HomeMy WebLinkAbout1961-01-18 EWSB MINUTESSPECIAL MEF.TING ENGLEWOOD WATER AND SEWER BOARD "" JANUARY 18, 1961 The meeting was called to order by Chairman Frantz at 8:00 Po Mo Heroers Present: Braun, Frantz, Kreiling, McCabe, Robohm Brownewell, Purcell Members Absent: other Officials Present: Utilities Director Babcock, Consultant Shivers, Assistant City Engineer Barde The meeting was held prima.rily to discuss, in detail, the various poin·t.s brought out in the inter.,,office memorandums from 1-h'o Rudd, City Manager and Mro Barde, As::iistant City Engineer, which were presented originall.y at the regular meeting of the Board held January 9, 1 961 , relative to the existing contracts and agreements betl'Ieen the City of Englewood, tte South Englewood Sanitation District Noo 1 and the South Arapahoe Sanitation District; and to determine the possible need for new agreensnts with said districtso The memorandums referred to above were as follows: "INTER ... OFFICE MEMORANOOH TO: Water and Sew_r Board DATE: January 6, 1961 c/o John Curtice, Recording Secretary FROM: Mro Lo Ro Rudd, City Manager SUBJF.CT: NEW AGREEHRNTS WITH SOUTH ARAPAHOE AND SOUTH ENGLEWOOD SANITATION DISTRICTS The substance in the accompanying memo from the City Engineer's office was brought before the City Council on January 3rd, since the administrative can go no further in informal understandings or temporary agreernentso Al though the working drawings and plans have been checked and found aif4>le, there appears to be an inter- mingling of affairs between the two districts named, wh1.ch are of some concern to tte City but are not covered in any prior documents or contractso Some new phases of concern only to South Arapahoe and the City are also appearingo The restriction in the original contract with South Engle- wood as to permissible quantity of sewage effluent may eV0ntually be circumvented by some proposed joint use of pipelines4 This restriction has turned out to be the only leverage of consequence which the City has available to force a revision or revamping of the original contract between South Englewood and the Cityo There are some inequities developing by virtue of that document which are of a disadvantage to the Cityo After an outline presentation of the matter to the Council, it was referred to the Water and Sever Boara with a suggestion that your Board a:r.Tange a joint meeting of minds of legal counsel and engineers from all three corporations involved, and at the earliest dateo The attempt will be made to have comprehensive plats and maps .• To: available for that sess:J.on to better illustrate the several phases involvedo It is possible that some of those at your table will have recollection of any early discussions on some of the points mentioned in the accompanying memorandumo LRR/ij CC: H. Ho Babcock Wo Oo Davies» Mr o Lo Ro Rudd /s/ L., Ro RUDD City Manager "INTER=OFFICE MEMORANDUM Date: December 29, 1960 From: Mro Neil Barde SUBJECTs FORTY TWO INCH OUTFALL SEWER A review or the preliminacy plans and amendments thereto and specification~ for a 42 inch outfall sewer, submitted by Meurer, Serafini, & Meurer, Engineers for the South Arapahoe Sanitation District, the following are noi!ed: There is no agreement between the City as to the joint use or this 42 inch sewero There should be such an agreement which should inclu~e: Who is responsible for maintenance and replacement, and who has public liabilityo Existing Sel!fer services to be tapped to 42 inch where present 18 inch will not function or interferes with service on 18 inch at no expense to Cityo Right of City to permit taps on 42 inch within present and i"uture City Limitso Tap and service fees to be retained by the Cityo · Right of City to connect any sewer to 42 inch within present or future City Limitso Right of District to construct in City streets or Righi~ of Ways for this Constructiono City's agreement with South Englewood District and South Arapahoe District runs only on Santa Fe to extension of Wo Mansfield Aveo From Wo Hampden north on Santa Fe l1ill be in the City Limitso Agreement should include that part recently put in by the Hip;hway Depto in place of the City's 18 inch sewer at Santa Fe and Hampden Interchangeo Any replacement or rerouting of Cityos 18 inch sever to be 18 inch vitrified clay sewer pif)e, extra strengtho Before a:ny-streets are cut, a permit shall be obtained .from City and repairs to same shall be as specified and approved by the City Engineero City should hold District responsible for trench settle- ment and street repairs over its trenches for a period of not less than two yearso If 42 inch sewer parallels with any water line it shall be not less than ten feet .from said water line, and an,y re .... location of water lines shall be agreed to by the Cityo Maintain intact present 18 inch sewer line and shall maintain a continuous now where designated by the Cityo District to furnish City current construction plans and changes made thereto, and final as constructed planso The District shall designate an individual, during con .. struction, authorized to act for the