election for the approval of the sale of boode to the construction of a
.sewage collection system for the Town of Bo'Vt=Mar Coloraao.., If all

Gentlemen:
The members of the City Council of Englewood
have asked me to inform you that your lett,er of
February 16th relative to possible sewage disposal ser-
vice has been referred to the Englewood Water and Seiler
Board for consideration at their next meeting on March
14th .. 19600 This Board is an advisory board only.ti but
the City Council depends upon this Board for much con-
sideration and reconmendation in matter of this sort
be!ore the City Council takes official actiono
Since the matter o.f transmission from your
village to the Englewood Sewer Plant would probably be
accomplished through the Valley Sanitation District
lineD it would be most helpful !or our Water and Sewer
Board to have authoritative advice from the Valley Dis=
trict showing that they would permit this movement and
use of their line~o
It is also suggested that soma repr&sentation
from your own District be in attendance at too Water and
Sewer Bovrd meeting on March l4tho

After considerable discussion and clarification as to location of the subject area on the
map,

Scott, seconded, That a letter be written to Bow-Mar Water and Sanitation District,
from the ~nglewood Water and Sewer Board, advising them that the
City of ~nglewood, Water and Sewer Bo~rd, would look favorably
upon treating the sewage from the approximately 50 sites; but~
that no recarunending action can be taken by the .Board until

Tha City is contsmplating some rather ex=
tensive pavement reconstruction on East Floyd Avenue
from Broadway eastward to South Logan Streato There is
also some telephone company construction work going on
in the 00 and 100 blocks on East. Floyd Avenue at the
present time o Both of these matters have brought i"t to
out attention that the pipeline hich conduc·t.s the
Ostrousky water rights away from the Denver City Ditch
is in a very bad state of repair and that it must be reu•
placed.almost i~diately and eertainl.y before arry
paving reconstruction is attemptedo . The attached plat
shows .fairly accurately the routil'lg of the Ostrousky
supply lateral across the City from the Denver City
Ditch to the Ostrousky property near West Dartmouth
Avenue and South Huron Street o Most of the lateral is
in covered conduit and m:th only two short stretches of
open ditch involvedo The City itself ia involved at
every place where the lateral runa in~ along or across
any streets and alleys, the balance of ·l;be location
being upon privately owned propertieao
It appears that the Ostrousky rights are tha
only ones now being served by this lateral and that such
rights consist of only t..°llree inches or 0078 CoF .. So The
whole route of the lateral is causing more and more
trouble and expense of maintenance to all concerned and
now the City ia faced with a large expenditure to put
the lateral in proper shape along ~aat Floyd Avenueo
The estimates of coat for various types of installation
are sho1'V!l upon the attached plato
It appears more feasible and certainly ·
practical to attempt to buy up ·the cistrousky ·rights and
to eliriiinat.e the ·1ong lateral im:ich now exis-..s with ·1ta
attendant troubleso The City .would be .justified in ·
probahl.y ••sweetening" the amount to .·be paid to Ostrou.slcy' s

The Oatroueky's are maintaining a suit against
the City at the present time because of some alleged
drainage damages for which they claim the City is r~
spansiblao There!ore,, we a.re in a bad position to
approach the Ostrou.sky 0 s in the name 01' the Cityo I
understand. that the Tri..,.City Trust is the normal agency
for procurement of water rights in this vicinity and
the ef1'orts of this group or its representative might be
more nearly successful in dealing with the Oatrousky 0 s
at a reasonable priceo Tha City Council has referred
this matter to tl»3 Water and Sewer .Boord .for their con-"
aideration and views as to the most feasible procedure
to eliminate this bad situation and they sug5eB' that it
be given first consideration so that we can resolve ou~

