1. MINUTES OF THE PHONE VOTE OF APRIL 11, 2006.
• The Englewood Water and Sewer Board approved the minutes of the phone vote of April
11, 2006 meeting.

2. GUEST: T.W. ANDERSON .
T. W. Anderson, an Englewood businessman and local builder, appeared as a guest to
express appreciation to the Water and Sewer Board for doing a commendable job over the
past years for the City of Englewood. Mr. Fonda and Mr. Anderson discussed various
projects that he was involved in over the past several decades. The Board thanked Mr.
Anderson for appearing before the Board.
3. WATER RIGHTS UPDATE.
The Board received a copy of the May 11, 2006 Water Rights Review from David Hill,
Englewood's Water Attorney.
4. KENT PLACE SALES CENTER.
The developers of Kent Place, located and Hampden and University, have requested to
connect temporary water and sewer services for their sales office into the private water
and sewer system owned by Kent Village. Stu noted that an agreement will be required
and should address that the tap is temporary, cannot be transferred upon sale and must be
disconnected by a specific date.
5. DRAINAGE AND FLOOD CONTROL IMPROVEMENTS FOR NORMANDY
GULCH.
Stu discussed an agreement that was submitted to the Nevada Ditch Company, in which
the City of Englewood is a majority stockholder. In the agreement, Urban Drainage and
Flood Control, the Town of Columbine Valley and the Nevada Ditch Company will
proceed to design and construct drainage and flood control improvements for Normandy
Gulch on the Nevada Ditch. Urban Drainage will be paying 50%, with Columbine and
Nevada Ditch each contributing 25%. The Board concurred with Nevada Ditch's
participation in the agreement.
6. INFORMATIONAL ARTICLES.
The Board received the following informational articles:
• "Farms high and dry," from the Rocky Mountain News.
• "Alarm sounded on water," from the Rocky Mountain News .
"Cities protecting their water turf," from the Rocky Mountain News.
"Boulder and allies consider water plan to help farmers," from the Rocky Mountain
News.
"Water drips down to plains farmer's ," from the Rocky Mountain News.
"Farmers plead for irrigation plan," from the Rocky Mountain News.
"City's property in Douglas County viewed as asset for Englewood," from the Englewood
Herald.
"City Council establishes 2006 sewer rates," from the Littleton Report.
7. HANDLING DELINQUENT ACCOUNTS WHERE THERE HAS BEEN A
RECENT REAL ESTATE TRANSACTION.
The Board received a proposed policy regarding delinquent accounts where there has
been a recent real estate transaction. If approved, all collection activities would be
suspended for thirty (30) days allowing time to resolve the bill in the case where a
property receives a final notice or a red tag.
The benefit of the doubt shall be in favor of the buyer and late fees can be waived.
During this investigative period no services will be disconnected and if the water has
been turned off, it will be turned back on for this period of time.

8. WATERING RESTRICTIONS.
To approve the proposed, "Handling
delinquent accounts where there has been a
recent real estate transaction" policy. (See
Attachment A).

Stu noted that summer water demand has decreased due to water conservation efforts
resulting from the drought cycle that has occurred in recent years. The policy of requiring
• meter installation when property changes hands has also contributed to this reduction.

Englewood is not planning to impose watering restrictions for the 2006 summer. The
Board will be advised ifreleases or calls on Englewood's water rights dictate a change in
policy.
The meeting adjourned at 5 :53 p.m .
The next Water and Sewer Board meeting will be Tuesday, July 11 , 2006 at 5 :00 p.m. in
the Community Development Conference Room .

Subject : Handling of delinquent accounts where there has been a recent
real estate transaction.
In final notice/delinquent account/red tag cases where the property has been through a
real estate transfer during the last billing period (since the last bill was issued), and
questions arise about receipt of payments, all collection activities will be suspended for
thirty (30) days to allow time to resolve all questions or disputes .
The benefit of the doubt shall be in favor of the buyer or new customer, and late fees can
be waived as a matter of course for the buyer.
During this investigative period no services will be disconnected . If the water has been
turned off, it will be turned back on for this period of time .
When researching customer complaints of this nature, always find out when they
purchased their house . This information is also on line at http://www .co.arapahoe.eo.us/.
We will recommend that they contact their realtor or title company to resolve any
disputes . We will furnish any documentation requested .
