Mro Sb1Ters stated that he 11&8 in possession ot a draft ot a Connector's Agreement, tor
sanita17 sewer service• proposed for execution between the Ciey-or Englewood and the newly
.formed Southgate Sanitation District, but that he had not had an opportunity to study the
doc ento (Also see minutes ot meeting ot I.larch lJ, l96lo)
Attar sane discussion, 'Which brought out that the sanitation district was anxious to begin
work on the systea and desired that the agreement be signed as soon as possible,

Purcell,, seconded, That the Water and Sewer Board recanmend that the Cormector's
Agreement, between the Cit7 of Englewood and The Southgate
Sanitation District be accepted and executed. by City Council,
subject to the approval of the Utilities Director, Mro Babeook,

Ur. Shivers advised the Board that the Cit7 had not, as yet, acquired ~ An~ Resenoir
water rightso He stated turther that Highline Canal rights acquired were good surf ace rights
which could be used in connect.ion with the reservoiro
ldro Babcock advised that Kro Riley ot the Denver Board ot Water Commissioners bad requested
that a photostatic copy of the deed transterring land and/or water rights to the City ot
Englewood, in the acquisition of the Maurice Ho Fisher lands, be :furnished him so that the
account .for billing ot annual ditch assessment:s can be proper]T changed to the City of
Eoglewoodo
Mr. Shivers was asked to furnish the proper document copy to llro Rileyo
Kr. Babcock advised the Board that Mr~ Talley, o\"i11el' of Lots 27 am 28, Plum Valley Subdivision,
in the vicinity of the proposed raw water storage reservoir, had contacted him relative to a
water bill, past due, 1n excess of $2000.00, which has accrued at a rate of $20000 per monthJ>
covering the premises known as Lot 30, Plm Valle;y Subdivision, DOW owned by the Cit.yo Lot 30,

11r. Shi"Vers stated that he bad negotiated with Mro Talley earlier for Lots 27 and 28 to
include tbe 118llo llro Shivers pointed out that the land bad been appraised at $4,000 per lot,
but, that Mro Talley had indicated that he wanted $2S 1 000 tor the land and nllo
Kro Shivers also pointed out that there are two other wells ill the vicinity on la.nd. no owned
by tbe Cit,. which cao.ld serve the house on Lot 30 and since it is possible that, since it mq
not be necessaJ7 to procure Lot 28 for the reservoir project, it mq also not be necessary to
bey the well provided it is located on Lot 280
It was the consensus of the Board that Kro Shivers and llro Babcock should investigate the
alleged 11&ter bill further; also determ:in1ng the need for the land and/or the well, and
should negotiations not settle the issue reasonably, condemnation proceedings should be startedo

Mr . Shivers reported that he is now in possession ot the abstracts tor the Denver City Ditch
rights cmo.ed by the Englewood Public Schools and is maldng a stud;y o1' same as to possible

requesting annexation to the Cit7 of Englnood. was turned
dom by the Planning Commission in its recomnendation to y-ouo
This area, as you kno'W, is now being served. by
Englewood utilities both Sewer and Water. While the Water
Board has not had a meeting since this recanmendation bas
come to you it has al'mqs been the Board' 5 thought that arJ3'
area in which we are DO\'I' serving utilities should be protected

While it is undoubtedly true that annexation ot this

posal presented at the last meeting of the Board on April lo, 196l.o
Mr. Babcock reporled that a conf'erenoe had been held with llro Rudd, City flan.ager, relative
to the proposal and while Kr. Rudd was quite sympaimic with the situation, under the present
arrangements, relative to the location of the Bllitcbboard, the close proximity of the reliet
clerk-typist and duplicat:l.Dg machine operations, and the fact that, b;y previous directive
of Cit¥ Council, the llunicipal Court Clerk be provided with as nearq private office as
possible., the pl8Jl did not appeer feasible to himo
