Mr o Babcock , Utilities Director, pointed out that two of the three parcels involved in
this request were school sites while the parcel owned by Ruth Porter Waring was private
ownersh i p" Mro Babcock pointed out further that the parcel owned by Arapahoe Coimt y
School District Noo 6 is located in the area presently being processed for anne.x ').tion
to the City of Littleton, and stated that the School District had approached the City
of Littleton for water service and were advised that the City of Littleton was not i n
a position to serve the schoolo This was verified by Mr o Dial, CityManagerD wh'.l_, in
contacting the Littleton City Manager learned that the City of Littleton would be
favorable to the site being included in the South-East Englewood Water District nth

Mr o Babcock raninded the Board that past policy of Englewood has been to off er w·ol ter
and sewer service to schools, where feasibly possible; but, that even more r ecent l y
confinned City policy has been to restrict the further growth of the South~East . .!n.glewood
Water District to its existing boundary on the east for water service to private..cy owned
propertyo
It was Mr ~ Babcock's recommendation that, under the circumstances, the inclusion be
allowed for the two school sites, but not for the privately owned propertyo

Mro Robert Gei:'Win of Coughlin & Campall1', Denverv also representing the firms of Petersii
Writer & Christensen; Bomrorth, Sullivan & Company and Boettcher and Compa.ey-1 appeared to
discuss with the Board the proposed water bond issue to finance the Western Slope Developco
ment of water rights and the construction of Englewood Noo l Dam and Appurtenant Works.,
Mro Gernn presented two schedules for proposed water bonds, both in a total smount of
$5 9 000;0()0» 11Jhich included the existing outstanding water bondsn One schedule was computed
over the period 1963-~1987; inclusive, or 2.S years, whjJ..e the other was canputed over the
period 1963-1992, inclusive, or JO yeareo
Mro Gerwin stated that the schedules were designed only as examples since he realized that
the City had not determined a firm .figure on which to design an actual schedule o Mr o Gerwin
stated further that in order for a proper proposal to be ma4e, it would be necessary for the
Cit7 to make a determination of its financial needs to canplete the proposed projects, as
well as the amount necessary in the initial bond issue for the more immediate .t'utureo

In response to your telephone request of a few da¥s ago, 11e
have prepared a preliminary, tentative cost estimate and construction
schedule of the proposed Englewood Transmountain Diversion System.a Our
estimatep because our surveys and plans have not been ccmpleted6 have
been based on the Tipton and Kalmbach reports and specifications dated
April, 19560 We adapted these data to the City•s present diversion plan
and updated the costs to present current costs ~
The tentative construction schedule has been based on initiating
construction next year and continued on an annual basis ... if construction
should be delayed the dates should be revised accordingly, i oe o by yearso

In the discussion following, it was bI_'ough ~ out that Schedules A and B, as set out in the
letter of July 2 1 1962• relative to Western Slope Developnent , should be cons i dered aa
essential in the determination of the tota.:L bond program, nth Schedule C to 'be d eferred
for later consideration for bonds., if necensaryo
It was also brought out that, since the contract for t he construction of Englewo od No o 1
Dam is due to be awarded probably in Augua1 ; of this yea r 0 the total estimated co s ts of
same, as set out in the letter of June 25 1 1962 9 should be included in the total bond
program .,
In further discussion, it was ~elt by the foard that provisions for possible construction
of a filter plant at the Englewood No o 1 Dsm site should be mad.e a

The matter of the 1963 Water Depart.ment budget was next discussed, relative to !inances
for the above discussed projectso
At this point, Mro Shivers, Water and Sewer Board Legal Consultant, related that at the
recent diligence hearing on Englewood's Western Slope water rights, the City of Denver's
legal representative appeared and was actively contesting the Western Slope decrees; that,
legal counsel ror Denver advised that if the court rendered a finding in favor o! Englewood~
it would be appealed to the Supreme Courto If it is adverse1 Englewood, undoubtedly would
appealo Consequently, unless Denver should change its position, the development of the
decrees, insofar as large expense is concerned, might very well be delayed for some timeo

they endorse the issuance of an estimated $41 0001 000 of water
bonds to be used for the capital improvements, scheduled over
the next five years, in the development of Western Slope water
rights and the construction of Englewood Noo l Dam and
Appurtenant Works; ei,750 1 000 o! said bonds to be issued on
or before November 11 1962, to cover obligations anticipated
through 19640

Further, inasmuch as Coughlin & Comp~ have a contract as
fiscal agents !or the financing of the construction of Englewood
No., 1 Dam and Appurtenant Works, that consideration be given
this ccmpal'>1" for service as fiscal agents for the proposed
issuance of the $4,000,000 of •ter bonds, since this COlllpaey
al.so has cooperated with and participated in the financial
development of Englewood's water systemo

