Mro Babcock, Utilities Director" advised the Board that the annual stockholder's meeting
of the Nevada Ditch Holding Company will be held Mondq, November S~ 1962~ at 3:30 PoHo
in Littleton City Hall~ Littleton~ Colorado; and~ the annual stockholder's meeting of The
McBroom Ditch Company., Ince will be held at 7130 PeMo on that same date in Englewood City

Mro Babcock reminded the Board that it is necessary, a.nnually::i for the City of Englewood to
designate a proJ<Y to vote the City or Englewood Shares in these companies at the annual
meetingso

Mr. Braun~ Councilman and Water and Sewer Board members advised the Board that he had not
been able to attend Water and Sewer Board meetings since the meeting time had been re.-
scheduled at 5tOO PoMo on the second Wednesday of each month; and, that he 1r10uld not be able
to attend future meetings at this time because of prior oommittmenteo
After polling all Board members present for a meeting suitable to all,, Mr.a Frantz9 Chairman.,
declared that future regular meetings of the F.nglewood Water and Sewer Board will be held
at 5cOO PoMo 1 the second Tuesday of each month, beginning with November 13,, 19620

A short discussion was held relative to the actual possibility or the City of Eilglewood .
ever being able to secure the cooperation of the City of Denver, Board o£ Water Commissioners,
for the joint use or the Denver City Ditch in transporting raw water from the South Platte
River to Englewood No. 1 Reservoiro
It was pointed out again9 as in former discussions, that the alternate method for trans-
mi tting this water would be through a pumping station located at the South Platte River,, thus
eliminatiJlg the use of the City Ditcho
The Board was ref erred to the preliminary estimate of costs in the comparison of the two
methods 0£ transmission, as set out in Mro WG W" Wheeler•s letter of September 5~ 1962~

The Board, having determined that the joi!lt use of the Denver City Ditch on an economicall:y
teasible basis will apparently be inpossible in the foreseeable future, agreed that the
City or Englewood should make a fir111 decision to use the alternate method of locating the
punping station at the South Platt9 River for tranSllli.ssion of the water directly to the
reservoir, in order that planning may proceed along those lineso

Boreas Pass water rights Wa.3 brought \lP for discussio~ Mr~ Braun had indicated that it
was possible that the City of Colorado Springs may be interested in the purchase of these
rights.,
After short discussion, Mro Shivers, Consultant» was asked to contact the proper City
officials 0£ tbe City ot Colorado Spri.>'lgs to determine whether or not they may be interested
in the purchase of the Boreas Pase water rightsp

Dear Sir:
Reference is made to the construction of the 8 ... inch over-
now line from your sewage lift station to the South Platte Rivero
Apparently there has been considerable mis.=understanding
relative to the justification and approval by those vitall.y concern,...
ed with this project.
The State Statutes provide that a City shall have the right
to protect its municipal water supply from contamination for a dis~
ta.JlCe up to five miles above its intake on a streamo The City of
Englewood was not aware of this proposed project prior to the adver=
tising for bids and then only by accidento Immediately upon being
notified or the advertisement .from an outside source,, I called Mro
Dale Rea, your engineer, and advised him that I was concernedo On
August 23,, 1962 I received a copy of the plans and specifications
from Mro Reao On August 27th,, 1962 I wrote the Colorado State Depart.»
ment of Public Health asking if they had approved the pla.nso A
reply was received by letter dated August 30# 1962 informing me that
the plans had not yet been approved but that they were currently rec-
viewing themo
Nothing further was heard from the State Dapartme.'lt of Public
Health until I received a copy of a letter addressed to Mro Reat)
dated September 10,.1962 fromMro Prince, Chief of the Public Health
Engineering SectionD acknowledging the receipt of the plans and speci0
£ications for the subject overflow line and in which he questioned its
use! and stating in part that "the wasts would be objectionable in the
river at that point because of downstream U8e of the watero"
It was felt by the undersigned that this should have been
a warning and that before any turther progress was mad0 on this project
the City of Englewood Utilities Department would have been contactedo
Instead, construction of the project continued and upon a visit to the
job September 18, 1962, I find that the job is approximately 75% com-
pletedo
I carmot help but agree .with Mro Prince of the State Health
Department that if the operations of the pumps in the sewage lift
station are to be made foolwproof by a signal system, etco-as stated
in Mro Rea• s letter, w is it ob actionable to run the ossible over-now into the lakes or po 88 B be g done now?
It is not understandable to me why a projectn whereby it is
evident that there would be objections due to possible contamination
of the South Platte River.11 was considered in the first place, and also
after being planned it was permitted to proceed so far without £!rat
getting some kind of an opi..1'lion or reaction .from those parties vitally
interested, namely, the City of Englewood that depends on its main water
supply from the South Platte River and the State Board of Health whose
responsibility is to help protect public water supplieso
The-object or this letter is to emphasize the concern of the
Utilities Department of the City ot Englewood and to object to any
suc h project whereby there is the possibility of rtm sewage entering
the South Platte River abov our headgate, the same to be a matter of
recordo

proposes to bring legal action against the sanitation district and recommended that the
City of Englewood do likewiseo