District in matters con= earning the City o To have a right to inspect sewer construction at all times; said construction being subject to the City's final acceptanceo Any Easements or Rights of Wq acquired by the District should include the CityV s right or ingress and egress for ins• spection and other necessary purposeso Technical aspects of the plans submitted have been checked and found ampleo Copies to: ~lfeurer , Serafini, & Meurer Mro Harold Babcock Mr . Davies City Engineer Mro Bal"de , Assistant City Engineer11 referred to a map to show all of the existing South Englewood Sanitation District sewer trunk lines to the sewage disposal plant, the pro- posed new 42 inoh South Arapahoe Sanitation District line and the points at which the South Englewood Sanitation District line will be abandoned with the new line being used jointly by both districts, and the relocation of lines owned by the City of Enelewood north of West Mansfield Avenueo Mro Barde also presented a Sewer Trunk Line Study, and led a discussion on same which , among other things, indicated that the South Englewood Sanitation Diatrict trun.~ line is , at pre:!lent, carrying less than one~hal! of its capacity and consequently the phase of the original contract with that district pertaining to permissible quantity of sewage eff1.uent would not, as yet, be involvedo (See copy or Sewer Trunk Line Study attached hereto as a part of these mirruteso) In reTlewing the individual points brought out in Mro Barde 's memorandum of Decemb e r 29 , 1960, references were made to the following existing contracts and agreemnts: lo Agreement between the City of Englewood , Colorado and the South Englewood Sanita- tion District Noo 1 , dated October 14, 19520 2o Connector's Agreement between the City-of 'Englewood , Colorado and the South Arapahoe Sanitation District, dated November 8, 1957 0 3o Contract between South Englewood Sanitation District No o 1 , South Arapahoe Sanitation District and the City of Englewood, Colorado, dated November 8, 1957 0 After a thorough discussion of each point of Mro Barde's memorandum, the following determinations were made by tha Board, assisted by Mro Shivers, Consultant, and Mro Barde was so advised: That a letter should be written by the administrative to the South Arapahoe Sanitation District asking that an individual be designated, by the di~trict, authorized to act for the district in matters concerning the City during construction and requesti..!g that same be conii~d by letter from the district to the City, That a letter should be written by the administrative to the South Arapahoe Sanitation District requesting quit claim deeds and other evidences to the City for easements acquired for the relocation of the City~owned portion of the trunk line, same to be furnished at the time of conveyance of the pipelines, as provided for in the original contracto 'lhat all other points of the momorandum were determined to be amply covered by the existing contracts~ agreements and ordinances oover.ing city engineering activities of the Cityo In view of the foregoing, it was the consensus of the Board that a joint meeting, as proposed January 9, 1961, between representatives of the City, the South Bngl~wood Sanitation District Noo 1 and the South Arapahoe Sanitation District, would not be neceasaryo Mro Frantz9 Chairman, once again brought to the attention of the Board that thei owners of the 160 acres of land, generally described as the NEi of Section 24, T5S, R68W, Arapahoe County, represented by Mro J. Glenn Donaldson, have indicated to him that if water se1"Vice cannot be obtained from the City or Englewood in the near future, arrangements will be made to secure sama from the City of Denvero (See Water and Sewer Board Minutes of February 8,, March 14, July ll, September 12, 1960 and Januar.r 9, 19610) The Board was reminded that this area is located within the Englewood service area as set up in the Tri=City Trust Agreement, but is outside the South=East Englewood Water District and the present City of Englewood "Red Line" o The Board was also reminded that the application for this inclusion has been discussed at length previously and, due to tha dire need for development of additional water supply and filter plant facilities to furnish water to any larger area than that to which the City is presently committed, no affirmative recommending action has been takeno Mro Frantz stated that he felt, under the circumstances, definite action should be taken by the Board so that an answer could be given the applicantso After much discussion which included the indefinite time aspects relative to possible development of transmountain water supply and the imminent prospects for rapid growth in the large area in which Englewood is already commit'l~ed to serve water.o Braun moved, McCabe, seconded~. That the application for inclusion of tbe NE~ of Section 24, T5Sg R68W, Arapahoe County, Colorado, into the South=East Englewoo Water District, with Englewood water service~ be deniedo Ayes: Braun, Frantz, Kreiling, McCabe, Robohm Nays: None Absent: Brownewell, Purcell -.. ..