City Council at its regular session on July 16, 1962, based on the total anticipated bond
issue of $4,0001 000 9 and the issuance 01' $1, 750 1 000 ot bonds in the immediate fu···ure ,,
In further discussion on the Western Slope diligence hearing., held 1n Hot Sulphw· Springs,
Colora.doa on July 9, 1962, J.lro Shivers, Consultant, stated that, at the request of Denver's
legal counsel, same had been continued to July 25, 19620 It was the opinion of !Arc Shivers
that, it' there is to be a legal fight with Denver in this matter, it would be be·' ter to get
it over with nowo The supporting diligence would, therefore, be far more expens i ve than
anticipated and additional assistance, both engineering and legal, would be requi red and
Mro Shivers requested authority to obtain such assistance, at his discretion$ and speIXi
such monies as might be necessary to present a full scale defense of Englewood's conditional
decreesn

Meadow Creek and Strawberry Creek and for righir<>f·-ir~ across forest lands near and parallel
to Englewood.Vs proposed right,c..of-way; and, although any water rights aoquired by Mro Elliot
lfOuld be junior in point of time, these filings8 none the less., could very ll interfere
with right&-af~~, Adams Tunnel use and water rights of Englewoodo Mr., Shivers requested
authority to appear in court:i in opposition to the Elliot filingso

Mro Shivers, Consultant, reported that the Stewart land9 former]¥ lmmm as the Woodburne
property, located in Section 33, T 5 s1 R 68 w, north of _ County Line Road and southwest
of the High Line Ganal9 consisting of 4o44 acres, could11 by' negot1ations 9 be purchased
for $10 9 0000 Mro Shivers pointed out that this represents virtually the last piace of
land to be acquired tor the Englewood Noo l Dam and Appurtenant Works, and that t.he price
is slightly less than the appraised valuationo
Uro Shivers reminded the Board tb.at this price is within the limitations of previous City
Council authorization to acquire the needed land for the raw water storage Dam and Reservoir
which al.lows up to 5% bqond the appraised valuationo
It was the unanimous opinion of the Board that Mro Shivers should negotiate for the purchase
of the Stewart land at a total price of $10ti000o
A proposed Amendment to Ordina.noe Noo 31, Series of 1957, permitting the draining of
swimming pools into the City sanitary sewer systan, was presented for Water and Sewer
Board considerationo (See copy attached as a part of these minuteso)

A short discussion was held relative to the possibility of holding future Water and
Sewer Board meetings in late afternoon rather than during the evening, to af'!ord a better
opportunity for all members to attendo
Since all members present were agreeable with the plan, Chairman Frantz stated that
beginning with the next regular session of the Water and Sewer Board, future meetings will
be held at .$:00 Po Mo~ the secom Wednesday of each month, in Ciey Council chamberso

SUCH FACILITIES IN THE CITY OF ENGLE\'fOOD, COLORADO BY DELETING THEREFROM
"SECTION 6 .., DISCHARGE SYSTEM" AND SUBSTITUTING THEREFOR A NEW SUCH

BE IT ORDAINED BY THE CITY OOUNCIL OF THE CITY OF ENGLEWOOD, COLORADO:
Section 1, Ordinance 31, Series of 1957, of the Ordinances of the City
of Englewood, Colorado for the const.ruction and regulation of private swimming
pools and other such facilities of the City ot Englewood, Colorado is hereby
amended by deleting therefrom "Section 6 .. , Discharge System" and substituting
thera.f or a new such Section llhich shall read as follows:
"Section 6 .,., pischarii)gSystem: All private sw.imming pools constructed
within the City of lewood shall be proVided with one drainage outlet9
not in excess of three inches in diameter extencling 8 from such pool to
either a brook, storm sewer or lawn sprinkling system on the premises on
which such private pool is locatedo The discharge of water from such
private swimming pools into a brook or sewer system shall be permitted
only by approval of the proper state, county and city officials aa each
case requireso No pool drain shall be connected directly into the city•s
sanitary sewer system; provided that, such ::.-wimming pools may be drained
into a noor drain through a maximum two inch wide outlet maintaining an
air gap., Each time that arry such swimming pool is drained, a drainage
permit must first be obtained !rem the utilities department and the pool
must be drained during the t:ime specified on the drainage pe.nnitc aste
water from back washing the filters may be drained through a floor drain
or through a sandtra.p,, or both» without a permito A charge of $.S oOO shall
be made for a permit to drain a public or sani.,.,public swimming pool into
the sanitary sewer system and a charge of $2oQO shall be made for a. private

in order to determine the proper place and type of connection with the
