills
Manor Subdivisiono
We appeared before the South=East ,h;nglewood Wa:ter District
yesterdq requesting that the approximately 55 acres be
included within the South=East Englewood Water Diatri.cto
We were advised by them that be.tore they cou.1.d do so they
would have to have the permission of the City of Englewood
to so include this area and they would have to be advised
that taps would be available o
It is our desire to add this area to our Cherry Hills Manor
Subdivision and request is hereby made to you to approve the
addition of this area into the Sout~ast Englewood Water
Districto

Regarding your telephone inquiry of yesterd~ concerning
what plans my clients had tor the developnent of the tract of lam,
which t.ra.et they seek an entrance to from South Clarkson StreetlJ the
matter was discussed with the clientso I am in.fonned that they do
not wish nor do they intend to 11 develop11 this particular tract into
a subdivision, ~t merely desire to move a present structure (now
located near t~ Northeast corner of their property) onto suc h tract
where the same will be used as a one fanily d11elling in connection
llith their bane o The house one moved will serve as quarters for
danestic help EID.ployed by our clients for the maintenance of all of
their propertyo
It would appear that the simplieat solution to this problem
of ingrees and egress would be to obtain the pennission of the Engle=
wood Water Board to move the existing fence on its right=<>f",wq a few
feet to the East, thus, permitting entrance onto the Jones property
to the inmediate East of your firm 9 e electrical installationo If this
can be accanplished such will be satis.tactory to Mro and Mrso Joneso
The only other solution would be for the entrance to open directly
onto South alarkson Street passing directly by and over your present
electrical installations, which you believe would not be satisf actor;y
to your firmo
I trust that the foregoing properly answers your inquiry and
that we will be furnished with the decision of the b:ngle wood Wa ter Board
in the very ar futureo

Mro Babcock explained that the above letter had been referred to h:im by Ur 0 Rust with
an informal request that the Water and Sewer Board give considaration to same as soon
as possibleo
This matter was discussed briefiy at the meeting of January 11, 1960 and was tabled for
further inf'ormation relative to proposed layout and how the area was to be developedo
After some further discussion,,

Robohm, seconded, That those interested be advised that access to the proposed
site appears» to the Englewood Water and Sewer Board» to be
available from existing access on South Clarkson; that right=
of=way to the storage reservoir was acquired under threat of
eminent domain for use as access and a pipeline to the storage
reservoir only, not as a public thorofareo Use as a public
thorofare or by others might result in a claim by the former
owner that the land was not being used for the purpose for which
it was acquiredo For this reason, the request must be deniedo

Council the matter 01' increasing the bond issue amount

approved an additional proposal from the bond house
group to pilot bonds in the amount of $1,000,,000 to be

need is apparent o The bond house group reduced their