Mro Babcock6 Utilities Director~ reported that the Connector~s Agreement between the City
and the South Englewood Sanitation District provides: uthat the City will provide capacity
tor8 accept, take, treat and dispose of all such sswage from the District's eighteen (18)
inch outfall line at Wast Mansfield Avenue and South Santa .l4~e Driveoie
He al.so stated that now 9 since tha South Arapahoe Sanitation District has come into the
picture and constructed their large line along part o! the same route, it Ylould be
difficult to detennine the amount of sewage in the 18 inch line at Wast Mansfield and
Santa r,e Drive that woulci be from the South Arapahoe Sanitation District and the amount that
would be;) from the South ~nglewood Sanitation Districto
Mro Babcock asked the Water and Sewer Bo..rd if this changed conditionp since the original.
contract, would be sufficient cause to request a revision or ra""'llegotiation o! the Connector 0 s
Agreement with South ~nglewood Sanitation Districto
Mro Shivers, Consultant, pointed out the following excerpt from the Connector 0 s Agreement
with the South Arapahoe Sanitation District: "It is understood and agreed . that the District
may temporarily connect with the lines o1' South J:mglewood Sanitation District Noa lg as
hereinafter set forth» but will, at a later date, connect directly with the trunk line of
the City 01· Englewood at South Santa Fe and Mansfield Ave11ue 11 • , , ·
Mro Shi veris interpreted that 11 at a later date" would mean when said 18 inch line reached
it's capacity; thus~ from then on, the said 18 inch line would be carrying only South
Eng l ewood Sanitation District sewageo
It was detennined» by the Hoard,, that no action was required at this timeo .
· Mr o Babcock, Utilities Director~ reported to the Board that he had recently rec~ived a
verbal request from the Denver Board of Water Commissioll9ra that consideration be given
t o t he possibility of Englewood water service to the Santa Fe Uyo depot which is located
on the south side of West Hampden Avenue between t~ Santa Fe hy o and the D&RGW Ra Ro
main line tracks, which location is in the City of Sheridano The depot is presently
s e r ve d by a 12" Denver water main in West .Hampaen Avenue, l'riti.ch line will be abandoned
in f avor of the proposed new State Highway Interchange soon to be constructed at that
l ocationo An existing 1211 .1.mglewooa water main~ also in West Hampden Avenue, will like=
wi se be· abandonedo Some new water main installations 1'ill be made to serve users presently
c onnected to the 12" J.t.;nglewooa. water main in this vicinity a.na it would be physically
possible to design the installation for a location at a reasonable di stance from the depoto

for consiueration i.'or two sewer taps for property o7med by George Adams which is located
along the north side of West Union Avenue between ·the aast bounda..7 01' ·the Valley Sanitation
District and the west boundary of the ~nglewood City Limitso Mro iiabcock also advised that
he had expected a letter from the Valley Sanitation District relative to this matter, but
that same had not been receivedn
It was determined that., inasmuch as 'c.his property is neither inside the City limit5 or
the Valley Sanitation District, and no formal latter of request 1.'or inclusion had been
received, no action could be takeno

of Directors and Officerso The offices of president
and secretary ... treasurer will become vacanto
There is some kind of an informal agreelll3nt
or understanding that ilro 1ee Jones will resign as a
director and president and that the two remaining members
will then fill the position1 immediately aJ:ter which the
secretary-treasurer will resign and that position will be
filled by the other two director of ficerso The concern
now developing is as to the eligibility of any City
officers or representatives to fill the impending
vacancies when such persona do not actually hold title
to any shares of McBroom stocko The present by-laws re=
quire that directors and of!icers be actual. shareholderso
It was suggested in the City Council chamber
that Mro Babcock hold the position of president and that
.Mro John Curtice hold the position of secretary=treasurer,
strictly as representing the City, and, therefore» re~
taining control o! the Board of Directors and the
officershipso However., the Councilmen feel that the Water
and Sewer Board should give this the Iulleet and earliest
consideration to devise WCf¥S and mean.a to accomplish the
desired results and to suggest the names of the persons
to occupy the two positions about to become vacanto

was .mailed to all Englewood water users on February 23 , 1960, after which.11

efficient publ ic service rendered by the Water Department
in the preparation and distribution of tba "Water Customer
Information Letter" mailed to Englewood water uesrs in

Utilities office, which indicated the anticipated net billing for sewage treatment
for 1960 and the anticipated increase in revenue !or sama in l96o over 1959; also,
showing details of net billing and collections !or both water and sewage treatment tor

Mro Shivers,. Consultant, reported to too Board that, in the process of negotiating for
land purchase for the proposed raw water storage reservoir, it had become increasingly
apparant that the known error in the elevations shown on the Uo S. Go So map might be
indicating land. to be necessaJ7 whereas.. actually 1 if accurate elevations were establiehed.11

Consultation 'With the engineers established tmt an accurate elevation map would ba
essential in a:rr:t event before proper plans and S,tlecifications for the construction of the
dam could be made upo The coat of conducting an actual survey would be equal to or greater
than the cost of having one of the aerial photography companies b.lild up a two foot
elevation contour map from aerial photographs and that the latter map would be more accurate
than an actual survey ..
The engineers were authorized by Mro Shivers to proceed to obtain such map, tJie cost ot
which was $1.115360000 After this map waa obtained~ Counsel was able to eleminate, as
necessary for the reservoir, one parcel of land appraised at $23,000oOO and it appears
the other parcels vihich will have to be acquired for purposes of control may, with a
small amount of expenditure by the City, become ealeable, resulting in partial recovery
of costso
Mro Shivers asked that the .Hoard recommend to City Council the approval. of the expenditure
ot the $1,$)6000 1 for the map, out of bond iu.nds or operating revenue as a part of the
cost of the reservoiro

collections standing of these two phases of t.he Ut,ilities Department functionso

collections for both inside city accounts and outsiaa city accounts, as well as an
indication of the development of both the water and sewel' systems by showing the
chronological increasing of service taps a.nd number of bills rendered thereto as
developrrent progresseso
